Routledge Research in Constitutional Law

This book is located at the intersection of constitutional law and political science and uses legal network analysis to shed light on hitherto unseen aspects of the citation practices among constitutional courts in Europe. The collection enhances our understanding as to why certain European constitutional courts refer more and others less to the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR) on the vertical level and other European constitutional courts on the horizontal level. Divided into two parts, the volume offers novel data on references between European constitutional courts. This book examines the convergences, divergences and reciprocal lessons that the BRICS countries (Brazil, Russia, India, China and South Africa)share with one another in developing the principles of private international law.


The chapters provide a thematic understanding of the cornerstones of private international law in each of the BRICS countries: namely, (1) the procedure to initiate claims in civil and commercial matters, (2) the law that would govern such matters in litigation and arbitration, as well as (3) the mechanism to recognise and enforce foreign judgments and arbitral awards.


Written by leading private international law scholars and practitioners, the chapters draw on domestic legislation and its interpretation through cases decided by the courts in each of these emerging economies, and explicitly cover the rules applicable in contractual and non-contractual concerns and issues of choice of court agreements. Issues around marriage, divorce, matrimonial property, succession and surrogacy are also addressed, considering the implication of such aspects through the increased movement of persons.


The book is a useful comparative resource for the governments of the BRICS countries, legislators, traders, academics, researchers and students looking for an in-depth discussion of the reciprocal lessons that these countries may have to offer one another on these issues.

This book analyses the theorisation and application of proportionality of criminal offences and penalties in EU law, shedding light on its hybrid nature. In the EU legal order, proportionality amounts to a general principle playing a crucial role in limiting the exercise of EU powers, assessing domestic measures' compatibility with internal market freedoms, and adjudicating fundamental rights. The EU concept of proportionality has a precise theorisation, but the principle assumes a distinct physiognomy in EU criminal law. Indeed, proportionality has a different meaning in criminal law, linked to theories of punishment. Not only do the two understandings of proportionality coexist in EU criminal law, but they are also intertwined, thus giving rise to a hybrid principle. However, their uneasy relationship remains unexplored. To understand this unique interaction, the book deepens theorisation and applications of the hybrid principle of proportionality of criminal offences and penalties in the EU legislative practice on the harmonisation of substantive criminal law and ECJ case law on the review of domestic criminal measures. This analysis gives fresh insights into the relationship between the EU and criminal law concepts of proportionality within the EU legal order.

This book analyses the role of actors that critically aid adjudicators at different stages of the dispute resolution process across 20 international dispute resolution bodies. Collectively referred to as 'dispute assistants' in the book, these actors are known by different names such as legal officers, référendaires, secretariat staff, registry staff, etc. The book uses doctrinal research, supplemented through interviews with relevant actors in each dispute resolution body, and delivers a holistic view of their everyday practice. The book provides a comparative study on the functions of dispute assistants at every stage of the dispute resolution process, revealing the widespread and critical nature of their work. It addresses the legitimacy concerns raised about the alleged influence dispute assistants may exercise over adjudicators as well as in the decision-making process. These concerns are traced across sources such as judicial/quasi-judicial decisions; statements or criticisms raised by States parties, academics, or practitioners; and concerns that arose in conversations with judges, dispute assistants, and other relevant actors. By employing a comparative lens, the book moves from concerns that are specific to individual dispute resolution bodies towards general concerns. By tapping into the wealth of comparative practices across dispute resolution bodies to navigate these legitimacy concerns, this essential book reframes the narrative that dispute assistants threaten the legitimacy of international dispute resolution, and proposes solutions to show how their expertise can be leveraged to strengthen the legitimacy of outcomes.
