This book focuses on contemporary problems related to fraud and risk in commercial law. It has been said by some that we are in a 'golden age of fraud'. In part this has been caused by globalisation, technological changes and the financialisation of business. This has resulted in the creation of automated linkages with integrated supply chains and the creation of systemic risks, which have been exacerbated by new forms of intangible assets like tokens and their ease of movement. While regulation has ebbed and flowed given the desire of governments to generate economic growth, as well as the distrust of their coercive powers, the courts have sought to strike a balance between considerations such as commercial certainty and fairness. The book provides an analysis of key contemporary issues on the theme of fraud and risk in commercial law, including: technology and fraud, secondary liability and 'failure to prevent' economic crime, abuse of business entities, insolvency and creditor protection, injunctions and other orders, cross-border issues, the relationship between regulation and private law, and solutions for policy makers.

From the rise of China as a technological superpower, to wars on its eastern borders, to the belief that the US is no longer a reliable ally, the European Commission sees the world as more unstable than at any other time in recent history. As such, the Commission has become the Geopolitical Commission, working to serve the interests of the Geopolitical Union. Central to many of these conflicts is technology - who produces it, where it is produced, and who controls it. These questions are central to the Commission's pursuit of digital/technological sovereignty, Europe's attempt to regain control of technology regulation. Jonathan M. Metzl has long been the forefront of a movement advocating for American gun reform as a matter of public health but in 2018 a racially charged mass shooting in Nashville led him on a path towards recognising the limitations of biomedical frameworks for fully diagnosing or treating the complexities of American gun politics. In What We've Become, Metzl looks at the cycle in which mass shootings lead to shock, horror, calls for action, and, ultimately, political gridlock, he explores what happens when violence is normalised as an acceptable trade-off for freedom. The often-forgotten global story of how the Confederacy lost its bid for sovereign nationhood In 1861, proslavery secessionists severed ties with the United States, launched the Confederacy, and readied their new government to join the international community as a sovereign nation. In The First Pariah State, Robert Bonner tells the story of how a transatlantic publicity campaign dashed Confederate hopes by ostracizing its rebellion as an immoral, global menace. The international anti-Confederate campaign built on existing antislavery themes but moved far beyond them. Improvised indictments circulated secessionists’ most incendiary words across the world. The Union and its foreign allies condemned the marauding Southern navy for disrupting high-seas commerce, violating civilized norms, and preparing for the resumption of the African slave trade. Abraham Lincoln and Senator Charles Sumner sought to convert rhetorical barbs and maritime anxieties into novel doctrines of international law designed to counter rogue regimes. And Union opinion-makers, including Black abolitionists, worked with European supporters to stymie the South’s naval expansion, war finances, and diplomatic efforts to gain formal recognition. International worries about the Confederate rebellion waned after U.S. victory, and the Southern pariahdom of the 1860s left few enduring traces in international law or overseas remembrances. In fact, over the next century and a half, the pro-Confederate “Lost Cause” mythology proved to be as powerful abroad as it was within the restored United States.

This book radically reforms the classical paradigm of international law. It proposes a novel theoretical framework of the 'separation of powers in a globalised democratic society', where both actors and norms are pluralised beyond a unitary and monolithic 'state' and international law as norms of, by, and for 'states'. The book applies this framework to holistically examine the interactions between human rights treaty organs - the European Court of Human Rights, the Inter-American Court of Human Rights, and the UN Human Rights Committee - and state organs, including parliaments, courts, administrative organs, and national human rights institutions. The book provides an innovative, original contribution to both the theory and practice of international human rights law.

This multilayered work follows a group of Guantanamo detainees from a single Middle Eastern country, Kuwait, portraying their lives before their capture, to their experience at Guantanamo, to their ultimate release and the lives they have been challenged in remaking after returning home. It is an intimate look at real men held for years without charge and without hope. Eric L. Lewis has represented Guantanamo detainees for more than twenty years and he conducted the hearings that gained the release of the last two Kuwaiti 'forever prisoners.' As part of a committed team, he spent time with these men and their families, fighting to gain access to courts and navigating the politics and diplomacy of the Global War on Terror. As well as telling the story of his time with the Guantanamo detainees, Lewis also analyzes how Guantanamo has changed American law and culture, and how its legacy continues today.
