The crisis of liberal democracy is clearly visible today, manifesting itself, inter alia, in the declining interest of citizens in participating in elections; the disappearance, or at least weakening, of the traditional axis of social conflict between labour and capital; the growing importance of populism; attacks on democratic institutions; and the efforts of leaders in many countries to centralize power. Across the globe, anti-establishment, anti-system, anti-elite and populist sentiments are on the rise, accompanied by the increasing prominence of anti-democratic parties. This volume aims to identify universal mechanisms of de-democratization using the example of Poland, by searching for reliable indicators of these processes. The authors examine and analyse the weakening of democratic institutions, the limitation of civil liberties, and the growth of authoritarian tendencies and political polarization, seeking out indicators of de-democratization phenomena in the legal-institutional, political-social and economic spheres, while also looking into actions that strengthen and protect de-democratization, which take place in the symbolic, social, political and economic domains.The authors thus seek to expand the existing analyses of de-democratization processes in a volume which will be of great use to those researching and studying democracy, the rule of law, contemporary politics and de-democratization in Poland and beyond.

Frederic Kupsch bietet eine systematische Analyse der rechtlichen Maßstäbe des EGMR und EuGH für die Regulierung von Online-Plattformen in Bezug auf rechtswidrige Inhalte. Er zeigt Gemeinsamkeiten und Unterschiede der Rechtsprechung auf, untersucht Entwicklungslinien und lotet Synergieeffekte aus. Davon ausgehend legt er den Schwerpunkt auf die Frage, ob soziale Netzwerke selbst einer Bindung an die Meinungsfreiheit unterworfen werden können. Methodisch verbindet er eine fallgruppenorientierte und rechtsvergleichende Auswertung der Rechtsprechung mit Bezügen zum IPbpR sowie einer Analyse des Gesetzes über Digitale Dienste. The problem is not a new one, first recognised by Sir Frederick Pollock, but it has persisted over the intervening years. So though the question is a longstanding one, the answer provided by the book is truly innovative. It adopts a 'law in context' methodology to offer solutions. The new methodological approach is combined with insights from global regulatory theory and cutting edge solutions such as private collectivised proceedings and remedies, streamlined adjudication, and administrative enforcement systems. It takes a global approach, looking at models in the US, Canada, the UK, and the EU. As the use of boilerplates is set only to increase as privatisation and globalisation spread, the answers provided by this book are much needed.

Was wird aus Österreich?

This volume (Parts A and B) contains 16 new studies that shed light on key aspects of immigration: the drivers of immigration, the factors fostering or hindering immigrant integration in the host country, and the impact of immigration in the host countries. The studies span a wide range of countries in Europe, North and South America and use novel administrative, regional and survey data to offer insights into historical and contemporary episodes of migration. Together, they enrich our understanding of the determinants and consequences of migration and provide an evidence base for policy discussions.
The volume covers three broad themes. In both Part A and B are eight papers on the integration of immigrants in the host society, focusing on the acquisition of human capital, labor supply, family formation, and returns to skills. Part B also studies the impact of immigration on outcomes that often dominate the public debate, namely employment, education, and crime. Published twice per year in conjunction with the Institute for the Study of Labor (IZA) Research in Labor Economics contains new cutting edge peer reviewed research applying economic theory and econometrics to policy related topics pertinent to worker well-being often with an international focus.
