This book presents a positive account of state aid law at the EU, UK, and global levels, and provides the keys to understanding how it is adjusting to emerging realities. Industrial policy, decarbonisation, de-risking of supply chains: the regulation of subsidies is at the forefront of the transformations that the world economy is undergoing. The book provides an overview of the foundations of EU State aid law, one of the most dynamic areas of EU law. An up-to-date and accessible framework explains the core conditions underpinning the notion of State aid - including advantage and selectivity. The book also covers how the EU model has changed over the past decade. It helps navigate the complex case law on the application of EU State aid law to tax rulings concluded with large multinationals (such as the Apple saga) as well as the perma-crisis of the regime since the COVID pandemic. The ways in which the EU model extends its reach beyond its borders - convergence and unilateral expansion - are also addressed. The UK Subsidy Control Act 2022 and the EU Foreign Subsidies Regulation are discussed and put in context. Conceived as a 'modular' book, it can be used both as a tool to navigate the fundamentals of the discipline and as a map to reflect upon its uncertain future.

The New Law of State Aid and Subsidies

The U.S. Constitution is silent about a right to privacy, yet the Supreme Court determined in the 1965 reproductive rights case Griswold v. Connecticut, that such a right is inferred from the Bill of Rights. The reasoning in the landmark case hinged on an unexpected word--penumbra. The Court concluded, in other words, that the unmentioned right to privacy resides in the shadows of the amendments. But this was not the first time penumbral imagery was used in legal writings, and its broader cultural usage dates back much further. Jared Schroeder's The Penumbra Problem provides a much-need--and quite colorful--social and cultural history of the term. The penumbra concept, it turns out, wasn't an accidental choice but instead a well-selected term with centuries of transnational history. Schroeder tells its story through two intertwining narratives: first, how the word penumbra transcended its oblique scientific origins to become a distinct cultural concept; and, second, the parallel story of its evolving use in legal thought. The book tracks back and forth in time, creating an unexpected lineage of people and works who became unwitting champions of the penumbra concept, including mathematician Johannes Kepler, feminist activist Estelle Griswold, British thinker Robert Hooke, and lexicographer Noah Webster. Pairing these stories with the writings of great legal thinkers such as Willam Douglas and Oliver Wendell Holmes, Schroeder is able to construct a kind of etymological love letter to this obscure concept. Not everyone has supported the privacy precedent, though, and it is no exaggeration to say that it is danger today. Schroeder's clever, utterly unique history is, at its core, a call to redouble efforts to save the right to privacy. He argues that we must understand its ponderous, indeed uncertain, origins to fully appreciate the precarity in which it exists today, and only then can we adequately fight for it.

"Der Missbrauch von Kindesmissbrauch" ist eine gesellschaftliche Analyse darüber, wie ein der schlimmsten Verbrechen unserer Zeit im öffentlichen Raum erneut "missbraucht" wird - nicht durch Täter im engeren Sinn, sondern durch Aufmerksamkeitslogiken, mediale Dynamiken, politische Instrumentalisierung und kommerzielle Verwertung. Das Buch ist kein persönlicher Erlebnisbericht, sondern zeigt, warum der Umgang mit dem Thema selbst für Betroffene gefährlich werden kann, wenn Leid zur Bühne, zur Währung oder zur Debattenwaffe wird. 

Ausgehend von einer Betrachtung von Macht (als Fähigkeit, andere zu beeinflussen) beschreibt der Autor, wie sich Macht in Strukturen wie Medien, Institutionen und Plattformen verschiebt - und wie Missbrauch neben körperlicher und psychischer Gewalt auch eine Kontrolle über Deutung und Wahrheit erzeugt. 

Dem stellt das Buch die Perspektive der Machtlosigkeit gegenüber: die Ohnmacht des Kindes während der Tat - und die fortgesetzte Ohnmacht im Erwachsenenleben, verstärkt durch Unglauben, Bagatellisierung oder sensationsgetriebene Reaktionen. Besonders zentral ist die Idee einer "zweiten Machtlosigkeit", wenn Betroffene erzählen wollen und ihre Realität angezweifelt, vereinnahmt oder zum öffentlichen Material gemacht wird. 

Im dritten und vierten Kapitel wird erklärt, warum soziale Medien Tabuthemen belohnen: Algorithmen fördern Intensität statt Wahrhaftigkeit, Empörung wird zur Reichweite, Geschichten werden zur "Währung". Daraus entsteht die Vermarktung von Leid - bis hin zu Produkten, Kampagnen und Selbstdarstellungen, die vom Thema profitieren, während Opferschutz in den Hintergrund rückt. 

Am Ende steht ein Appell: Schutz statt Show, Respekt statt Reichweite, plus ein Ethik-Leitfaden mit konkreten Regeln (u. a. zuhören statt urteilen, keine fremden Geschichten verbreiten, Sensationsdarstellungen meiden, Trigger beachten, Fokus auf Betroffene). Ergänzend werden Hilfsangebote genannt.
