Danach folgt eine Zusammenfassung über Sinn und Zweck des Urheberrechts.Für die gesellschaftliche und kulturelle Entwicklung eines Landes ist es von großer Bedeutung, seine Künstler zu schützen und ihnen „freies“ künstlerisches Schaffen zu ermöglichen. Nicht nur der Gedanke, dass Künstler durch ihr Wirken zum kulturellen Leben und zur Weiterentwicklung der Gesellschaft einen wichtigen Beitrag leisten, sondern auch der finanzielle Aspekt der Regelungen des Urheberrechts wird beleuchtet. Studienarbeit aus dem Jahr 2021 im Fachbereich Jura - Medienrecht, Multimediarecht, Urheberrecht, Note: 14,00, Westfälische Wilhelms-Universität Münster, Sprache: Deutsch, Abstract: Im Internet wird das Entscheidungsverhalten der Verbraucher vor allem durch die Bewertungen anderer Kunden und durch die Platzierung von Angeboten in den Suchergebnissen beeinflusst. Aufgrund der resultierenden Bedeutung von Rankings und Verbraucherbewertungen als Marketing-Instrument kommt es jedoch vermehrt zu Manipulationen. Um den Verbraucher in seiner Entscheidungsfähigkeit zu schützen, wurde das UWG um neue Informationspflichten und Verbote erweitert. Ob diese Vorschriften den Verbraucherschutz tatsächlich verbessern, wird in dieser Arbeit kritisch untersucht. Dafür werden zunächst Anlass und Systematik der Gesetzesänderung erläutert und die neuen Transparenzgebote inhaltlich dargestellt. Durch einen Vergleich mit der aktuellen Rechtslage wird untersucht, inwiefern die neuen Vorschriften das Potenzial haben, etwaige bestehende Transparenzdefizite zu beseitigen. Es folgt eine kritische Auseinandersetzung mit der Geeignetheit der neuen Informationspflichten zur Verbesserung des Verbraucherschutzes sowie mit ihren Auswirkungen auf die Unternehmer. Zuletzt wird dargelegt, wie eine verbraucherfreundliche Darstellung von Pflichtangaben im Internet gelingen kann, um die Wirksamkeit von Transparenzgeboten zu gewährleisten.

Studienarbeit aus dem Jahr 2019 im Fachbereich Jura - Medienrecht, Multimediarecht, Urheberrecht, , Sprache: Deutsch, Abstract: Neue Produkte integrieren zunehmend eine Vielzahl unterschiedlicher Technologien, wodurch oft auf Innovationen anderer Unternehmen zurückgegriffen werden muss. Infolgedessen sehen sich Produkthersteller häufig gezwungen, eine Vielzahl von Patentlizenzen verschiedener Lizenzgeber zu erwerben, was mit hohen Gebühren verbunden ist. Insbesondere für Lizenzsuchende, die eine Technologie nach Maßgabe eines technischen Standards anbieten möchten und hierfür ein standardessentielles Patent (SEP) benötigen, stellt dieses Patentdickicht eine Marktzutrittsschranke dar. Marktzutrittsbarrieren können etwa auch daraus folgen, dass ein Patentinhaber die Relevanz seines Patents in Standardisierungsverfahren aus strategischen Erwägungen spät offenlegt. Lizenzsucher werden insgesamt in vielfältiger Weise in der Nutzung bestimmter technischer Lösungen behindert. Da die Anzahl an Patenten, die einzelne Produkte schützen, in den vergangenen Jahren deutlich gestiegen ist, liegt in diesen Phänomenen inzwischen eine grundlegende Beeinträchtigung der Innovationskraft der deutschen und europäischen Volkswirtschaft. Zur Lösung dieser Problematik werden Patentpools vorgeschlagen. Die Europäische Kommission ermutigt Standardsetzungsorganisationen und SEP-Inhaber dazu, wirksame und transparente Möglichkeiten der SEP-Lizenzierung über Lizenzierungsplattformen zu finden und führt Patentpools als eine dieser Möglichkeiten an. Die vorliegende Arbeit untersucht das Potenzial von Patentpools in Bezug auf die oben beschriebenen wirtschaftlichen Problemstellungen sowie die kartellrechtlichen Grenzen, die es bei der Ausgestaltung und Umsetzung eines Patentpools zu beachten gilt.
