This book traces the legal creation of National Parks in England and Wales, considering how statute and case law shaped the different provisions within the National Park and Access to the Countryside Act 1949. National parks are often associated with hiking, holidaying, and nature but they are rarely perceived as legal spaces. Yet national parks in England and Wales only exist through the legal processes contained within the National Parks and Access to the Countryside Act 1949, a piece of legislation which is internationally unique in how it defines what a national park is. In celebrating the 75th Anniversary of the National Parks and Access to the Countryside Act 1949, the book examines the legally unique nature of national parks in England and Wales, exploring why these spaces were created in a legally distinct way. In doing so, the book takes the reader on a journey through the ever-evolving landscapes of planning law, administrative law, and property law in the 19th and 20th centuries, providing a new perspective on the enactment of national parks legislation. In presenting the National Parks and Access to the Countryside Act 1949 as part of a wider system of legal change, the book encourages the reader to think differently about national parks, emphasising the inherently legal nature of these spaces. Part of the iconic Landmark Cases series, this book brings the most significant cases in charity law together for the first time. More than four hundred years have passed since the Statute of Charitable Uses of 1601, whose Preamble set out a list of charitable purposes which has formed the basis of the modern legal definition of charity. This book explores the substantial body of judge-made rules and principles developed since then, highlighting a carefully curated selection of the landmark cases which have shaped charity law. Each chapter analyses one or more judicial decisions, setting them in their historical context, explaining their contemporary importance, and considering their future relevance. The selected cases cover a broad range of topics. Some go to the heart of what it means to be a charity, elucidating charity's legal definition and public benefit requirement. The Law That Never Was

Informal Decision Making in the European Community Under the Luxembourg Compromise

This book examines the influence and strategic efforts of the Comintern, the agency created in 1919 by Lenin to promote world revolution, during the Spanish civil war. The author explores how Soviet actors took control of the War Commissariat and the Republican Government’s foreign radio broadcast service, in order to craft and diffuse an interpretation of the conflict that would serve Soviet foreign policy interests. This effective infiltration and control, contrary to a significant scholarly consensus, was not an accidental by product, but the result of careful planning and execution. Challenging dominant interpretations of the Spanish Civil War, the author reveals how the Comintern's internal assessment of the nature of the war was in fact, in stark contrast with the evolving public narrative it promoted from July 1936. Rather than a genuine effort to combat fascism and ‘defend the democratic republic,’ the strategy of the Soviet government in the Spanish Civil War was specifically designed to drive a wedge between capitalist and 'imperialist' powers, thereby hindering the formation of a much-feared 'all-imperialist, all-capitalist' military alliance against the USSR. With chapters delving into key topics such as the manipulation of public narratives, the strategic deployment of propaganda, and the construction of memory, this book presents new insights for scholars of the Spanish Civil War, the Soviet Union, and collective memory studies.

This book, as a monograph devoted to the concept of right, takes as its vantage point the historical transformation of human society from agricultural civilization to commercial–industrial civilization. It traces the formation and evolution of the concept of right, analyzes the strengths and weaknesses of the right‑related thought of three major Western jurisprudential traditions and their representative figures, repudiates the intellectual constraints that existing Western notions of right have imposed upon the Chinese legal academy, and develops a theoretical system of right supported by such core concepts as the constitution of right, the ontological foundation of right, the bearer of right, the function of right, and the semantic transformation of right.

To what extent can an animal constitute a 'juridical species'? This highly original book considers how animals have been integral to law and to legal thinking.Going beyond the traditional approaches to animal rights and the question of whether non-human animals may be considered legal 'subjects,' this book follows two types of animal - bears and bees - and asks what existence these species have maintained in juridical thought. This book gives extraordinary new insights into the legal, political and industrial strife in the UK of the early 1970s, focusing on the National Industrial Relations Court and how its independence came to be injured at a time of national crisis. When the Heath Government came to power in 1970, it set up the National Industrial Relations Court to referee highly contentious disputes between unions and employers. When Donaldson jailed five dockers in 1972 - the Pentonville Five - for defying the Court's orders, strikes erupted and the docks closed.
