This book challenges the near-universal acceptance of a US-style, Western constitutional paradigm as the best basis for comparative constitutional studies. It does so on three main grounds: anachronism, 'othering' and cultural specificity. Main pillars of 'convergent constitutional theory' are rooted in the revolutionary, late-eighteenth century - a lost world; constitutional arrangements that deviate from the paradigm are often branded as 'outliers' or even as not constitutional at all; and the foundations of the paradigm in liberal democracy give no space for other forms of constitutionalism. Whatever the attractions of convergent theory as a normative ideal of good government, for the purposes of understanding, analysing and explaining constitutional systems it is far from ideal. This book discusses and questions: convergent theory's weddedness to writing as the technology of constitution-making; its image of a constitution as fundamental law; its idea that a constitution expresses the 'sovereignty of the people'; its use of tripartite separation of powers as the basic principle of institutional design; its relative neglect of administrative law; its association of 'rights' with judicially enforceable bills of rights; and its obsession with a vaguely specified concept of 'democracy'. It makes suggestions for alternative, preferable methods of understanding, analysing and explaining constitutions, and governmental and constitutional systems.

Is it a "market sector," a "general equilibrium," or the "gross domestic product"? Economics today has become so preoccupied with methods that economists risk losing sight of the economy itself. Meanwhile, other disciplines, although often intent on criticizing the methods of economics, have failed to articulate an alternative vision of the economy. Before the ascent of postwar neoclassical economics, fierce debates raged, as many different visions of the economy circulated and competed with one another. In The Real Economy, Jonathan Levy returns to the spirit of this earlier era, which, in all its contentiousness, gave birth to the discipline of economics. Drawing inspiration particularly from Thorstein Veblen and John Maynard Keynes, Levy proposes a theory of the economy that is open to rich empirical and historical scrutiny, covering topics that include the emergence of capitalism, the notion of radical uncertainty, the meaning of demand, the primal desire for money, the history of corporations, and contemporary globalization. This book brings to light a neglected program of cosmopolitan normativity in international law - innate cosmopolitanism. Whilst liberal cosmopolitanism is organized around the abstract individual, and constitutional cosmopolitanism is organized around the achievement of a formal arrangement, innate cosmopolitanism, is organized around a naturally-occurring collective whole: comprising all of humanity at any point in time, and understood as a historical phenomenon capable of exhibiting a will, interests or ends of its own. As such, innate cosmopolitanism is, he argues, is the leitmotif of international law. The book thus brings to light an ill-appreciated stream of cosmopolitan normativity in international law, and subject it to critique.

Beginning from an intentionally broad use of the term cosmopolitan, derived from etymological roots in the cosmo-polis, Geoff Gordon draws out the main streams of thought associated with cosmopolitanism over time in discourses of international law and politics. The two best-recognized are liberal cosmopolitanism and constitutional cosmopolitanism. And, In addition to these, he introduces a third: innate cosmopolitanism. Clarifying, consolidating – and critiquing – cosmopolitan thought, the book thus brings to light an ill-appreciated stream of cosmopolitan normativity in international law, and subject it to critique. It will be of huge interest to specialists and students of international law and politics, and especially those concerned with ideas and theories of global order or international society.

Practices of tracking and tracing have a long history, yet they are expanding in scale and scope in the digital age with important consequences for the accounts which shape our organizational and everyday lives. At a time when the benefits of traceability for assuring quality, maintaining security, and supporting knowledge-creation must be balanced with needs for privacy and accountability, Economy of Traces delivers an analysis of the implications of traceability for the many accounts we live by. Issues about why we trace, what we trace, and how we trace have become critical, and the book draws upon thinking in accounting, philosophy, and sociology to understand the different facets of traceability, including connectivity, organization, governance, risk, personhood, and knowledge generation. Through these themes, the book locates a key tension at the heart of our digital economy of traces; namely, that the more we are technically able to produce and track traces of human behaviour, the more fragile the traditional organizational forms of human oversight and accountability become. Economy of Traces develops a traceological theory of accounting to understand this tension and how tracking and oversight, while intertwined, are changing their mix in the digital age. In particular, audit trails which have traditionally underpinned human capacities for observation and governance, are being displaced and de-centered. Economy of Traces avoids both wholesale humanist critique of digital technologies on the one hand and uncritical celebration of their augmenting power on the other, in order to understand and theorize the dynamics of change in the organization of traceability and accounts production.
