This book is concerned with the practical, ethical and political realities of critical research around state punishment. Based on a series of interviews conducted with researchers within and outside of academia, it aims to capture the personal challenges, ethical dilemmas, practical obstacles, positive rewards and (potential or actual) harmful effects of undertaking critical research concerned with state punishment. It essential reading for undergraduate and postgraduate students of criminology, media, sociology, journalism, film studies, and cultural studies.

This book is concerned with the practical, ethical and political realities of critical research around state punishment. By definition, critical research is a dynamic and political process which recognizes the broad structural contexts within which human action takes place. Critical researchers argue for a more dynamic and reflexive approach to research, and have duties to expose oppressive structures and practices, make audible voices that are habitually silenced, and empower and emancipate marginalized groups and individuals. Based on a series of interviews conducted with researchers within and outside of academia, this book aims to capture the personal challenges, ethical dilemmas, practical obstacles, positive rewards and (potential or actual) harmful effects of undertaking critical research concerned with state punishment. How should criminal law be used to address corporate misconduct effectively? Through a doctrinal and theoretical analysis, A Theory of Corporate Crime puts forward a defence of the 'failure to prevent' model of corporate liability and its liberal-welfarist framework, as a key part of the answer to that question. Delving into its conceptual and moral foundations, this book contrasts the failure-to-prevent model with the traditional identification doctrine and other rival theories, revealing its relative advantages for addressing wrongdoing associated with medium and large-sized companies. It critically evaluates recent legislative developments, including the Economic Crime and Corporate Transparency Act 2023, and traces the shift in emphasis from classical liberal principles towards a liberal-welfarist framework. Subsequent chapters analyze key defenses to corporate crime and the attribution of wrongdoing to corporate entities. A Theory of Corporate Crime argues that addressing serious corporate wrongdoing requires more than punitive sanctions. Instead of relying solely on punishment, legal systems should prioritize rehabilitating the corporation and promoting its reintegration as a socially responsible corporate citizen.

The Law of Financial Crime

Following the events of 9\11 individual countries and the international community became increasingly concerned about how best to prevent the funding of terrorist groups. Alternative remittance systems such as Hawala, where money is moved informally between a network of brokers in the Middle East, north Africa and south Asia have been identified as a potential source of terrorist financing leading to calls for greater regulation of such alternative remittance systems.This book analyses the risk such alternative remittance systems pose in terms of terrorist financing, offering a detailed overview of the historical origins and methods of operation of alternative remittance systems or informal value transfer systems. The factors that have come to ensure that these systems have remained operationally viable in modern times are identified along with the risks they present balanced against an overview of their actual misuse for illicit purposes to date. The book presents a detailed critique of the UK framework for the regulation of these systems drawing where possible on existing data to assess the use and effectiveness of these measures in practice. A range of options for mitigating risks associated with specific remittance corridors is considered ranging from initiatives that promote remittances through the banking sector, to efforts to mitigate risk and the impact on the delivery of UK overseas development aid. The book concludes with key recommendations as to the effectiveness of the current regulatory framework within the UK viewed from the perspective of international efforts to secure the regulation of these systems, and in stemming terrorist finance as part of national and international counter-terrorism policy.
