Masterpieces of Contemporary Jurisprudents in China

This book is the first academic monograph in China to comprehensively examine the concept, principles, and system of civil law from an ethical point of view. Under the background that China has promulgated the Civil Code, it is necessary to analyze the relevant contents of the Civil Code from all aspects, in depth and from various angles. The basic point of view is that China’s Civil Code should not only consider the advanced nature, but also take into account the national character, sublimation, and inheritance, and to meet the needs of modern society and demonstrate the ethical value. This open access book presents a thorough, multidisciplinary examination of children’s rights in Central and Eastern Europe (CEE) with a focus on Lithuania. Pursuing a comparative approach, it explores various aspects of children’s rights as established in constitutional, civil, administrative and criminal law in the region, while also discussing emerging issues. The book shares unique insights into the challenges and progress specific to individual CEE countries, many of which have undergone significant political, social, and legal transformations in recent decades. The comparative analysis of practices and legal frameworks between Lithuania and other countries in the region and across various CEE countries is a key feature of the book. By comparing practices, case law and legal regulations across different CEE countries, it highlights both the diversity and the common challenges in the region. Moreover, such a comparative perspective is invaluable for policymakers, practitioners, and academics in terms of identifying best practices and learning from different countries’ experiences. The respective chapters offer evidence-based insights and recommendations to guide the development of more effective and rights-based approaches to child protection. While aiming to enhance awareness and understanding of children’s rights, the book also seeks to fill a gap in the literature by focusing on the CEE region, an area often underrepresented and overlooked in global discussions on children’s rights. This book considers whether Parliament recognises a constitutional right to property. Parliament is supreme: in theory, there is nothing to stop it from passing laws to confiscate property. Nevertheless, MPs often argue that a proposed law would be unconstitutional. What does this mean in a system without a written constitution? What counts as a sound argument about constitutional rights? And what influence do constitutional arguments have on the legislative process? The book takes a close look at these questions. It reviews legislation and debates from the Middle Ages through to more recent legislation, and covers a wide range of topics, such as land reform, nationalisation, taxation, regulatory laws and retrospection. It also looks at the most recent debates and considers the relevance of constitutional thinking to election manifestos of the main political parties.

This volume brings together the revised and peer reviewed scientific contributions presented at the 5th Conference on Comparative and International Law (27 June 2025), jointly organized by the Law Center of the Catholic University of Petrópolis (Brazil) and the Society of Juridical and Administrative Sciences.
The book explores the intersections between law, ethics, and human vulnerability through a transnational and comparative lens, addressing some of the most pressing challenges of our time: technological risks, equality and responsibility in evolving legal frameworks, and the pursuit of justice in the fields of human rights and international criminal law.
The volume is structured into three thematic parts: (1) Technology, Risks and Global Governance – examining how global administrative law, artificial intelligence, and medical innovations such as xenotransplantation generate both opportunities and existential risks, thereby calling for renewed forms of international regulation and ethical responsibility. (2) Responsibility, Equality and Comparative Legal Perspectives – engaging with philosophical and legal perspectives on responsibility, analysing authority and social hierarchies within civil law traditions, and evaluating the principle of equal opportunities between women and men in electoral law from comparative angles. (3) Justice, Human Rights and International Criminal Law – addressing forgotten or ongoing struggles for justice, the contested authority of the International Criminal Court, and the strengths and limitations of climate change litigation as a mechanism for advancing environmental justice.
The central theme of the book is how legal and governance frameworks can address human vulnerability in a rapidly changing global context, where ethical dilemmas, technological disruptions, and structural inequalities converge.
