Mit der Nanotechnologie erwartet uns die nächste technologische Revolution. So viel scheint für viele bereits festzustehen, wenn man der allgegenwärtigen Berichterstattung Glauben schenken darf. Tatsächlich verspricht die Nanotechnologie, Einfluss auf alle Lebensbereiche auszuüben, befasst sie sich doch im Kern mit der Kontrolle von Materie auf der namensstiftenden Nanoskala - die Skala der Atome und Moleküle, aus denen unsere ganze Welt besteht. Nichtsdestotrotz bleiben fundamentale Umwälzungen bislang aus. Aber weshalb?


 Hartnäckig hält sich als Antwort auf diese Frage, das Patentsystem sei schuld. Nicht zuletzt aufgrund all der Versprechungen sei ein »Goldrausch« entbrannt, möglichst früh möglichst viel der Nanotechnologie unter die eigene Kontrolle zu bringen, sodass diese nun in einem undurchdringlichen Patentdickicht gefangen sei.


 Gestützt auf Erkenntnisse einer ökonomischen Analyse sowie eines Rechtsvergleichs mit den USA erörtert die vorliegende Untersuchung in einem ersten Schritt, inwieweit diese Antwort überhaupt zutrifft. In einem zweiten Schritt untersucht sie sodann, welche Hebel das Patentrecht bereithält, um dem Problem im Ernstfall beizukommen.

Das Lizenzkartellrecht, also die kartellrechtliche Inhaltskontrolle von Lizenzverträgen ist seit jeher Gegenstand lebhafter Diskussionen in Rechtsprechung und Lehre. Dies ergibt sich nicht nur dadurch, dass hier das Spannungsverhältnis von Immaterialgüterrecht und Kartellrecht besonders plastisch zum Tragen kommt, sondern auch, dass dieses Rechtsgebiet auch von besonderer Relevant für die Vertragspraxis ist. Anlass dieser Dissertation war die völlige Neufassung der bisherigen EG-Gruppenfreistellungsverordnung für Technologietransfer-Vereinbarungen VO 240/96, welche mit Wirkung zum 1. Mail 2004 durch die neue VO Nr. 772/04 abgelöst wurde. Der Verfasser untersucht insofern die Entwicklungen des Lizenzkartellrechts, als er die neue Verordnung einerseits mit der bisherigen Regelung und anderseits mit der Rechtslage in den USA vergleicht. Ein besonderes Augenmerk gilt hier dem Vergleich von in der Praxis häufig verwendeten, problematischen Vertragsklauseln.

Die Verbrauchergeneralklausel des UWG

Die Umweltfreundlichkeit von Unternehmen ist bei Verbrauchern stark in den Fokus gerückt. Daher wird sehr viel mit diesem Teil der Corporate Social Responsibility, der unternehmerischen Umweltverantwortung, geworben. Unternehmen kommen dabei teilweise in einen Konflikt mit dem Gesetz gegen den unlauteren Wettbewerb (UWG). Ob darüber hinaus auch bereits umweltschädliches Verhalten an sich als unlauter anzusehen ist, ist weitgehend ungeklärt.
Die Arbeit untersucht diese beiden Berührungspunkte zwischen der Verantwortung von Unternehmen für den Schutz der Umwelt und dem Lauterkeitsrecht und arbeitet die genauen Auswirkungen des UWG in diesem Bereich heraus. Sie betrachtet die aktuellen Formen der Umweltwerbung sowie des dabei vorkommenden Greenwashings mancher Unternehmen und analysiert, welche Grenze das Lauterkeitsrecht dem setzt. Im Fokus stehen dabei die Fragen, ob und inwieweit es durch die Werbung mit der eigenen Umweltverantwortung zu Irreführungen kommt und welche weitergehenden Informationspflichten dadurch gegenüber dem Verbraucher entstehen.
Die Autorin setzt sich außerdem mit der Frage auseinander, ob das UWG darüber hinaus auch dafür verwendet werden kann, die Einhaltung bestimmter Umweltstandards durchzusetzen. Dies läuft auf die Frage hinaus, ob umweltschädliches Verhalten von Unternehmen unlauter im Sinne des UWG ist. Zwar gehört der Umweltschutz nicht zu den Schutzzwecken des UWG. Dadurch, dass sich die Ausbeutung der Umwelt jedoch auch auf die Funktionsfähigkeit des Wettbewerbs auswirkt, kommt die Autorin zu dem Ergebnis, dass auf der Grundlage der lauterkeitsrechtlichen Generalklausel umweltschädliches Verhalten grundsätzlich den Tatbestand der Unlauterkeit erfüllt. Dies kann allerdings nur gelten, soweit hinreichend klar erkennbar ist, welche Anforderungen bestehen, es also beispielsweise einen Branchenstandard an ökologischen Selbstverpflichtungen gibt, an dem sich die Unternehmen hinsichtlich der an sie gestellten Erwartungen orientieren können.
