HUMAN RIGHTS LAW EXPLAINED

Founded in 2001, the GCYILJ provides an authoritative and unique annual survey of developments in global law, governance and jurisprudence. The 2025 Volume marks the Yearbook's twenty-fifth anniversary and reflects on the endurance of constitutional principles amid global disorder and the pressures reshaping international law, justice, politics, and ethics. Contributions address current systemic crises: geopolitical conflicts, the humanitarian emergency in Gaza, liberal democracies, famine and impunity, multipolarity in international law, international governance, planetary ethics, public-interest litigation before the ICJ, and the ICC's contested role between Ukraine and Palestine. The Global Community Yearbook of International Law and Jurisprudence 2025

Róisín Á Costello provides a critical analysis of the ways in which law is portrayed in Irish literature and argues that authors from Ireland (writing in both Irish and English) have consistently used literature as a mechanism to challenge and critique institutional power. In doing so, she argues that Irish literature, and the narratives it has created about law, have been used to re-assert and recomplicate Irish identities at sites of conflict and to interrogate the legitimacy of power and how it is exercised. Drawing on a range of texts including novels, poetry, plays, song and satire, Costello illustrates that Irish literature has acted as a decolonial and intersectional force in critiquing the institution of law and constructing national, linguistic and political identities in Ireland. She traces a pattern in which Irish authors consistently used literature as a lens for legal analysis in Ireland, using their work to address fundamental concerns about the legitimacy of law, the role of doubt in legal proceedings, the need for popular accountability, and the marginalisation of minority groups an identities by formal institutions and system.

This book reimagines gender-based poverty in urban areas as a human rights issue, offering a transformative legal framework to address one of the most pressing and overlooked challenges of our time. More than half the world's population now lives in cities, with women comprising a growing share of the urban population/residents/people living in urban areas. Yet gender-based poverty remains a persistent and under-addressed issue in international human rights law. No existing convention explicitly tackles the intersection of gender, poverty, and urbanisation. This book breaks new ground by arguing that gender-based poverty in urban areas can - and should - be recognised as a human rights violation. Drawing on legal theory, feminist legal studies, and international human rights frameworks, the book critiques current legal approaches that treat poverty as a social or moral issue, rather than a structural and multidimensional injustice. It advances Sandra Fredman's four-dimensional model of substantive equality - disadvantage, recognition, participation, and transformation - as a more effective legal lens. The European Convention on Human Rights

This book is the first comprehensive academic treatment of the International Covenant on Economic, Social and Cultural Rights (ICESCR) and employment rights, which has a global vocation demonstrated by having been ratified by 173 States since it was adopted in 1966. Workers' rights need protection and reinforcement. To achieve this aim, international human rights standards can play an important role. The ICESCR is the most important global UN instrument in this respect. It covers a wide range of employment rights, including the right to strike, and has global application. But it is not sufficiently developed and used, and national implementation often needs improvement. Part 1 of the book analyses general issues related to the Covenant, such as context, development, challenges, influences at the global and regional levels, interpretation and procedural elements. Part 2 deals with the specific provisions which are directly linked to the employment relation. The book is based on a thorough analysis, mainly, but not exclusively, of the case law of the Committee on Economic, Social and Cultural Rights (CESCR), that is monitoring the national implementation of the Covenant. Together, the chapters in this book will empower academics and practitioners in labour law to find answers to relevant and practical problems in order to better enforce and improve workers' rights. The book is the result of a project by the 'Transnational Trade Union Rights' experts Network (TTUR), linked to the European Trade Union Institute (ETUI).

The International Covenant on Economic, Social and Cultural Rights and the Employment Relation

This collection explores the relationship between race, racism, and human rights law. It seeks to illuminate, in particular, how the European Court of Human Rights articulates the category of race, how human rights are experienced (differently) by racial minorities, and whether the European Convention on Human Rights has the tools to recognise and address racial harms. By centring race, it considers how Convention rights would look through the lens of race and ultimately interrogates if human rights law is part of the solution or part of the problem.
