Hart Studies in Comparative Public Law

This book offers an in-depth understanding of the challenges, dilemmas and strategies of reinstating the rule of law after the dismantling of a constitutional order. Drawing on the case of Poland's democratic transition back to the rule of law, the volume explores the uncharted territory of restoring independent institutions within an EU Member State. After eight years of autocratic interference with the judiciary, media and state institutions, the Parliamentary elections of October 2023 mark a turning point for Poland. The new government now faces the complex challenge of restoring the rule of law, with European and international law playing a pivotal role. Still, at numerous crossroads a dilemma comes up: Can the rule of law be disregarded to restore it? Or must the rule of law be adhered to at the risk of legal and institutional paralysis? This book presents strategies for solving this dilemma in theory and practice, thereby paving the way for other states' transitions to come. Through a comparative and interdisciplinary approach, including historical and contextual analysis, the authors show that restoring the rule of law is more than just a legal challenge. This volume equips academics and policymakers with conceptual tools and practical guidance to address the pressing issue of reinstating the rule of law, both in Poland and beyond.

Gender Equality Behind Bars represents the first analysis of prison and immigration detention policies, broadly identified as penality policies, within the context of gender policy studies. Adopting an interdisciplinary approach, it provides a roadmap for better understanding penality policy from feminist and gendered perspectives. An introductory chapter examines the paradoxical relationship between gender equality and life behind bars for women. This is followed by ten in-depth case-studies on gender and penality policies in a unique line-up of countries in the Global North (Denmark, Poland, Portugal, Canada, the UK and Spain) and the Global South (Zimbabwe, Uruguay and Peru). The comparative conclusion identifies cross-national and cross-sectoral trends and proposes a research agenda for a gendered approach to penality policies. Issues including discrimination against women prisoners and women migrant detainees, gender-bias in prison environments and potential for gender transformation "behind bars" are covered throughout the book. Sustainability Law: Comparative, Interdisciplinary, and Intradisciplinary Perspectives

This book provides the first in-depth study of the crime of bigamy from the 17th century to the present day. Between 1604 and 2024, around 30,000 individuals were prosecuted for bigamy in England and Wales. A few were able to establish a defence to the charge, but most were convicted. How they were punished varied hugely across the centuries - from execution, branding, whipping, transportation, and imprisonment through to fines and community service. Double Trouble details the legal framework that underpinned such prosecutions. As a companion volume to Double Lives: Stories of Bigamy in England and Wales, 1604-2024, it sets the offence in the context of the changing laws on marriage and divorce, and examines the consequences of bigamy for those involved, including the remedies that were available to the often-deceived second spouse. Drawing on a wide array of sources from the 17th century to the present day, including formal law reports, legal treatises, newspapers, censuses, parish registers, divorce petitions and Parliamentary debates, this book shows how bigamy should be taken seriously as an offence that all too often involved deception, abandonment and heartbreak.

This book considers whether Parliament recognises a constitutional right to property. Parliament is supreme: in theory, there is nothing to stop it from passing laws to confiscate property. Nevertheless, MPs often argue that a proposed law would be unconstitutional. What does this mean in a system without a written constitution? What counts as a sound argument about constitutional rights? And what influence do constitutional arguments have on the legislative process? The book takes a close look at these questions. This book explores how multisector collaboration approaches in Kenya and South Africa contribute to the fulfilment of human rights state obligations to prevent and effectively respond to sexual violence against women. Applying a feminist human rights perspective, the author unpacks state obligations to exercise due diligence in prevention, protection, prosecution, punishment and provision of adequate remedies to victims. This perspective puts victims’ needs and rights at the forefront in assessing service integration models, while foregrounding the need for state accountability to establish sustainable and effective sexual violence interventions. Using a qualitative case-study approach and interview data, it analyses how sexual violence service integration centers operate in urban, peri-urban and rural contexts . It demonstrates how these multi-sector collaboration approaches can produce different service orientations that may eclipse and de-center the needs and rights of sexual violence victims. The author concludes by discussing the parameters of what a victimcentered service integration approach would look like and highlights critical ways to shift deeply-rooted social, structural and institutional norms, which are the root causes of violence against women.Ruth Nekura
 is a legal scholar, human rights advocate, feminist thinker and sociolegal researcher with 15 years’ of sustained work experience in social justice, with a focus on law reform, research, strategic litigation and advocacy. She is passionate about access to justice, substantive equality and invokes both structural and individual level analyses to challenge systemic inequalities. Ruth works as a consultant, providing technical expertise to civil society organisations’ through conducting (human rights and gender) analyses of laws, implementation practices and program interventions, conducting capacity strengthening, strategy development and knowledge leadership.

A woman remarries after hearing that her husband has drowned, only for him to turn up alive and well. Is she now a criminal? A deserted husband, unable to afford a divorce, finds happiness in a new union. How many did the same? A conman advertises for a wife and then disappears with her lifesavings; he has already done the same to many other women. How was he brought to justice? These are just a few of the hundreds of bigamous remarriages put under the microscope in Double Lives. As a companion volume to Double Trouble: Bigamy and the Law in England and Wales, 1604-2024, this book goes behind the law reports to reconstruct the stories of those involved. Drawing on archival sources, pamphlets, newspapers, census data, parish registers, divorce petitions and family histories, it shows the different forms that bigamy might take - accidental, consensual, deceptive or exploitative - and how bigamists' stories in turn helped to shape the law. Double Lives shows how bigamy should not be dismissed as a comical or victimless crime. Every case had its own complex mix of desire and deception, and, all too often, heartbreak for someone.
