In the classical law of nations there was a doctrine of civil war. This book sets out to recover the forgotten legal tradition that shaped the modern world from 1575-1975. The result is an autonomous reassessment of four hundred years of the law of insurgencies and revolutions, both in state practice and in legal scholarship. Its journey through centuries of rebellion and the rule of law touches some of the most basic questions of international law across ages. What does it mean to stand among the nations of the world? Who should be welcomed among the subjects of international law, who should not, and who should decide? Its findings not only help make the classical doctrine understandable again, but also offer potential new insights for present-day lawyers about the origins, aspirations and vulnerabilities of the legal tradition with which they work today.

The Classical Doctrine of Civil War in International Law

This book examines intermediate appellate courts by using the Irish Court of Appeal as a case study. The operation and contribution of intermediate appellate courts are often overlooked in legal scholarship, which tends to focus on apex courts, most frequently national supreme courts. However, intermediate appellate courts perform a series of vital functions, including error prevention, the development of doctrine, and ensuring that apex courts are free to concentrate on issues of exceptional public importance. The significance of intermediate appellate courts has increased in recent decades in tandem with an increase in the volume and complexity of litigation in many countries. The Irish Court of Appeal was established in 2014 and this enables a number of dimensions of non-apex courts to be examined, including the rationales for, and challenges of, inserting such a court into an existing and well-established legal system. Institutional aspects of the court such as the appointment and promotion of its judges and its rules on dissent are analysed. The process of 'setting up court' is described. In addition, its contribution to some areas of substantive law over the first 10 years of its operation is evaluated. Interviews with judges who have served on the Court enrich the book's account of its operation and development. In addition, comparative perspectives from Northern Ireland and England and Wales enhance the analysis of an integral part of many legal systems.

This edited volume offers a practical and systematic tool for understanding the controversial dynamics of de-radicalization and extremism in the context of global terrorism. Since 2010 there has been a sharp increase in the number of extreme jihadist groups around the world. A surge in right-wing radicalization marked by hate speech and anti-immigrant anxieties has also been noted. States have subsequently sought to develop approaches to counter these groups, with variable success.While some countries have been relatively successful in countering radicalization, others have seen an increase in the number of terrorist attacks.Using comparative analysis, this book examines the controversial subject of de-radicalization as a tool of the state in modifying political behaviour. Drawing on Western and non-Western case studies, it assesses how governments around the world use counter-terrorism measures, be it through policing, the judicial process, state-sponsored programs or community approaches, to address extremist radicalization. It also considers how effective these policies have been in modifying extremist forms of behaviour, and why some countries have been more successful than others. A first-ever documentary history of antisemitism in the United States, spanning five centuries &nbsp; In a 1790 letter to Rhode Island Jewish leader Moses Seixas, President George Washington responded to Seixas’s concerns about Jewish persecution, assuring him that America “gives to bigotry no sanction, to persecution no assistance, [and] requires only that they who live under its protection should demean themselves as good citizens.” Historians have typically identified this letter as a symbol of American Jewish exceptionalism, the idea that Jewish life in the United States has been qualitatively distinct from, indeed better than, Jewish life in Europe. Undergirding this idea is the claim that antisemitism has been a relatively minor force in American Jewish life. In this volume, Britt P. Tevis upends this narrative to reveal various manifestations of Jewish inequality in American history, highlighting the ways that Jews have encountered limited civil and political rights. &nbsp; Using a remarkable array of primary sources, Tevis traces the history of antisemitism in the United States from 1654 to 2024. Comprising government reports, judicial decisions, correspondence, advertisements, cartoons, social media posts, and more, this documentary reader presents examples of antisemitism in nine overlapping categories: church and state, disenfranchisement, racialization, defamation, antisemitism and anti-Black racism, immigration and citizenship, exclusion and segregation, violence, and anti-Zionism.
