Nicole Moreham: The Protection of
Privacy in English Private Law

The Protection of Privacy in English Private Law

Curaçao Gambling License

Curaçao is no longer the old shortcut many operators still imagine. For years, Curaçao was viewed by many online gambling entrepreneurs as a fast, flexible, and relatively accessible route into the iGaming market. But the licensing environment has changed. Under the new Curaçao Gaming Authority and LOK framework, applicants face a more formal, transparent, and compliance-driven regime.Curaçao Gambling License: The New Reality is a serious guide for entrepreneurs, operators, investors, consultants, and professionals who need to understand what the new Curaçao licensing environment actually requires before relying on outdated advice or entering the process unprepared. This book explains why many applicants misunderstand the transition from the old sublicense culture to a more direct and accountable regulatory model. It shows how licensing now depends not only on documents, but on ownership transparency, corporate substance, source of funds, operational control, AML readiness, player protection, payment flows, supplier arrangements, reporting obligations, and long-term compliance discipline.Inside this book, you will learn: Why Curaçao should no longer be treated as a simple offshore shortcutWhat a Curaçao online gaming license actually covers - and what it does notWhy legal entity structure, UBO disclosure, key persons, and local management matterHow the two-phase CGA application process changes applicant preparationWhy applications may be refused because of weak ownership, unclear funds, liquidity concerns, poor compliance, or incomplete readinessHow provisional licensing differs from definitive licensingWhy AML, KYC, responsible gambling, player accounts, reporting, complaints, ADR, and data access are not formalitiesHow payment processing, supplier agreements, certified games, domains, public disclosures, and operational controls affect the licensing fileWhy outdated Curaçao advice can lead to weak applications, wasted fees, banking problems, and commercial delayHow serious applicants should build a licensing strategy that can survive regulatory, banking, payment provider, and investor scrutinyThis book does not promise approval, shortcuts, or guaranteed outcomes. It is not written as a promotional brochure for Curaçao. It is written as a practical and strategic explanation of the new licensing reality.Curaçao may still be a valuable jurisdiction for serious online gambling operators. But it is no longer a jurisdiction where applicants can rely on vague structures, passive directors, incomplete supplier control, copied compliance policies, or old sublicense-era assumptions. The central message is simple: Curaçao can still work - but only if the business is structured, documented, governed, and operated like a regulated gambling business before the application is submitted. This book is for serious applicants who want to avoid outdated advice, weak applications, and costly licensing mistakes.

The New Reality: Avoid Outdated Advice, Weak Applications, and Costly Mistakes

Modern Studies in European Law

This book provides an in-depth analysis of the scope and the limits of the EU regulation of the audiovisual media market, including broadcasting or other audiovisual services, but also image, sound and data storage media, and commercial communication.

Media Law and Market Regulation in the European Union

From Catwalk to Courtroom

Routledge Research in Human Rights Law

This book provides a comprehensive examination of digital regulation's most pressing challenge: building effective legal frameworks to counter unlawful speech across digital platforms. Moving beyond traditional focus on service provider responsibility, it adopts a holistic approach examining perspectives of providers, content creators, and end-users. It analyses content moderation limits, regulatory risks, and the legitimacy of delegating illegal content blocking to private entities. The chapters explore European liability standards evolution for illegal digital speech, explaining EU digital service provider liability foundations and associated controversies. It examines user liability arising from social network functionalities like "likes" and "shares" rather than direct content publication. While primarily focused on EU law, it provides detailed insights into selected Member State regulations and comparisons with leading economic partners including the US and UK, enabling readers to compare different regulatory models. This book is intended for professionals across digital service regulation including experts, legislators, law enforcement agencies, and the academic community. It will be particularly valuable for lawyers, engineers, sociologists, and researchers specialising in media law and human rights law seeking to understand contemporary challenges in digital content regulation and cross-jurisdictional approaches to managing harmful online content.

Clearly Unlawful Content in EU Digital Law

Beyond Hate Speech

Schriften zum Recht der Digitalisierung

Communication platforms such as Facebook, Instagram, TikTok, X, and YouTube have become central arenas of public opinion formation. Their operators moderate millions of items of user-generated content every day on the basis of privately drafted terms of service, removing not only unlawful but also lawful content protected by fundamental rights. Jonas Hiller examines under which conditions and to what extent such moderation is permissible.

