The European Social Charter: A Commentary

This book is the first comprehensive academic treatment of the International Covenant on Economic, Social and Cultural Rights (ICESCR) and employment rights, which has a global vocation demonstrated by having been ratified by 173 States since it was adopted in 1966. Workers' rights need protection and reinforcement. To achieve this aim, international human rights standards can play an important role. The ICESCR is the most important global UN instrument in this respect. It covers a wide range of employment rights, including the right to strike, and has global application. But it is not sufficiently developed and used, and national implementation often needs improvement. Part 1 of the book analyses general issues related to the Covenant, such as context, development, challenges, influences at the global and regional levels, interpretation and procedural elements. Part 2 deals with the specific provisions which are directly linked to the employment relation. The book is based on a thorough analysis, mainly, but not exclusively, of the case law of the Committee on Economic, Social and Cultural Rights (CESCR), that is monitoring the national implementation of the Covenant. Together, the chapters in this book will empower academics and practitioners in labour law to find answers to relevant and practical problems in order to better enforce and improve workers' rights. The book is the result of a project by the 'Transnational Trade Union Rights' experts Network (TTUR), linked to the European Trade Union Institute (ETUI).

The International Covenant on Economic, Social and Cultural Rights and the Employment Relation

Under the United Nations Convention on the Law of the Sea (UNCLOS), a State's maritime zones and the rights they confer are tied to its land territory. As climate change accelerates coastal erosion and inundation, traditional assumptions suggest these entitlements could shrink or disappear, with profound implications for access to marine resources. Sea-Level Rise and the Legal Stability of Maritime Zones explores the development of a new legal perspective that supports the preservation of maritime zones despite rising sea levels. This book advances a contemporary interpretation of UNCLOS, drawing on a broad spectrum of state practice as reflected in international declarations and domestic legislation. Through systematic analysis of this evidence within the framework of treaty interpretation, Frances Anggadi consolidates the doctrinal basis for the view that the preservation of maritime zones may be achieved through interpreting existing provisions of UNCLOS, rather than requiring a treaty amendment. As the first comprehensive work to conceptualize this emerging perspective, it offers a clear and principled framework for safeguarding maritime zones, demonstrating how international law can evolve to address global environmental challenges.

Bhupinder S. Chimni, International Law and Global Justice: The Imperative of Climate Justice The lecture explores the relationship between "international law and global justice". It first turns to the question of legitimacy of international laws which has in recent decades been actively debated in the disciplinary literature. The lecture inter alia contends that since the concepts of "legitimacy" and "justice" raise analogous issues, the debate anticipated the turn to the subject of global justice. The lecture then addresses the significant epistemic objections advanced against establishing a thick relationship between international law and the goal of global justice. The analytical and practical advantages of positing a positive linkage between international law and global justice are briefly noted thereafter. The lecture goes on to exemplify these understandings arguing that the pursuit of "climate justice" is critical to addressing the problem of global warming. It identifies in this regard the central elements of the concept of "climate justice" and touches on some aspects of the existing climate debate, including the principal cause of the climate crisis, the need for a radical response, and the proposed use of carbon border adjustment mechanisms by Global North nations. The lecture goes on to note that a just climate and global order calls for among other things structural reforms in the workings of global capitalism. It eventually turns to the question of agency and speaks of the possible social and political forces and actors that can promote the realization of justice in the global legal order.
