This book is written for academics, students, policymakers and practitioners interested in the legal recognition of LGBT+ parenting. It provides readers with a new conceptual framework for the best interests principle and demonstrates how to apply this framework in the areas of parental responsibility, adoption, donor-conception and surrogacy.

Constitutionalism in Asia

This book analyses the equal citizenship claims of women and sexual and gender diverse people across several Asian jurisdictions. The volume examines the rich diversity of constitutional responses to sex, gender and sexuality in the region from a comparative perspective. Leading comparative constitutional law scholars identify 'opportunity structures' to explain the uneven advancement of gender equality through constitutional litigation and consider a combination of variables which shape the diverging trajectories of the jurisdictions in this study. The authors also embed the relevant constitutional and legal developments in their historical, political and social contexts. This deep contextual understanding of the relationship between sex, gender, sexuality and constitutionalism greatly enriches the analysis. The case studies reflect a variety of constitutional structures, institutional designs and contextual dynamics which may advance or impede developments with respect to sex, gender and sexuality. As a whole, the chapters further an understanding of the constitutional domain as a fruitful site for advancing gender equality and the rights of sexual and gender diverse people. The jurisdictions covered represent all Asian sub-regions including: East Asia (Japan, Taiwan, Hong Kong and South Korea), South East Asia (Malaysia, Singapore, Philippines and Indonesia), and South Asia (India, Nepal, Pakistan and Sri Lanka). The introductory framework chapter situates these insights from the region within the broader global context of the evolution of gender constitutionalism.

The youngest volume of the renowned series of European Commentaries edited by Ulrich Magnus and Peter Mankowski covers the European Insolvency Regulation. This Regulation in its recast version of 2015 is of great practical importance. It primarily regulates when courts in the EU are competent to deal with insolvency proceedings which have transborder effects, which law is applicable in such proceedings, the conditions under which insolvency proceedings are to be recognized in other EU States and how courts and insolvency practitioners should cooperate in transborder situations. The Commentary provides an in-depth presentation and discussion of each article and pays particular attention to the insolvency decisions of the European Court of Justice but also to national case law. The Hungarian Yearbook of International Law and European Law presents, contextualizes and analyzes the most important international judicial forum's decisions (in particular: CJEU, ECtHR), which relate to Hungary (e.g. either Hungary is one of the parties to the case, or the proceedings were initiated by Hungarian courts or Hungarian citizens/legal entities). The Hungarian Yearbook's other aim is to provide an opportunity for Hungarian researchers to present their latest research findings in the field of European law and international law to the international public. The book, which systematically analyzes private international law rules contained in the Colombian legal system, contributes to the study and knowledge of this legal field, and also has a positive impact on its practical application. In addition, attention is given to the need for a special legislation that not only fits the Colombian reality and takes into consideration the evolution of private international law in Latin America. The book appeals to a worldwide audience. It enables readers to better understand how private law deals with a variety of situations in the Global South. Such situations can be linked to virtually all global phenomena, including at least two: cross-border migration and international trade. Regarding this, Colombia stands out in Latin America because, although it has traditionally been the origin of many migrants, in recent years it has also come to play an important role as a destination and transit country for migrants from different regions. In addition,Colombia’s economic growth has led it to become part of several international trade agreements, for example, with the Andean Community, Venezuela, Mexico, MERCOSUR, Chile, the Northern Triangle, which includes Guatemala, El Salvador and Honduras, and also with Canada, the European Free Trade Association (EFTA), the United States, the European Union, South Korea, Costa Rica and the Pacific Alliance, of which Chile, Colombia, Mexico and Peru are members. All this, while resulting in an increase in situations with foreign elements that must be dealt with by national authorities, makes it unavoidable to know the Colombian private international law to know the legal landscape of the region in relation to global issues that currently must be addressed worldwide. Thus, the book is of interest to students in different countries. They find in it a guide to understand the theory and dogmatics of private international law in Latin America and Colombia. The academic relevance of the book is alsoreflected in its usefulness for scholars working in private international law and comparative law. It allows for an in-depth study of the problems that underly private international law in this part of the Global South. It is structured and written in such a way that it can be used as a textbook in undergraduate and graduate courses in subjects such as comparative law, private international law, international contracts, international trade, and international movement of persons and goods.

A Private International Law for Colombia

This book examines the convergences, divergences and reciprocal lessons that the BRICS countries (Brazil, Russia, India, China and South Africa)share with one another in developing the principles of private international law.


The chapters provide a thematic understanding of the cornerstones of private international law in each of the BRICS countries: namely, (1) the procedure to initiate claims in civil and commercial matters, (2) the law that would govern such matters in litigation and arbitration, as well as (3) the mechanism to recognise and enforce foreign judgments and arbitral awards.


Written by leading private international law scholars and practitioners, the chapters draw on domestic legislation and its interpretation through cases decided by the courts in each of these emerging economies, and explicitly cover the rules applicable in contractual and non-contractual concerns and issues of choice of court agreements. Issues around marriage, divorce, matrimonial property, succession and surrogacy are also addressed, considering the implication of such aspects through the increased movement of persons.


The book is a useful comparative resource for the governments of the BRICS countries, legislators, traders, academics, researchers and students looking for an in-depth discussion of the reciprocal lessons that these countries may have to offer one another on these issues.

Private International Law in BRICS

Equality law is audist. Deaf communities around the world continue to encounter Deaf Legal Exclusion through legal frameworks that define them narrowly and restrict their rights. This book examines why these frameworks have not delivered equality in practice. It argues that the core issue is structural misrecognition: law protects deaf people only when they accept a definition based on impairment. Sign language, culture and community are treated as secondary. What appears to be inclusion is often a Deaf Legal Illusion: equality claimed in principle but absent in practice. The book analyses five models used to categorise deaf people in law and policy: disability, language minority, culturo-linguistic community, ethnic group and Indigenous group. Some appear in legislation; others are found in scholarship and advocacy. Each reflects only part of deaf people's lives. Drawing on doctrinal and socio-legal analysis of the Equality Act 2010, case law of the ECtHR, and the UN Convention on the Rights of Persons with Disabilities, the book critiques how equality law relies on narrow definitions of fairness. It explores formal, substantive and transformative precepts of equality, assessing their ability to reflect deaf people's experiences. It identifies the audist assumptions built into legal systems that expect deaf people to adapt to hearing norms, while withholding full recognition of sign language and community belonging. In response, the book proposes the Deaf Rights Model, which brings the five models together as complementary rather than competing. Alongside Deaf Equality Concepts, it offers a framework in which sign language, culture and community become central to legal thinking about equality. The Deaf Legal Dilemma establishes Deaf Legal Studies as a field grounded in the priorities and expertise of deaf communities. It invites lawmakers, practitioners and scholars to rethink the purpose of the law and the structures through which deaf people are recognised.
