'Arbitral Institutions and the Parties to the Arbitration. An Analysis of their Relationship in the Context of Contractual and Statutory Frameworks': This study examines the relationship between arbitral institutions and the parties to arbitration under German law and from a comparative perspective. It analyzes whether and under what conditions arbitral institutions may be liable for misconduct. The applicable law and jurisdiction are assessed under the Rome I Regulation, the Brussels Ia Regulation, and U.S. law. The author rejects extending judicial or arbitral immunity by analogy and instead advocates a limited statutory liability regime.
