Studien zum ausländischen und internationalen Privatrecht

Madeleine Petersen Weiner examines strategic lawsuits against public participation (SLAPPs) in a cross-border context. Such actions are not aimed at enforcing subjective rights; rather, they are intended to intimidate journalists, activists, or NGOs through the burdens of civil proceedings and to deter them from further critical reporting. This produces a chilling effect that impairs individual rights and weakens democratic accountability mechanisms. In what ways does private international law facilitate such abusive litigation and what counter-strategies should be considered? In particular, the mosaic approach developed by the CJEU enables claimants to sue in any state where a statement can be accessed. As a result, those affected can scarcely predict where they may be sued and which law will apply. The EU's recently adopted Anti-SLAPP Directive has so far addressed this problem only incompletely. The author develops a reform proposal to curb SLAPPs across the three pillars of private international law: international jurisdiction, applicable law, and the recognition and enforcement of judgments. She argues for a uniform regulatory regime oriented toward the injured party's center of main interests . In this way, she increases legal certainty and reduces the potential for strategic abuse.

This book re-examines the origins and development of the laws of war and human rights law and exposes an overlooked provision of the European Convention on Human Rights which permits the use of lethal force where absolutely necessary to quell an insurrection. When civilian casualties occur in internal armed conflicts, questions are asked about how civilians can be better protected against the use of force by armed insurgents and state security forces. The laws of war include protection against the targeting of civilians but permit the use of force based on 'military necessity' and allow 'proportionate' civilian casualties. Where those laws do not apply, the use of force is generally seen as being limited to self-defence. This creates paradigms of armed conflict and law-enforcement with very different rules. The paradigms are then treated by governments and other actors as being separate and divided by a threshold of violence, when, in practice, they overlap, both in the conduct of military operations and, this book argues, as a matter of law. Revisiting the law provides the opportunity to reassess the benefits and risks of the existing paradigms and consider how applying the provision permitting the use of lethal force in quelling an insurrection would affect them. The book concludes that it offers a middle way based on the existing law, but it requires wider recognition and development in order to achieve a more appropriate balance between human rights and collective security.

He is the author and co-author of 230 different scientific studies, including ‘Determinants and possibilities of counteracting the use of improvised explosive devices’; and has participated in 12 development projects, including project dedicated to ‘Improving the Safety and Protection of Soldiers on Missions Through Research and Development in Military Medical and Technical Areas’.
Marek Wrzosek is professor at War Studies University, Warsaw, Poland. His military, research and teaching career develops in the scope of military reconnaissance systems, information systems and particularly military and non-military threats assessment. He published numerous theoretical and practical works, participated in the international research projects. His most important works include

Danuta Kämierczak is associate professor at University of The National Education Commission, Krakow, Poland. Her scope of research includes security studies including human security, education management, disaster risk management. Challenging the prevailing orthodoxy, it reinterprets the leadership clause in the definition of the crime of aggression and offers a new responsibility framework that reflects how decisions about war are actually made. Under this approach, liability is not confined to heads of state and top military leaders but extends to civilian power brokers, private actors, and third-state officials who are present at key moments of deliberation and, as reason-giving and reason-demanding participants, exercise decisive influence over whether a state goes to war or continues one. The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.
