This book examines the development of the Russian oil and gas industry over recent decades, showing how, in a series of in-depth case studies of previous international company involvement, international companies should in future cope with the business environment, how they should acquire local knowledge, deal with the state, and forge partnerships with domestic companies, but only to a limited extent.

Russia is the world’s largest producer of both oil and gas, with very significant reserves. Since the collapse of the Soviet Union the exploitation of oil and gas has taken place mainly in existing "Soviet legacy" fields, where established, relatively simple technologies were sufficient. This enabled the Russian state and local Russian entrepreneurs to be major players in the oil and gas industry, making use of international oil and gas companies and their expertise, but not wholly reliant on international companies. As the position is now changing, with "Soviet legacy" fields coming to the end of their lives, and with a growing need for more difficult fields to be exploited, requiring more advanced technology, the role of international companies is likely to be greater in future. This book reassesses classic Marxist theories of finance capital and uneven development in the context of the present intensified process of financialization and the accentuation of combined and accelerating uneven development. In particular, the work of Hilferding and Luxemburg is discussed and re-framed in light of both the contributions of Marx and more recent engagements by David Harvey and Neil Smith. The book explores the case of South Africa in particular in light of the combination of a rapidly financializing yet crisis-ridden South African political economy on the one hand and intensifying social inequality and political conflict on the other.&nbsp;It explores a series of strategies and possibilities that might open up trajectories for change and transformation with particular attention paid to the promises and constraints of the de-growth movement and intersectional class struggle, which will appeal to political economists, researchers, and students alongside those studying South Africa specifically. Patrick Bond is a political economist and professor at the University of Johannesburg, South Africa. He spent more than two decades teaching at the Wits University School of Governance in Johannesburg and the University of KwaZulu-Natal Centre for Civil Society in Durban. During the late 1980s he pursued doctoral studies in economic geography at Johns Hopkins University, while learning politics in the anti-apartheid, labour, student and community movements. In 1994 and 1996, he worked in the Reconstruction and Development Ministry in President Nelson Mandela’s office, drafting the democratic government’s first White Paper and a dozen other major policy documents. He appears more than 100 times a year on South African and international broadcast media, and usually gives more than 50 guest lectures annually.

This collection of essays presents a socio-legal history of epidemics from the medieval period to the present day. Building on previous studies of infectious diseases undertaken by social historians of medicine, this collection explores the histories of epidemics and disease by looking at the legal measures deployed against them. Whilst previous works have considered the mechanisms by which legal change occurs, the social and political assumptions on which new laws and new legal structures are premised and the social changes which follow, this book focuses on the way in which historical actors understood law to be a complex means of responding to disease and the way in which that law shaped (and limited) the responses which could be made to disease. Taking an interdisciplinary approach, it features contributions from scholars across a range of academic disciplines who consider the wider implications of epidemics and disease beyond the obvious health effects. The collection focuses first on regulatory responses such as the quarantine laws and border policies in the eighteenth century, the framing of 'disease' in the Colonial Immigration Acts in the nineteenth century and the ethics of public health in the twentieth century in Great Britain. It then goes on to consider developments in broader legal doctrine which themselves resulted from social and/or legal responses to disease, including the centralisation of labour regulation in the wake of the black death, property disputes about leper houses, pest houses and fever hospitals, and the prosecution of medical professionals for disease transmission in 19th century England. Methodologically all the chapters are historical, but a range of approaches has been taken, from quite traditional doctrinal legal history through socio-legal history to traditional political and social history, to bring the history of epidemics and the legal measures deployed against them in to sharp focus.

Epidemics and the Law from Plague to the Present

The question explored in this book is how contracts can manage uncertainties. Commercial parties face uncertainties on a regular basis. Market fluctuations, new laws and regulations, pandemics, rapid technology advancements, and geopolitical tensions are all examples of events whose nature cannot be easily foreseen or captured by the contractual parties' expectations. One possible way of addressing the uncertainty generated by such risks and events is through reliance on established contractual doctrines, such as variation or frustration. Under English law, these doctrines are traditionally limited. Another, and typically preferable, method is for contract drafters to include clauses that modify, suspend, or terminate the obligations or liabilities of one (or both) of the parties, or clauses that at least open up the options for renegotiation. Examples include material adverse change (or effect) clauses, hardship clauses, performance clauses, termination or suspension clauses, remedies clauses, and variation clauses. Such clauses raise a range of issues concerning their interpretation, effect and enforceability; the consequences that follow when the clauses do not work as planned; the consequences of allocating contractual discretion to a party to determine the existence of the relevant risk or event; and the extent to which the existence of specific clauses changes the options available to the parties beyond what general contract law principles offer. The book advances the understanding of how the law deals with the unexpected and is an essential read for academics, students, and practitioners, including contract drafters, legal advisors, and litigation lawyers.
