This book examines the convergences, divergences and reciprocal lessons that the BRICS countries (Brazil, Russia, India, China and South Africa)share with one another in developing the principles of private international law.


The chapters provide a thematic understanding of the cornerstones of private international law in each of the BRICS countries: namely, (1) the procedure to initiate claims in civil and commercial matters, (2) the law that would govern such matters in litigation and arbitration, as well as (3) the mechanism to recognise and enforce foreign judgments and arbitral awards.


Written by leading private international law scholars and practitioners, the chapters draw on domestic legislation and its interpretation through cases decided by the courts in each of these emerging economies, and explicitly cover the rules applicable in contractual and non-contractual concerns and issues of choice of court agreements. Issues around marriage, divorce, matrimonial property, succession and surrogacy are also addressed, considering the implication of such aspects through the increased movement of persons.


The book is a useful comparative resource for the governments of the BRICS countries, legislators, traders, academics, researchers and students looking for an in-depth discussion of the reciprocal lessons that these countries may have to offer one another on these issues.

This book explores how, over two centuries, the Russian meaning of the rule of law has been reflected in the legal doctrine, legislation, formal and informal practices of legal and political institutions, and also everyday life and the perceptions of Russian citizens at large and certain minority groups. 

The authors argue that legal dualism – the tension between constitutionalism and political expediency – explains the rise and fall of multiple ways in which the parts of the Russian state interact with each other and with citizens, and in which citizens and businesses interact among themselves both at home and abroad.

Fentanyl is a first-person, insider account of how the crisis consumed the Biden Administration amid a series of other national security emergencies. It follows Jake Braun, a senior White House official, and his colleagues while they scramble to respond to the epidemic. As Mexican cartels ruthlessly executed their most radical transformation in 50 years, Braun and his colleagues architected the first U.S. government wide strategy to combat fentanyl in history. The effort brought him to Mexico to meet with Mexican agents who kick down cartel doors for the U.S. government there. He also spent time with data analytics wizards buried in nondescript offices in Virginia suburbs that hunt down Chinese fentanyl precursor chemicals on the Dark Web. He even takes a detour to gather intelligence from Russian migrants in U.S. detention facilities that migrated through cartel-controlled areas of Mexico. In the process, Braun uncovered the remarkable transformation cartels in Mexico underwent over the last 50 years. They morphed from narco-empires the size of Fortune 50 companies specializing in marijuana and cocaine to ones specializing in human migration and, separately, fentanyl. After much painstaking effort, the Biden Administration successfully executed the most sweeping takedown of cartel leadership and fentanyl infrastructure since the crisis began. Due to the efforts of heroic agents, intelligence officers and national security experts, the leviathan U.S. government is now marshaled in ways never before imagined against the Chinese chemical companies and cartels propagating the fentanyl epidemic. Further, the strategy seems to be working. Just a year after it was kicked off, the fentanyl fatalities dropped nearly 37%. Yet the crisis persists. This book provides a comprehensive overview of Russia's Arctic policies since the 2022 war with Ukraine began. Covering geopolitical transformations, domestic evolutions and the role of climate change, it traces how, for around two decades, Russia has renewed its strategic interest in the Arctic region. It reflects on how, with more than half of the circumpolar territories, Russia's Arctic regions generate between 10 and 15% of Russia's GDP and a quarter of its exports, with the yet-to-be-explored reserves of the Arctic continental shelf also offering immense potential. Russia's Arctic analyses the growth of hydrocarbon deposits in the far north of Siberia and nearby offshore areas and how this has contributed to the rapid development of the Northern Sea Route. Marlene Laruelle and Jean Radvanyi examine the tremendous long-term importance of the region for Russia, regardless of internal political developments and the state of relations with the West. Long a place for science diplomacy and transborder dialogue, the region has once again become a hotspot for geostrategic tensions and a new interface between an expanded NATO and Russia. While the West is imposing increasingly broad sanctions specifically targeting Arctic hydrocarbon development projects, the Russian government is striving to circumvent or mitigate their effects with countermeasures by relying on their allies, most of whom are Asian. This book makes a simple but consequential claim: individuals who decisively influence a state's decision to use armed force should be held criminally responsible for aggressive war. Challenging the prevailing orthodoxy, it reinterprets the leadership clause in the definition of the crime of aggression and offers a new responsibility framework that reflects how decisions about war are actually made. Under this approach, liability is not confined to heads of state and top military leaders but extends to civilian power brokers, private actors, and third-state officials who are present at key moments of deliberation and, as reason-giving and reason-demanding participants, exercise decisive influence over whether a state goes to war or continues one. By clarifying who counts as a 'leader' and why, the book charts a principled middle path between overcriminalizing ordinary participants in war, such as common foot soldiers and private citizens, and exempting those who set unlawful wars in motion. Drawing on an eclectic set of sources, the book offers a timely rethinking of individual responsibility for the unlawful uses of force.
