International Political Theory

This collection reviews Hegel in relation to the key themes of history, politics and philosophy. It shows how Hegel is a historical thinker, whose theories are
developed via a philosophical consideration of historical development at a number of levels. Hegel’s expertise in the history of philosophy leads him to
recognize the distinctiveness of the present, while building upon philosophical predecessors. This perspective sheds light on Hegel’s distinctive reading of the
political, which is both insightful and timely. Hegel’s reading of political economy emerges out of his conception of modernity and remains relevant to contemporary conceptions of civil society. Likewise Hegel’s focus upon the international remains of great moment in that he shows the interplay between internal and external forms of sovereignty. Hegel’s global perspective on international politics remains of relevance today and it bears upon his understanding of internal state sovereignty and history. This volume ends with a synoptic reading of Hegel today, which reviews him critically in the light of his problematic reading of race, sex and Eurocentrism. Using case studies from Belgrade, Serbia, this book explores how 'good' is formed, identifying the aspects that guide value judgment about what is considered good. These aspects are perceived as magnetic poles of the ethical compass, interpreted here as a tool for comprehensive ethical orientation among the forces of power, public interest, justice, dialogue, morphology, and politics. The book establishes a theoretical framework for evaluating existing practice in conjunction with the multi-layered nature of good defined through different normative theories and approaches. It proposes a method for moving from evaluation to action by formulating recommendations to improve urban development practice. The specific cases examine typical spatial development practices by the private sector and the public sector in order to provide a basis for the evaluation framework, acquiring evidence-based answers, and demonstrating how recommendations can be defined. Die Corona-Pandemie führte in Deutschland zu massiven, mittelbaren Eingriffen in das Recht auf informationelle Selbstbestimmung – insbesondere durch verpflichtende Kundenkontaktdatenverarbeitungsregelungen in privaten Einrichtungen durch Corona-Rechtsverordnungen. Diese Arbeit untersucht die verfassungsrechtliche Zulässigkeit dieser Maßnahmen und analysiert kritisch, ob die seinerzeit geltende Rechtsgrundlage (§ 32 S. 1 i.V.m. § 28 Abs. 1 IfSG) dem Vorbehalt des Gesetzes gerecht wird sowie ob sie hinreichend bestimmt war, um die schwerwiegenden Grundrechtseingriffe über mehrere Monate zu tragen. Die Dissertation zeigt ein graduelles Muster in der gerichtlichen und literarischen Bewertung auf und kommt zu dem Ergebnis, dass die verfassungskonforme Anwendung der Generalklausel bereits nach einem halben Jahr der Pandemie ihre Grenzen erreichte.

In this book, John Finnis provides a virtually unparalleled, in-depth assessment of Leon Peträycki’s work by a Western scholar. In the opening chapter, Finnis takes up the challenge of reading Peträycki not simply as a historical curiosity of Eastern European jurisprudence but as a thinker whose wide-ranging and ambitious ideas continue to spark debate today. He critiques not only Peträycki’s non-standard “economic analysis of law,” which differs markedly from the Chicago School model (not to mention from Guido Calabresi’s and Pietro Trimarchi’s versions), but also many other aspects of Peträycki’s various contributions to jurisprudence. These include, above all, his legal-realistic but nonetheless appreciative treatment of the natural-law tradition(s), which makes Peträycki both distinctive and difficult to classify in terms of standard schools of thought.

In the opening chapter, Finnis takes up the challenge of reading Petrażycki not simply as a historical curiosity of Eastern European jurisprudence but as a thinker whose wide-ranging and ambitious ideas continue to spark debate today. He critiques not only Petrażycki’s non-standard “economic analysis of law,” which differs markedly from the Chicago School model (not to mention from Guido Calabresi’s and Pietro Trimarchi’s versions), but also many other aspects of Petrażycki’s various contributions to jurisprudence. These include, above all, his legal-realistic but nonetheless appreciative treatment of the natural-law tradition(s), which makes Petrażycki both distinctive and difficult to classify in terms of standard schools of thought.Finnis’ essay is followed by nine further contributions. Written by scholars from different traditions and standpoints, they criticize, reassess, and elaborate upon Finnis’ arguments, creating a rich and multi-voiced dialogue. The volume concludes with Finnis’ own, extensive “concluding reflections,” in which he directly responds to his fellow contributors, clarifying his original questions and replying to the challenges raised in their chapters.This unique volume showcases Finnis’ insights, while enabling his interlocutors to highlight the depth and complexity of both Finnis’ and Petrażycki’s thought, as well as broader issues – more relevant now than ever – such as the differences between Catholic natural law, Orthodox natural law, and Petrażycki’s atheistic, humanistic, anti-speciesist ideal of substituting love for law and morality alike.
