Critical Criminological Perspectives

This book explores narratives and practices around gender and criminal justice, with a focus on women in Latin America. The chapters are written by academics, policy-making institutions, women with lived experience and activist actors in Latin America. They provide a distinctive analysis of gender and criminal justice in the region, along with the tensions between victimization and agency in women’s paths of criminalization. This book looks at women’s resistance and responses to States’ processes of gender stereotyping and punishment. Ultimately, it showcases women’s collective capacity to shape the security agenda.
Corina Giacomello is Professor of Sociology of Law at the Institute of Judicial Studies of the Autonomous University of Chiapas, Mexico. She is an academic and international consultant with expertise in gender studies, children’s rights, criminal justice and prison systems and drug policies. She has 20 years of experience in advocacy-oriented research and development of legal, judicial and public policy proposals at the national and international level.

This book assembles critical contributions on the work of TRS Allan, the Professor Emeritus of Jurisprudence and Public Law at the University of Cambridge, whose leading work in legal and constitutional theory spans almost 45 years. Allan has charted a distinctive path for legal, political, and moral theory and practice and has become a highly significant figure in the UK and in common law/parliamentary systems around the world. His ideas challenge established opinions about constitutional law within these systems as well as established views about the rule of law from more abstract or philosophical perspectives. Allan claims that law and morality find an inherent connection through the rule of law. He argues that there is a connection that flourishes in common law jurisdictions because although Parliament has sovereign legislative powers, its laws gain their full legal meaning only through an interpretive lens. This lens seeks to reconcile sovereign will with legality's basic moral ideals, especially the idea that law must be general and capable of guiding behaviour and thus respectful of the equality and dignity of its subjects. In this book, John Finnis provides a virtually unparalleled, in-depth assessment of Leon Petrażycki’s work by a Western scholar. In the opening chapter, Finnis takes up the challenge of reading Petrażycki not simply as a historical curiosity of Eastern European jurisprudence but as a thinker whose wide-ranging and ambitious ideas continue to spark debate today. He critiques not only Petrażycki’s non-standard “economic analysis of law,” which differs markedly from the Chicago School model (not to mention from Guido Calabresi’s and Pietro Trimarchi’s versions), but also many other aspects of Petrażycki’s various contributions to jurisprudence. These include, above all, his legal-realistic but nonetheless appreciative treatment of the natural-law tradition(s), which makes Petrażycki both distinctive and difficult to classify in terms of standard schools of thought.Finnis’ essay is followed by nine further contributions. Written by scholars from different traditions and standpoints, they criticize, reassess, and elaborate upon Finnis’ arguments, creating a rich and multi-voiced dialogue. This open access book examines the evolution of employment tribunals from a speedy, informal process to a system marked by delays and significant financial and human costs. Resolving disputes in the workplace is difficult, expensive and emotionally charged. The current system is broken but what is the answer? Using material from a large-scale empirical study, including a survey of over 200 practitioners, the book examines the problems facing the system. It then considers how these problems are addressed in other jurisdictions both in the UK and in other countries. The book then examines what can be done. It suggests that locating labour law disputes within a contract-tort-human rights frame takes insufficient account of the fundamental emotional and behavioural factors that are in play. The book therefore argues that much can be learnt from the resolution of family law disputes, whether it be in relation to how a relationship that has ended can be satisfactorily concluded, or how a relationship with ongoing ties can be managed going forwards. Utilising this theoretical reframing, the book proposes a blueprint for the future of employment dispute resolution. This book is for policy makers, practitioners and academics looking for a rigorous empirical and theoretical analysis of what has gone wrong with employment dispute resolution and what can be done about it. The Principles of Family Business Law

This book considers the lessons that can be gleaned from the Occupy movement, some 14 years after its inception. The Occupy movement brought with it many things, including a renewed interest in class and class struggle. Using the work of Nicos Poulantzas as its departure point, the book considers the theoretical and conceptual parameters of class structures under the most contemporary form of capitalism: the monopoly finance capitalist stage. An examination of state responses to the Occupy movement reveals the ability of the exploiting classes to maintain and reproduce the capitalist system via an expression of political power through the state and its tendency to deploy both ideological and physical defenses against any significant attacks on capitalism. The analysis offered reveals how some degree of anti-capitalist opposition is tolerated until such time that it must be forcefully censored and stopped, coined here as ‘the authoritarian state with a democratic alter-ego’, offering a nuanced conceptualization of state power for readers to explore and apply for themselves in other contexts. For the nature of the state to change significantly, social class agents need to find ways to access greater autonomy from the shackles of its power. This book explores the ways in which attempts to take up counterhegemonic class positions are persistently thwarted by a pervasive and yet intricately configured state power, backed by profit motivated corporate interest. It also poses urgent questions about the role and nature of alliances when trying to challenge both ideological and forcefully repressive state practices under capitalism. The book considers how we ‘find each other’ again in future struggles against capitalism and the attendant harms that it produces for the whole of humanity and the planet.
