Studien zur Europäischen Rechtsgeschichte

Mit der Entdeckung der Veroneser Handschrift der Institutionen des Gaius 1816 wurde das wohl wichtigste selbständig überlieferte Zeugnis des römischen Rechts der klassischen Zeit zu einem Forschungsgegenstand ersten Ranges. Friedrich Carl von Savigny, der den Fund vorbereitet hatte, unterzog den Text einer tiefgehenden Analyse und hielt exegetische Vorlesungen, in denen er das Werk des römischen Juristen insgesamt und dessen einzelne Lehrsätze interpretierte. So eröffnete die Verbindung von Forschung und Lehre noch vor dem Erscheinen des Textes im Druck den Blick auf dessen Wahrnehmung durch den prominentesten Juristen seiner Zeit. Der vorliegende Band enthält die Edition der drei erhaltenen Nachschriften von Savignys Gaius-Vorlesungen.

The U.S. Constitution is silent about a right to privacy, yet the Supreme Court determined in the 1965 reproductive rights case Griswold v. Connecticut, that such a right is inferred from the Bill of Rights. The reasoning in the landmark case hinged on an unexpected word – penumbra. The Court concluded, in other words, that the unmentioned right to privacy resides in the shadows of the amendments.But this was not the first time penumbral imagery was used in legal writings, and its broader cultural usage dates back much further. Jared Schroeder's The Penumbra Problem provides a much-needed – and quite colorful – social and cultural history of the term. The penumbra concept, it turns out, wasn't an accidental choice but instead a well-selected term with centuries of transnational history.Schroeder tells its story through two intertwining narratives: first, how the word penumbra transcended its oblique scientific origins to become a distinct cultural concept; and, second, the parallel story of its evolving use in legal thought. The book tracks back and forth in time, creating an unexpected lineage of people and works who became unwitting champions of the penumbra concept, including mathematician Johannes Kepler, feminist activist Estelle Griswold, British thinker Robert Hooke, and lexicographer Noah Webster. Pairing these stories with the writings of great legal thinkers such as Willam Douglas and Oliver Wendell Holmes, Schroeder is able to construct a kind of etymological love letter to this obscure concept.Not everyone has supported the privacy precedent, though, and it is no exaggeration to say that it is in danger today. Schroeder's clever, utterly unique history is, at its core, a call to redouble efforts to save the right to privacy. Eine Gesamtschau deutscher Polenpolitik seit 1918: Die Autorinnen und Autoren dieses Bandes blicken zurück in eine ausgesprochen dynamische Beziehungsgeschichte. Seit der Aufnahme diplomatischer Beziehungen zwischen Deutschland und Polen Ende 1918 hat sich die deutsche Politik Polen mal angenähert, sich mal von Polen abgewandt, unterbrochen vom Zivilisationsbruch des Zweiten Weltkriegs. The material assembled in this volume offers a deeper insight into Walter Eucken's attitudes, thought, and actions during the darkest years of Germany's history: the period of National Socialism. Although Eucken, like his associates, destroyed potentially incriminating documents after the failed assassination attempt by Count Stauffenberg on Adolf Hitler on July 20, 1944, the surviving texts mark key stages in a process that ultimately led this determined opponent of the Nazi regime - an opponent from the very beginning - into active resistance against Hitler. 
 

 What rendered Eucken immune to National Socialism from the outset was his philosophically grounded abhorrence of the dissolution of the free individual into the collective, as is inherent in all totalitarian, especially 
 völkisch
 (ethno-nationalist) ideologies. His systematic opposition to the Nazi regime began with refusal, open protest, and confrontation, particularly in response to the rapid 
 Gleichschaltung
 (forced coordination) of the universities, Martin Heidegger's rectorship, and the dismantling of academic freedom by the Nazis. Following Germany's invasion of Poland and several ultimately unsuccessful attempts to exert positive influence on the centers of power in Berlin, his resistance culminated in a - necessarily cautious - participation in conspiratorial activities as an advisor and confidant to the plotters. 
 

 The texts in this volume include notes and sketches of ideas, completed manuscripts that remained unpublished during his lifetime, published essays, a transcript of the lecture "Kampf der Wissenschaften," the record of a public discussion with a Nazi district leader, an expert report commissioned by the Reich Ministry of Economics on possible "sources of war financing" at the end of 1939, the academically significant essay "Wettbewerb als Grundprinzip der Wirtschaftsverfassung" prepared within the Academy for German Law, the chapter Eucken authored for the "Primer of Economics" initiated by Carl Goerdeler, as well as the appendix he co-authored to the memorandum "Wirtschafts- und Sozialordnung" of the Bonhoeffer Circle. This memorandum was prepared on behalf of the Confessing Church with a view to a future world church conference planned for the time after the war and the hoped-for overthrow of Hitler. Retrospective additions include, among other things, Eucken's "Notizen über die Haltung der rechts- und staatswissenschaftlichen Fakultät in Freiburg während der Herrschaft des Nationalsozialismus," his funeral oration for his prematurely deceased colleague Adolf Lampe, and drafts for an obituary of Hans Großmann-Doerth, with whom, together with Franz Böhm, Eucken had launched the research program of the Freiburg School: the development of a legal order conceived as an economic constitution, whose fundamental principle would be competition.
 

 These materials make it possible to trace how Eucken, precisely through his confrontation with the rapidly escalating regime of injustice - with the enforced 
 Gleichschaltung
 , the increasing move toward a planned economy, the persecution of the Jews culminating in genocide, the other atrocities of the dictatorship, and the devastating Second World War - was able to sharpen his conception of a "humane and functional order," diametrically opposed to such a cataclysm. Eucken's theoretical design of a competitive order would later provide direction in the postwar years for the establishment of a social market economy in the young Federal Republic of Germany.

II offers readers forty-four new accessible essays on the nature of constitutional democracy and constitutional crises, how the democratic recission is being experienced throughout the world, the factors that are providing challenges for constitutional democracy, and the tools being fashioned to maintain constitutional democracy, including the possibility of more global governance. This volume informs readers of the present state of constitutional democracy throughout the world and provides them with a framework for maintaining and improving constitutional governance.

The health of constitutional democracy has not improved substantially since the publication of Constitutional Democracy in Crisis? I. Widespread concern exists about the decline of constitutional democracy around the world, a phenomenon often referred to as 'democratic recession', 'democratic failure' or 'democratic backsliding.' The United States is hurtling toward competitive authoritarianism if not at that destination. The United Kingdom, France, Germany, and Italy confront powerful authoritarian movements. Eastern European countries struggle to maintain fragile democracies, while democratic efforts in the Global South confront the legacy of colonialism. Several "feel-good" cases remain: New Zealand and Australia continue as robust constitutional democracies; Poland and possibly Hungary are undergoing democratic "U-turns" after an authoritarian turn; constitutional reform failures have not dampened democratic momentum in Chile; and Brazil's strong democratic culture enabled resistance to and ultimately the conviction of Jair Bolsonaro.

Struggles to establish, sustain, and restore constitutional democracy have not only persisted but accelerated over the past eight years, increasingly blurring the line between "episodic turbulence" and "structural rupture." Global developments now demand not just updated examples, but a re-examination of core assumptions, about what constitutes a constitutional crisis, how rapidly constitutional-democratic systems can be reoriented, which institutions matter most under stress, and what effective repair looks like once democratic injury is normalized. Recent events underscore the need to "pause and reflect on the constitutional project," which appears to be in crisis and perhaps outdated, "incapable of leading us effectively into the planetary epoch."
