Adopting a multidisciplinary approach to climate adjudication, this open access book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania. In all, the volume will: - Engage with extra-legal influence to how show judges and arbitrators make their decisions in climate cases, shedding light on the inconsistent responses that climate cases have generated so far - Challenge assumptions of legal universalism, by recognising differences in how the law works in various - Inform actors involved in climate litigation (lawyers, judges, arbitrators, disputants), policymakers, and the public about how cases are decided. This book discusses private international law rules relevant to environmental disputes in Asia that involve corporations, surveys 12 Asian jurisdictions, and proposes areas for reform. The volume is split into two sections. The first of these is dedicated to framing and discussing specific issues, such as the liability of corporations, directors and investors for environmental wrongdoing, or the recognition and enforcement of foreign judgements and awards on environmental disputes - and how domestic rules may affect private international law. Across his career as an academic, Advocate General at the Court of Justice of the European Union, and judge of the High Court, Court of Appeal, and Supreme Court of Ireland, Gerard Hogan has had a profound influence on public law. He is widely regarded as Ireland's leading legal scholar, particularly in constitutional law, administrative law, and EU law. The volume in his honour focuses on the central role of courts in public law. What goals are still feasible for the politics of emancipation on a ruined planet? This is where we are. Today's techno-oligarchs are not concerned with saving the planet; rather, they have accepted the end of progress and are focused on safeguarding their wealth in the face of an impending political and ecological collapse. Artificial intelligence and algorithms make decisions for us. Climate breakdown has long steamed past the wreckage of the Paris Agreement. Perhaps the accelerationists have the right idea. Accelerationism - which aims to resolve the current crisis through the intensification of technological development - is the only philosophy not clinging to the now-extinct idea of progress. The idea has gained ground on both the left and right: but the right-wing is shot through with misanthropy, while the left remains entangled in a faith in technological progress and the domination of nature. Transcending capitalism at the end of progress requires a synthesis of the two. The result of this synthesis: Dark Socialism. From 'rock star philosopher' Kohei Saito comes an anticapitalist clarion call for our breakneck times, channeling despair into a socialist project equal to the end of progress.

This book explores the major theories of common law adjudication and presents a new theory of adjudication. It shows that the existing major theories of common law adjudication each capture only part of what occurs in actual court proceedings. It presents a new theory of adjudication that incorporates both useful and modified elements of these theories. The new theory itself comprises two parts: first, an attitudinal aspect based on institutional values; and second, a number of practical and theoretical factors which give concrete expression to those values. Throughout the book, the author draws on his prior experience both as a law professor and as a judge in his country's highest appellate court in order to provide a unique perspective that illustrates this new theory.
