This book examines the persistence of blasphemy provisions, their increasing use in post-authoritarian Indonesia and the extent to which religion has been instrumentalised for political ends justified by law.Based on empirical research and an analysis of more than a hundred court decisions that connects evidence to theoretical discussions, this book traces the evolution and dynamics of capitalism in relation to the nature of legal order and the operation of laws, particularly those related to religion. Using an interdisciplinary approach, the author offers a rich analysis of the competing discourses on blasphemy in Indonesia. The work bridges the literatures of law and other social sciences. Providing an updated analysis of Indonesian blasphemy laws, this book also aims to shed light on the dynamics of legal order that affect how and why such laws exist. Rather than merely documenting regulations on and cases of blasphemy, the study aims to further understand the operation of law as a reflection of power relations. Specifically, the book reveals that the persistence of blasphemy laws has more to do with the illiberal nature of Indonesia's legal order, which renders laws that privilege religious orthodoxy a practical instrument for religious mobilisation for political purposes, than with the cultural distinctiveness of Indonesian society or the lack of modern bureaucratic and legal institutions supporting secularisation, as many scholars have argued.Offering original contribution to scholarship on blasphemy, the politicisation of religion and illiberalism in democracies, this book will be of interest to academics in the field of Asian politics, law and Southeast Asia studies.

This book develops an evolutionary economics approach to welfare state dynamics. Welfare states are complex settings, including social insurance, social assistance, and universal provisions. Their main aim is to shelter household incomes from instability and redistribute incomes. This book analyses welfare states in terms of how they pool business cycle uncertainty between the state (social security), firms, and households. The evolutionary and institutional analysis of welfare states, focusing, in particular, on labor market segmentation and national¿level policy design, is applied to two particular cases: a Southern European country (Portugal) and a deep¿rooted European welfare state (France). These two countries have introduced similar social protection reforms and experienced similar crises, yet the two welfare states are very different. This book explores how low-wage labour migration policies in seven Asian economies affect millions of migrant workers. It identifies two contrasting regulatory approaches that bookend a governance spectrum, offering an original theoretical framework for understanding which policies heighten workers' vulnerability to exploitation and which improve their chances of success.The book argues that the regulatory choice to either invest in and manage, or privatise and outsource, key labour migration governance functions has a material impact on outcomes for workers. Specifically, the data demonstrate that migrant workers in destination economies in Asia that take a government-managed approach pay lower recruitment costs, enjoy greater labour market mobility and earn higher wages as they benefit from greater labour law protections. Conversely, migrant workers in employer-managed regimes pay higher recruitment costs, have more limited labour market mobility, earn less and are more vulnerable to mistreatment at the hands of their employers. In addition to a thorough regional analysis, the book presents three case studies that examine the employer-managed approach followed by Singapore since the 1970s, the government-managed approach adopted by South Korea in 2004, and the government-managed approach pursued in Thailand including through legislative reforms implemented in 2017, and outcomes for low-wage migrant workers in all three countries. The final chapter argues that apex court judgments from these three countries reflect and reinforce their government's approach to low-wage labour migration governance.Identifying urgently needed reforms that would materially improve outcomes for millions of low-wage migrant workers in Asia and beyond, this book will be of interest to lawmakers, migrant worker advocates and researchers of Asian migration, labour migration, labour law and socio-legal studies.
