Critical Criminological Perspectives

This edited collection reflects the diversity of gender-based violence and presents new perspectives and expands current scholarship in global contexts. It considers behaviours and actions including digital, interpersonal and institutional violence which are not readily understood as violence but are experienced as inherently harmful. It showcases how digital technology permeates violence and harm in diverse ways – whether this be via surveillance technology, harmful ideology or hate speech online or the globalised nature of the internet. With reflections on how people can research and challenge gender-based violence and harm in the future, it speaks to those interested in digital harm across Sociology, Criminology, Psychology, Youth Studies, Education, Law, Media and/or Cultural Studies.
Angela Wilcock is Senior Lecturer in Criminology at the University of Sunderland, UK, as well as having a professional background with vast experience in front-line service provision, working with the most marginalised groups in society.
Helen Williams is Senior Lecturer in Criminology at the University of Sunderland, UK. She engages in research on the state and social regulation of sex and sexuality and has published on slut-shaming, sex work and sexual violence.

Despite the remarkably serious problems caused by aging and population decline in Japan, there are very few books that inform the world about them in English. Through this book, a Japanese economic demographer clearly shows the various economic consequences of population problems in Japan, especially the impacts of continuing ultra-low fertility and the world's highest life expectancy in the post-demographic transition phase. The explanation is at a basic level but covers the overall economic issues including labor, capital, technical progress, consumption, savings and investment from a demographic perspective. Finally, some remedies for economic growth in Japan are proposed. Because economic policies are expected to have short-term effects while demographic ones to increase the fertility rate need some time to take effect, earlier books about the Japanese economy have hardly ever dealt with demographic policies. Furthermore, this book directly addresses the integrated economic and demographic policies appropriate to Japan. These are different from the French natalistic social policy, the Scandinavian policy of a work-life balance or the immigration policy in Australia or the United States. This book emphasizes the power of local communities in Japan as a part of East Asia. In this sense, the book provides a new key to readers who are interested in the future Japanese economy and population.

Passion and Power is about the life and career of Harriet Newman Cohen, one of the nation's most celebrated divorce attorneys, as she navigated the male-dominated legal world from the 1970s to today. This sweeping narrative details Harriet's journey through three worlds: raising a family at a time when men held all the power, graduating from law school on the cusp of the "divorce revolution," and re-fighting old battles over women's rights in today's time of reaction of retrenchment. The frankness with which Harriet relates her own experience is matched by equally candid insights into how a legal system that often rewards bad behavior and irrational decision-making shapes the culture at large and impacts those trying to navigate their way towards a better life. Writing with candor and humor, Harriet describes her encounters with celebrities, mentors, notable judges, allies, and adversaries. She examines many cases but describes three in almost novelistic detail, all drawn from her own practice-including her pivotal role in the "Case of a Lifetime," the focus of the three-part documentary HBO series Nuclear Family (2021). Gender Equality Behind Bars represents the first analysis of prison and immigration detention policies, broadly identified as penality policies, within the context of gender policy studies. Adopting an interdisciplinary approach, it provides a roadmap for better understanding penality policy from feminist and gendered perspectives. An introductory chapter examines the paradoxical relationship between gender equality and life behind bars for women.&nbsp;This is followed by ten in-depth case-studies on gender and penality policies in a unique line-up of countries in the Global North&nbsp;(Denmark, Poland, Portugal, Canada, the UK and Spain) and the Global South (Zimbabwe, Uruguay and Peru). The comparative conclusion identifies cross-national and cross-sectoral trends and proposes a research agenda for a gendered approach to penality policies. Issues including discrimination against women prisoners and women migrant detainees, gender-bias in prison environments&nbsp;and potential for gender transformation&nbsp;“behind bars” are covered throughout the book. Combining theoretical and empirical evidence, gender equality behind bars will appeal to scholars and students of public policy, gender studies, anthropology and criminology, as well as those interested in penal policies, criminal justice and punishment.

This book provides a one-stop, comprehensive guide to the Marrakesh Treaty and its relation to copyright protection and disability law.Beginning with an exploration of the origin and impact of the 'global book famine', the book contextualises the role of copyright law in restricting access to the written word. Detailing the core philosophical underpinnings of the debate, the book offers new interpretive insights into the classic justifications of copyright protection through the lens of inclusivity. Additionally, models of disability and their influence over national copyright policies are explored. The social and human rights models of disability, combined with an inclusive interpretation of copyright justifications, are advocated as essential to the Marrakesh Treaty's ability to stimulate meaningful and transformative change. Based on critical textual analysis and an original, panoramic view of the implementation of the Marrakesh Treaty, the book raises awareness of key successes and challenges in the Treaty's operation thus far. It highlights remaining gaps between the Treaty's framework and national implementing laws, and provides suggestions for the improvement of the Treaty's text, implementation, and practical impact.The book will be of interest to researchers in the field of copyright law, policy, and disability rights legal theory.

It examines the axiological foundations of participatory attitudes and their impact on civic engagement, while also presenting practical examples of their implementation and influence on local communities.
By presenting participatory models, the publication highlights various interdependencies shaping civic activity. While many forms of participation are similar or analogous, others are unique in nature. This open access book offers an in-depth understanding of the challenges, dilemmas and strategies of reinstating the rule of law after the dismantling of a constitutional order. Drawing on the case of Poland's democratic transition back to the rule of law, the volume explores the uncharted territory of restoring independent institutions within an EU Member State. After eight years of autocratic interference with the judiciary, media and state institutions, the Parliamentary elections of October 2023 mark a turning point for Poland. The new government now faces the complex challenge of restoring the rule of law, with European and international law playing a pivotal role. Still, at numerous crossroads a dilemma comes up: Can the rule of law be disregarded to restore it? Or must the rule of law be adhered to at the risk of legal and institutional paralysis? This book presents strategies for solving this dilemma in theory and practice, thereby paving the way for other states' transitions to come. Through a comparative and interdisciplinary approach, including historical and contextual analysis, the authors show that restoring the rule of law is more than just a legal challenge. This open access book is a crucial intervention in the debate concerning positive human rights obligations. There is nowadays no dispute in human rights doctrine over whether rights entail positive duties on the part of the state at the level of principle. But there has been surprisingly little academic commentary devoted to the question of whether there are, or should be, limits placed on how far those obligations extend. Similarly, there has been little scholarly attention paid to the question of how causation can be reasonably attributed in the context of violations of positive obligations. And there are very few sociological explanations provided as to why positive human rights obligations appear to be expanding without principled limits in the first place. This volume assembles the work of a range of leading scholars in international human rights law to fill these gaps in the literature. Each of its 11 substantive chapters addresses an aspect of positive obligations with a particular focus on issues concerning limits. Taken together, they provide the first serious attempt to grapple critically with the subject of the limits, causality and scope of positive obligations theoretically and doctrinally.
