A Critical Introduction

Brexit involves a break from the environmental regulation regime of the EU, including the oversight by the European Commission. A large proportion of existing environmental law and policy in the UK derives from the EU, with its implementation largely monitored and enforced by EU institutions such as the European Commission. The Environment Act 2021 introduces a new regime of environmental principles and governance to fulfil the role that will be lost upon Brexit. The Act creates a new regime of environmental policy for the UK, together with a new system of targets, monitoring and reporting on issues such as air quality, water, waste and biodiversity. It also creates an entirely new body - the Office for Environmental Protection - with wide-ranging enforcement powers, and a new form of litigation: environmental review. In addition, the Act extends and develops environmental law sectorally in a number of significant ways, including by on waste collection, biodiversity net gain, conservation covenants and due diligence on forest risk commodities. This new book will provide a practitioners' guide to the implementation of the Act including related legislation and regulations made under it. This book aims to explore possible solutions to the climate crisis through the tools provided by law, with particular emphasis on tax law. In a rapidly changing and constantly evolving society, taxation assumes increasing importance, as exchanges become as swift and complex as the connections that bring people closer together. Tax law permeates every activity involving an exchange, including those conducted remotely.The chapters follow a linear progression, moving from description to the proposal of concrete solutions. The analysis begins with an examination of the status quo, paying particular attention to the warnings raised by academics who have long highlighted the challenges posed by climate change and emphasized the need for a just transition. The discussion then turns to the issue of taxonomy, which plays a crucial role both in taxation and in green finance.Subsequently, the book explores the opportunities offered by well-designed labor taxation, especially in relation to the development of green jobs. It also provides an overview of the taxation of the digital market, considered in both the Italian and international contexts, in order to address current fiscal challenges.The final chapters set out several relevant solutions, including both short- and long-term measures, implemented through a range of legal instruments. In addition, the book offers macroeconomic perspectives, including reflections on possible adjustments to existing economic theories, with the aim of encouraging further research at the intersection of law and economics.

Outer space has long been considered the last untouched wilderness. However, non-State actors are increasingly active in space, heightening the risk of space pollution. Space law, designed during the Cold War, is State-centric and makes inadequate provision for non-State actors. In the face of this emerging threat, this book examines potential avenues of redress in space law, including the Outer Space Treaty, along with international environmental law, international criminal law, international humanitarian law, and international human rights law. It also reviews the national legislation adopted by space-faring States at the domestic level. Title 40 presents regulations governing care of the environment from the 14 subchapters of Chapter I and from the provisions regarding the Council on Environmental Quality found in Chapter V. Programs addressing air, water, pesticides, radiation protection, and noise abatement are included. Practices for waste and toxic materials disposal and clean-up are also prescribed. Additions and revisions to this section of the code are posted annually by July. Publication follows within six months.
