'Judicial Competition and Language of Proceedings. Parameters of Decision-Making, Models of Implementation and Issues of Translation': This publication examines which parameters are decisive in the choice between litigation and arbitration - particularly, what role the language of proceedings plays in this context. In this regard, the German Commercial Chambers and Courts are compared with the Netherlands Commercial Court. Additionally, the publication examines whether and how the civil law of Louisiana can be used to preserve the legal substance of German law when rendered in English.
