Das Prozessrecht des Einheitlichen Patentgerichts (EPG) bildet das erste autonom-supranationale Verfahrensrechtsregime auf dem Gebiet des Privatrechts, das grundsätzlich ohne Verweis auf nationales Prozessrecht auskommt. Verfahrensprinzipien ermöglichen es, dieses weitgehend noch unbekannte Terrain grundlegend zu kartieren. Sie bilden die Leitgedanken und das argumentative Material, dessen sich Wissenschaft und Praxis bei der Auslegung, Abwägung und Entscheidungsfindung regelmäßig bedienen. Mittels eines Rechtsvergleichs werden in der Abhandlung diejenigen Prinzipien des Verfahrens vor dem Einheitlichen Patentgericht herausgearbeitet, die für ein systematisches Verständnis des neuen Prozessrechts entscheidend sind. Die Herleitung stützt sich methodisch auf einen breit angelegten Vergleich der für die patentrechtliche Praxis bedeutsamen Prozessrechtsordnungen Deutschlands, Englands und Frankreichs, sowie mehrerer weiterer zentraler Elemente des europäischen Prozess- und Immaterialgüterrechts, wie etwa das Verfahren vor den Beschwerdekammern des Europäischen Patentamts, das Verfahren vor dem EUIPO und die harmonisierten Teile der Verletzungsverfahren betreffend Unionsmarken und Gemeinschaftsgeschmacksmuster. Bestimmt werden ferner die für das Rechtsregime des EPG maßgeblichen Auslegungsmethoden und seine Rechtsnatur.
Auf Basis der gewonnenen Erkenntnisse wird der Inhalt der untersuchten Verfahrensprinzipien eingehend beschrieben. Aufgearbeitet werden in diesem Zuge sowohl grundsätzliche Fragestellungen, wie etwa die Gewährleistung von Verfahrensgerechtigkeit trotz des dem EPG in breitem Umfang eingeräumten Ermessens, als auch praktisch bedeutsame Aspekte wie die Bestimmung des Klagegegenstands, die Antragsbindung, die Partei- und Klageänderung, das weithin mögliche forum und language shopping, die vorzeitige amts- oder parteiwegige Beendigung des Rechtsstreits sowie der Schutz von Geschäftsgeheimnissen. Zahlreiche Zusammenfassungen erleichtern dabei die Lektüre auch für den eiligen Leser.

        &lt;p&gt;Nach welchen Kriterien sollen Behandlungsplätze zugeteilt werden, wenn die vorhandenen Ressourcen nicht ausreichen, um alle Patienten zu behandeln, die einer Behandlung bedürfen? Diese in der Covid-19-Pandemie viel diskutierte Fragestellung ist Thema dieser Arbeit. Nach Untersuchung der möglichen Strafbarkeitsrisiken für Ärzte in einer solchen Triage-Situation in der Pandemie und Feststellung eines gesetzgeberischen Handlungsbedarfs, befasst sich die Autorin mit der Frage, nach welchen Kriterien die Zuteilung erfolgen soll und unterbreitet ihrerseits einen Vorschlag für eine gesetzliche Regelung der Triage-Situation. Zudem befasst sie sich mit dem neu eingeführten § 5c IfSG.&lt;/p&gt;

The Economic Value Added (EVA) framework developed by the Stern Stewart &amp; Company is gradually replacing the traditional measures of financial performance due to its robustness and its immunity from "creative accounting".Fortune magazine has called it "today's hottest financial idea and getting hotter" and management guru Peter Drucker referred to it as a measure of total factor productivity. The traditional measures for performance measurement, suffer from some serious limitations which are the main reason that these traditional methods based on earnings can’t be used as a reliable measure of performance measurement. Hence, there is the need of new approaches for the performance measurement which takes stakeholder’s perspective into consideration and shareholders wealth into consideration. EVA is a better performance measurement tool and it has been proved in the research done on 10 companies in India. EVA has been compared with traditional techniques like ROI, ROE, EPS, NVA and MVA and the results are presented. Suggestive measures have also been given at the end and reference tables are also given. The research will e beneficial for academicians and people associated with finance.