The legal framework is provided by the Digital Services Act (DSA), in force since 2024, whose moderation-related due diligence obligations are first systematically analyzed. Building on this, the author develops standards for reviewing both the exercise and the substantive content of privately autonomous moderation decisions, as well as their effects under private law. He also examines the scope for national regulation that remains under the fully harmonizing DSA.

The study demonstrates that the DSA leads to a constitutionalization of the platform user agreement without entirely eliminating private autonomy. In their moderation practices, platform operators become bound by fundamental rights and rule-of-law principles. While they retain broad discretion in designing their terms of service, the application and enforcement of those terms in individual cases are subject to stricter scrutiny. Key criteria for this graduated intensity of review are market power, user dependency, and a platform's function as a public forum.

The study also critically assesses the DSA's fully harmonizing effect, arguing that the regulation of the digital public sphere touches upon the cultural sovereignty and democratic identity of the Member States. Rather than preserving national regulatory discretion, the fully harmonizing nature of EU law results in a Europeanization of freedom of expression in the digital sphere.

Unboring Newsies History for Kids

Non-disclosure agreements (NDAs) typically feature in business transactions to protect signatories' confidentiality, sensitive information and intellectual property. In recent years, however, the growth of NDA-related settlements in employment disputes involving discrimination and sexual misconduct has raised serious concerns about their purpose and potentially harmful effects. To understand the extent of the problem and how to tackle it, this book focuses on three main areas: first, it considers the scope and ethical implications of NDA misuse; second, it examines key public policy initiatives and grassroots campaigns to stop NDAs being exploited; and third, it suggests pragmatic solutions and ways forward to eradicate unethical practices. The book outlines the complex issues and debates surrounding the use of NDAs along with countless examples and evidence from across the UK labour market. The gagging of victims by employers exacerbates the plight of vulnerable groups such as women, ethnic minorities and people with disabilities, while failing to address perpetrators' behavior and organizational malpractice. Against this backdrop, various public policy strategies are highlighted including, legislation, parliamentary inquiries, legal regulatory interventions and advocacy work, as well as wider international perspectives on NDA misuse. The book ultimately shines a light on the secret world of NDAs and the corporate power dynamics at its core. In doing so, it raises searching questions about the role that detrimental NDAs and those who enable them play in perpetuating discrimination and sexual transgressions in the workplace.

Reforming Britain’s Workplace to Stop the Silencing of Victims

Everyday Misuse of Non-Disclosure Agreements

This collection offers the first sustained, multidisciplinary legal analysis of deepfakes and their far¿reaching consequences.Deepfake technology has moved with disorienting speed from fringe curiosity to a global social, political, and legal problem. Once the preserve of Hollywood studios, the ability to fabricate hyper¿realistic images, audio, and video is now available to anyone with a smartphone. Its most prevalent and devastating use remains the creation of non¿consensual sexually explicit content targeting women. Yet deepfakes also fuel political disinformation, destabilise democratic processes, enable fraud and identity theft, and contribute to a broader post¿truth climate in which the authenticity of all digital evidence becomes contestable. In this landscape, one of the most urgent tasks is simply to begin the right conversations about how law and society should respond. Across three sections, various international scholars examine how synthetic media challenges foundational assumptions about privacy, image rights, evidential truth, and democratic integrity. These essays explore deepfakes' profound impact on the individual dignity of both the living and the dead, their capacity to generate epistemic uncertainty, and the structural difficulties they pose for courts, regulators, and lawmakers. Bringing together theoretical, doctrinal, and comparative insights, the book illuminates a fragmented regulatory landscape and articulates both the pressing need for more coherent, principled governance of synthetic media, and some of the difficulties that will necessarily be encountered by those designing regulatory measures. This is a timely and vital volume for scholars, jurists, and legislators concerned with the future of truth, autonomy, and accountability in an increasingly synthetic world.

Music law involves several key substantive areas of law copyrights, trademarks, and identity rights, to name a few. While traditional entities such as songwriters and record companies have always existed, technological advances in digital distribution have brought important new players into the mix. Concerns about the usage rights of digital music have emerged as well as agreements arising from the use of music in advertising and branding. Inexpensive duplication technology, the portability and ubiquity of mobile music devices, and the ease of transmitting digital files have also become areas of concern. Music Law for the General Practitioner, Second Edition provides lawyers with comprehensive information on the business and legal topics that are likely to be encountered when representing a musical talent, producer, or consumer.
