Perspectives on Criminal Compliance and Corporate Criminal Liability

This book brings together studies in forensics, law and criminology, which are all equally essential for a fair criminal justice system. It gives a comprehensive view to a wide variety of readers from the three communities across the globe to connect the dots which link all these three subjects, thus catalyzing interdisciplinary collaborations. The book explores the topics through four themes -- exploring forensic science in the 21st century; looking at law and criminal justice in the new millennium; contemporary trends in criminology; and, medico-legal aspects of human identification.

'Free Speech!' is a clarion call all over the world, yet what it means today is more contested than ever. Many cultures regard it as dangerous: in China, India, and across the Islamic world, unorthodox views about politics, sex, and religion are repressed and people are often punished for expressing them. Even in the west, where it is held up as a core value, there is widespread discord and disagreement about what freedom of expression means. Amidst perennial imbalances of power, continually evolving cultural taboos, dramatic new technologies and a fast-changing global media landscape, where free speech comes from - and how we might think about it - are critical questions. Through the lens of history, What Is Free Speech? shows us that freedom of speech is not an absolute from which societies and regimes have drifted or dissented at different times, but something more complicated and interesting. This book explains how to think more deeply about free speech as a global as well as a local question - by tracing how we got into our current predicaments, showing that history complicates our contemporary presumptions, and suggesting fresh possibilities for the future.

What Is Free Speech?

This formative period of EU law witnessed an intense struggle over the emergence of a constitutional practice. While the supranational institutions, including the European Commission, the European Court of Justice and the European Parliament, as well as EU law academics helped to develop and promote the constitutional practice, member state governments and judiciaries were generally reluctant to embrace it. The struggle resulted in an uneasy stalemate in which the constitutional practice was allowed to influence the doctrines, shape and functioning of the European legal order that now underpins the EU, but a majority of member state governments&nbsp;rejected European constitutionalism as the legitimating principle of the new EU formed on basis of the Treaty of Maastricht (1992).&nbsp;The struggle and eventual stalemate over the&nbsp;constitutional practice traced in this&nbsp;book accounts for the fragile and&nbsp;partial system of rule of law that exists in the EU today.

The History of European Union Law

This book examines intermediate appellate courts by using the Irish Court of Appeal as a case study. The operation and contribution of intermediate appellate courts are often overlooked in legal scholarship, which tends to focus on apex courts, most frequently national supreme courts. However, intermediate appellate courts perform a series of vital functions, including error prevention, the development of doctrine, and ensuring that apex courts are free to concentrate on issues of exceptional public importance. The significance of intermediate appellate courts has increased in recent decades in tandem with an increase in the volume and complexity of litigation in many countries. The Irish Court of Appeal was established in 2014 and this enables a number of dimensions of non-apex courts to be examined, including the rationales for, and challenges of, inserting such a court into an existing and well-established legal system. Institutional aspects of the court such as the appointment and promotion of its judges and its rules on dissent are analysed. The process of 'setting up court' is described. In addition, its contribution to some areas of substantive law over the first 10 years of its operation is evaluated. Interviews with judges who have served on the Court enrich the book's account of its operation and development. In addition, comparative perspectives from Northern Ireland and England and Wales enhance the analysis of an integral part of many legal systems.

Metzl has long been the forefront of a movement advocating for American gun reform as a matter of public health but in 2018 a racially charged mass shooting in Nashville led him on a path towards recognising the limitations of biomedical frameworks for fully diagnosing or treating the complexities of American gun politics.
