This open access book provides a Mediterranean perspective on digital societies, focusing on core issues such as cultural heritage, tourism, smart city development, migration, humanitarian action management, maritime security, health data sharing, and the Mediterranean data space. The Mediterranean Sea is not just a geographical place; it is a crossroads of cultures, economies, and political trends which are now intertwined with data-driven technologies. Neither a national nor an EU versus non-EU perspective can fully grasp the variety and complexity of the resulting space and legal issues. This book takes a multidisciplinary approach to Mediterranean digital societies by analysing the legal, societal, and technical dimensions of the Mediterranean digital environment, with contributions by scholars and experts in this area. In turn, this new multidisciplinary view of the mechanics of storytelling sparks new ways of approaching the writing, reading and teaching of fiction in and beyond the writing workshop. Fiction in the Field

This book focuses on contemporary problems related to fraud and risk in commercial law. It has been said by some that we are in a 'golden age of fraud'. In part this has been caused by globalisation, technological changes and the financialisation of business. This has resulted in the creation of automated linkages with integrated supply chains and the creation of systemic risks, which have been exacerbated by new forms of intangible assets like tokens and their ease of movement. While regulation has ebbed and flowed given the desire of governments to generate economic growth, as well as the distrust of their coercive powers, the courts have sought to strike a balance between considerations such as commercial certainty and fairness. The book provides an analysis of key contemporary issues on the theme of fraud and risk in commercial law, including: technology and fraud, secondary liability and 'failure to prevent' economic crime, abuse of business entities, insolvency and creditor protection, injunctions and other orders, cross-border issues, the relationship between regulation and private law, and solutions for policy makers.

This multilayered work follows a group of Guantanamo detainees from a single Middle Eastern country, Kuwait, portraying their lives before their capture, to their experience at Guantanamo, to their ultimate release and the lives they have been challenged in remaking after returning home. It is an intimate look at real men held for years without charge and without hope. Eric L. Lewis has represented Guantanamo detainees for more than twenty years and he conducted the hearings that gained the release of the last two Kuwaiti 'forever prisoners.' As part of a committed team, he spent time with these men and their families, fighting to gain access to courts and navigating the politics and diplomacy of the Global War on Terror. As well as telling the story of his time with the Guantanamo detainees, Lewis also analyzes how Guantanamo has changed American law and culture, and how its legacy continues today.

This formative period of EU law witnessed an intense struggle over the emergence of a constitutional practice. While the supranational institutions, including the European Commission, the European Court of Justice and the European Parliament, as well as EU law academics helped to develop and promote the constitutional practice, member state governments and judiciaries were generally reluctant to embrace it. The struggle resulted in an uneasy stalemate in which the constitutional practice was allowed to influence the doctrines, shape and functioning of the European legal order that now underpins the EU, but a majority of member state governments&nbsp;rejected European constitutionalism as the legitimating principle of the new EU formed on basis of the Treaty of Maastricht (1992).&nbsp;The struggle and eventual stalemate over the&nbsp;constitutional practice traced in this&nbsp;book accounts for the fragile and&nbsp;partial system of rule of law that exists in the EU today.

The History of European Union Law

The end of the Cold War gave way to a fundamental shift in the structure of the international system. It was an era characterized above all by liberal triumphalism in which Western politicians and policymakers turned to international organizations (IOs) to spread and reinforce liberal values. These IOs, backed by the West, proliferated at exceedingly high rates, with democracies in particular becoming fully integrated members. Scholars agreed with policymakers, finding overwhelming evidence that these IOs were positive forces for democracy, and for several decades liberal democracy appeared ascendant. However, beginning around 2010, liberal democracy's forward march abruptly halted, and ongoing evidence of democratic backsliding ---an historically unprecedented phenomenon in which democratically elected officials erode liberal democratic institutions--- calls into question the post-Cold War narrative of liberal democratic triumphalism. What explains democracy's sudden reversal of fortune and the emergence of this new form of democratic regression on the heels of unmatched international integration and support for liberal democracy? Eroding Democracy from the Outside In proposes a novel international-level theory of democratic backsliding. In the decades after the Soviet Union fell, IOs became not only much more common, but a certain subset of these organizations also gained unprecedented power and influence over domestic affairs and substantive, highly salient economic and political policy outcomes. One unintended consequence of this increased delegation of economic and political policy authority to powerful IOs has been that over time core domestic representative institutions, such as political parties and legislatures, have been eroded, while power has been increasingly concentrated in the hands of executives who represent their states at the international level. These weak institutions, unable to either represent citizens' wide-ranging interests or act as a check on growing executive power, have paved the way for would-be autocrats to consolidate their hold on the state. The result all too often has been democratic backsliding.
