Bildungsforschung

Fake News und Hate Speech sind Phänomene, mit denen wir fast tagtäglich konfrontiert sind, sei es im beruflichen, ehrenamtlichen oder privaten Kontext. Die Beiträge bieten Einblicke in das ostbelgische Speak Up! Lab, in dem sich Wissenschaftler*innen, Praktiker*innen und Menschen aus der Zivilgesellschaft mit den Ursachen, Erscheinungsformen und Folgen von Fake News und Hate Speech auseinandergesetzt haben. Die Beiträge wurden von Menschen mit den unterschiedlichsten beruflichen, (mutter-)sprachlichen und kulturellen Hintergründen verfasst. Offen und authentisch legen sie die Herausforderungen und Erfahrungen aus dem ostbelgischen Speak Up! Lab dar und liefern neue Denkanstöße. Neben Berichten und Reflexionsbeiträgen zu den bisherigen Tagungen versammelt dieser Band auch die Ergebnisse der tagungsübergreifenden Arbeitsgruppen sowie Kurzinterviews mit Teilnehmenden der Speak Up! Tagungen, die ihre Arbeit vorstellen.

This book is a scholarly compilation that explores the diverse and evolving landscape of public maritime law across Asia. Public Maritime Law in Asia

This open access book examines the role played by international, regional, and national legal frameworks in holding corporations operating in the natural resource sector accountable for human rights violations in the Global South.

Influential scholars from across the world address pressing issues concerning the integration of business and human rights standards for better governance of natural resources. They focus particularly on extractive and multinational companies in the Global South and their role in the transition to net zero societies. The book also examines legal mechanisms for corporate accountability under international, human rights and transnational law, using case studies from selected countries across Africa, Asia, and Latin America.

The book reviews proposals for an enforceable legal framework to hold corporations accountable for human rights abuses and environmental damage. It considers initiatives such as the OECD Guidelines on Multinational Enterprises, the UN Guiding Principles on Business and Human Rights, the UN's Draft Business and Human Rights Treaty, and the European Union Corporate Sustainability Due Diligence Directive.

This open access book presents a thorough, multidisciplinary examination of children’s rights in Central and Eastern Europe (CEE) with a focus on Lithuania. Pursuing a comparative approach, it explores various aspects of children’s rights as established in constitutional, civil, administrative and criminal law in the region, while also discussing emerging issues. The book shares unique insights into the challenges and progress specific to individual CEE countries, many of which have undergone significant political, social, and legal transformations in recent decades. The comparative analysis of practices and legal frameworks between Lithuania and other countries in the region and across various CEE countries is a key feature of the book. By comparing practices, case law and legal regulations across different CEE countries, it highlights both the diversity and the common challenges in the region. Moreover, such a comparative perspective is invaluable for policymakers, practitioners, and academics in terms of identifying best practices and learning from different countries’ experiences. The respective chapters offer evidence-based insights and recommendations to guide the development of more effective and rights-based approaches to child protection. While aiming to enhance awareness and understanding of children’s rights, the book also seeks to fill a gap in the literature by focusing on the CEE region, an area often underrepresented and overlooked in global discussions on children’s rights. This Handbook addresses the role of the criminal-legal system in projecting and enforcing racial injustice across the globe. It consists of high-profile contributions that expose structural relations, global colonial and imperial histories, class oppression, and ongoing hegemonic domination that generate racial injustices and are embedded in criminalization and law enforcement. The Handbook considers racist ideologies and their origins, racist institutions, procedures, and practices, and their impacts, and resistance/collective responses to racism. Prison building has moved from the margins to the mainstream of our penal politics. In recent years the UK Government has invested billions in new prison building and the main political parties are currently locked into a penal arms race over who can, and who will, build the most additional prison places in England and Wales. Prison building is now widely lauded as the definitive policy solution to the current prisons crisis and yet, this remains an elusive sphere of penal policymaking. Academic research remains in its infancy, and we still know very little about how these large investment decisions are made, by whom and for what reasons.
In seeking to shine a light on this subterranean and largely closed sphere of contemporary penal policymaking, this book presents the first systematic study of prison building programmes in England and Wales since the mid-1990’s punitive turn. Drawing upon extensive archival research, 28 exploratory qualitative interviews, publicly recorded data, historic satellite imagery and other mapping techniques this book has three main aims: (1) to provide an authoritative historical account of prison building activity in England and Wales since the mid-1990s punitive turn, (2) to explain why successive governments have chosen to invest in new prison building programmes and (3) to reflect upon how the prisons we build - functionally, architecturally, geographically – continue to shape our politics long after they have been constructed.

This book traces, assesses and compares the history of conscientious objection – in the cultural context of eight developed democratic nations – from refusal of military service and a range of similar moral dilemmas, to objecting to abortion, to vaccination hesitancy and contemporary warfare. It considers the impact of this form of dissent in relation to social movements, social activists and whistle blowers. It reflects on the relationships between the sacred and the secular, the state and the citizen, in order to better understand the responsibilities of citizenship in our increasingly secular societies. It analyses what defines the conscientiousness of an objection from both legal and ethical standpoints. It explores the increased reliance on “grounds of religion, belief or conscience” as providing justification for excusing some citizens from complying with certain responsibilities – mandated by equality and non-discrimination legislation – that are binding for all others. By conducting a comparative evaluation of national law and judicial rulings on a fixed agenda of issues, this book identifies key jurisdictional differences concerning conscientious objection. In so doing, it highlights the importance of cultural context and constructs a jurisdiction-specific overview of legislation, policies and case law. By tracking policy developments and highlighting crucial judicial rulings – particularly in the US – it provides insights into the probable future direction of developments in national law relating to conscientious objection. Lastly, the book draws attention to some of the potential consequences of manifesting dissent by opting out of performing public services: the possible local breakdown of specific service availability (e.g. abortion); prompting population movements as established democratic civil rights are locally negated; fragmenting society into a geographic patchwork of regions in which some citizens are branded as conservative/reactionary and others as progressive. Conscientious objections carry profound implications for a coherent democratic society.
