The Protection of Privacy in English Private Law

Offers a new First Amendment framework that permits deterring political deceit, while minimizing the chill of honest discourse, by targeting fraudulent intent, not false content More than ever, influencers and politicians communicate political messages that they do not believe to be true. This political deceit is constitutionally valueless, harms public discourse, and impedes effective public decision-making. Yet, under current doctrine, the Supreme Court would invalidate any regulation of deceitful political advocacy as an abridgement of political speech. In Deterring Political Deceit, David Chang explores why traditional efforts to target falsity in political speech have been rooted in constitutional error. While the Court has determined that the defamation of public officials is unprotected, it wrongly declared that false statements of fact lack constitutional value, and overlooked the contradiction between deceitful communicative intent and free speech values. Both errors together have prevented reformers from identifying the political fraudsters who should be deterred by law, and recognizing the politically sincere who should be protected and respected, even when wrong. Chang makes a bold and compelling legal argument for why deceitful political speech should be excluded from First Amendment protection. He proposes a dexterous solution: A false political statement is constitutionally valuable, and deserves protection–if the speaker believes their message to be true. A political message that the speaker did not believe to be true, regardless of its content, is constitutionally valueless, societally harmful, and does not deserve protection from regulatory deterrence. Drawing upon fresh, valuable insights, Deterring Political Deceit identifies wrongdoing that challenges the survival of this constitutional democracy, and charts a path for the People's self-defense through law.

This book is a comparative study of state-based censorship laws and practices in the Asia Pacific region.It provides crucial historical context for each of the common law traditions in Malaysia, Australia and Hong Kong - all former British colonies - and compares it to the tradition of civil law and the lèse majesté law in Thailand. This book analyzes questions of platform bias, algorithmic filtering and ranking of Internet speech, and declining perceptions of online freedom.Courts have intervened against unfair platforms in important cases, but they have deferred to private sector decisions in many others, particularly in the United States. The First Amendment, human rights law, competition law, Section 230 of the Communications Decency Act, and an array of state and foreign laws address bad faith conduct by Internet platforms or other commercial actors. Arguing that the problem of platform neutrality is similar to the net neutrality problem, the book discusses the assault on freedom of speech that emerges from public-private partnerships. The book draws parallels between U.S. constitutional and statutory doctrines relating to shared spaces and the teachings of international human rights bodies relating to the responsibilities of private actors. This book analyzes the legal tensions that exist in the economy that purports to "reanimate" the dead using postmortem digital technologies. Technological reanimation has proven to be big business, with many notable commercial entities investing in this "afterlife economy". Postmortem technologies convincingly replicate the appearance, physiognomy, conversation styles, and thought patterns of a deceased individual by generating digital copies that act in their stead. In the entertainment industry, new works can be created with dead celebrities through a postmortem copy that is managed by their representatives. The result is an economy in which the dead are offered as a product or service to consumers, with some having their artistic legacies extended past death through an "afterlife career". Many stakeholders stand to benefit from such a lucrative afterlife economy, but the law is simply not prepared for the issues that will arise with this exploitation of the dead. Reanimation requires the exploitation of one's reputation, persona, artistic works, and personal data. However, the corresponding legal protections are either nonexistent, inapplicable, or inconsistent across borders - depending on which posthumous interest is analyzed. In response, and by studying the contours of the existing legal protections in the afterlife economy, this book proposes a system rooted in the "shared ownership" of one's postmortem copy and the responsible "stewardship" of legacies through fiduciary duties.Law and the Digital Reanimation of the Dead will be of considerable interest to scholars working in the areas of entertainment law, intellectual property, and law and technology, as well as others with professional interests in the area.

It compares the industry landscape to that of the US where the right of publicity has been recognised since 1953 and has gone as far as to protect 'identity'. The book argues that nonlegal factors significantly impact the commercialisation of persona across the jurisdictions and interact with the law to encourage permission-based behaviours. However, there remains a divergence in the dispute resolution sphere.
