Each chapter analyses a single judicial decision and locates it in a wider legal, political and policy context, tracing its subsequent impact on refugee law and policy. Some of the decisions analysed in this collection were foundational in establishing the reach of refugee law, particularly in defining the scope of the refugee definition. Others engage with key areas of refugee rights in contexts which indicate a critical turning point in state refugee policy, such as interdiction of boats at sea, encampment and extraterritorial asylum processing mechanisms. This open access book focuses on private sponsorship of refugees, which has slowly begun to increase the opportunities for refugees to start new lives in Europe, without putting themselves or their families at risk from perilous journeys.

After contextualising the phenomenon and describing the most notable European programmes, the book argues that private sponsorship schemes characterised by naming and additionality should be further explored and trialled within Europe. 

Having considered the phenomenon from both theoretical and practical viewpoints, the book argues that this would be possible by balancing private sponsors' claims with state sovereignty, in matters such as welfare, integration and security.

This volume explores the legal history of migration and the role played by legal theories, case law, practices, customary laws, and legislations in shaping and governing mobility between the 19th century and the Second World War. Based on different methodological approaches and sources, including archival documents, special courts' decisions, diplomatic materials, legal journals and books, and international treaties, the chapters focus on countries of departure and destination both in Western and Eastern regions. Confronted with mass migration, Western legal science has been forced to rethink concepts and institutions such as borders, citizenship and the principle of territoriality.
