This formative period of EU law witnessed an intense struggle over the emergence of a constitutional practice. While the supranational institutions, including the European Commission, the European Court of Justice and the European Parliament, as well as EU law academics helped to develop and promote the constitutional practice, member state governments and judiciaries were generally reluctant to embrace it. The struggle resulted in an uneasy stalemate in which the constitutional practice was allowed to influence the doctrines, shape and functioning of the European legal order that now underpins the EU, but a majority of member state governments&nbsp;rejected European constitutionalism as the legitimating principle of the new EU formed on basis of the Treaty of Maastricht (1992).&nbsp;The struggle and eventual stalemate over the&nbsp;constitutional practice traced in this&nbsp;book accounts for the fragile and&nbsp;partial system of rule of law that exists in the EU today.

This book investigates the availability in Asian jurisdictions of civil remedies against multinational businesses for human rights abuses. Various means have been developed in Europe and elsewhere to hold businesses accountable to victims for human rights abuses. Techniques include legislating due diligence requirements for companies operating abroad, broadening court jurisdiction to include foreign companies having subsidiaries within a country, expanding international jurisdiction, promoting universal jurisdiction, and implementing international conventions and sanctions. On the 15th anniversary of the 2011 UN Guiding Principles on Business and Human Rights, the book assesses whether the norms of the UN Guiding Principles have taken root in Asia, which has only had a mixed record for upholding human rights. The book first considers the international state of play in the field. It moves on to case studies of corporate governance and human rights in Asia (especially Japan, South Korea, India, Thailand, and the Philippines). It then examines emerging issues (environmental damage and climate change, crimes against humanity, and compliance programs and corporate criminal Responsibility), and considers how Asia has dealt and can deal with corporate responsibility in connection with those matters. By way of conclusion, the book offers an action plan for implementing the UN Guiding Principles in Asia.

Mass Violence and Its Aftermath

The often-forgotten global story of how the Confederacy lost its bid for sovereign nationhood In 1861, proslavery secessionists severed ties with the United States, launched the Confederacy, and readied their new government to join the international community as a sovereign nation. In The First Pariah State, Robert Bonner tells the story of how a transatlantic publicity campaign dashed Confederate hopes by ostracizing its rebellion as an immoral, global menace. The international anti-Confederate campaign built on existing antislavery themes but moved far beyond them. Improvised indictments circulated secessionists’ most incendiary words across the world. The Union and its foreign allies condemned the marauding Southern navy for disrupting high-seas commerce, violating civilized norms, and preparing for the resumption of the African slave trade. Abraham Lincoln and Senator Charles Sumner sought to convert rhetorical barbs and maritime anxieties into novel doctrines of international law designed to counter rogue regimes. And Union opinion-makers, including Black abolitionists, worked with European supporters to stymie the South’s naval expansion, war finances, and diplomatic efforts to gain formal recognition. International worries about the Confederate rebellion waned after U.S. victory, and the Southern pariahdom of the 1860s left few enduring traces in international law or overseas remembrances. In fact, over the next century and a half, the pro-Confederate “Lost Cause” mythology proved to be as powerful abroad as it was within the restored United States.
