This book is a monograph by Professor Cui Jianyuan on the article by article interpretation and evaluation of the real right provisions of the Chinese civil code, which is divided into two volumes. The interpretation of each article includes: the main purpose of this article, pointing out the core meaning of the law in one sentence; Relevant provisions to clarify the application conflict of repealed laws and relevant judicial interpretations; Understanding and application not only provide a value guidance from the perspective of theory, but also guide the application of law in specific cases from the perspective of practice, but also make a forward-looking discussion on the possible difficult problems in practice.

Governing AI is about getting AI right. Building upon AI scholarship in science and technology studies, technology law, business ethics, and computer science, it documents potential risks and actual harms associated with AI, lists proposed solutions to AI-related problems around the world, and assesses their impact. The book presents a vast range of theoretical debates and empirical evidence to document how and how well technical solutions, business self-regulation, and legal regulation work. It is a call to think inside and outside the box. Technical solutions, business self-regulation, and especially legal regulation can mitigate and even eliminate some of the potential risks and actual harms arising from the development and use of AI. However, the long-term health of the relationship between technology and society depends on whether ordinary people are empowered to participate in making informed decisions to govern the future of technology - AI included.

Ius Gentium: Comparative Perspectives on Law and Justice

This book traces, assesses and compares the history of conscientious objection – in the cultural context of eight developed democratic nations – from refusal of military service and a range of similar moral dilemmas, to objecting to abortion, to vaccination hesitancy and contemporary warfare. It considers the impact of this form of dissent in relation to social movements, social activists and whistle blowers. It reflects on the relationships between the sacred and the secular, the state and the citizen, in order to better understand the responsibilities of citizenship in our increasingly secular societies. It analyses what defines the conscientiousness of an objection from both legal and ethical standpoints. It explores the increased reliance on “grounds of religion, belief or conscience” as providing justification for excusing some citizens from complying with certain responsibilities – mandated by equality and non-discrimination legislation – that are binding for all others. By conducting a comparative evaluation of national law and judicial rulings on a fixed agenda of issues, this book identifies key jurisdictional differences concerning conscientious objection. In so doing, it highlights the importance of cultural context and constructs a jurisdiction-specific overview of legislation, policies and case law. By tracking policy developments and highlighting crucial judicial rulings – particularly in the US – it provides insights into the probable future direction of developments in national law relating to conscientious objection. Lastly, the book draws attention to some of the potential consequences of manifesting dissent by opting out of performing public services: the possible local breakdown of specific service availability (e.g. abortion); prompting population movements as established democratic civil rights are locally negated; fragmenting society into a geographic patchwork of regions in which some citizens are branded as conservative/reactionary and others as progressive. Conscientious objections carry profound implications for a coherent democratic society.

Constitutionalism in Asia

This book presents an in-depth interrogation of the theory and application of the Basic Structure Doctrine in the Federation of Malaysia. The Basic Structure Doctrine, famously introduced in the 1973 Indian Supreme decision of Kesavananda Bharati v State of Kerala AIR - which held that certain core or fundamental features in the Constitution of India could not be amended by Parliament even if it met all procedural requirements - was initially rejected when it was first argued in Malaysia in the 1975 case of Loh Kooi Choon v Government of Malaysia and lay dormant for the next three decades. Judicial winds shifted in 2010 when Malaysia's apex court, the Federal Court, cited Kesavananda with approval in the case of Sivarasa Rasiah v Badan Peguam Malaysia &amp; Anor, and observed that it was 'clear from the way in which the Federal Constitution is constructed that there are certain features that constitute its basic fabric' and that 'any statute (including one amending the Constitution) that offends the basic structure may be struck down as unconstitutional.' In a quick succession of cases, the Federal Court cemented this doctrine in Malaysia's jurisprudence and deployed it to defend the court's judicial power. These widely-publicised cases generated much debate beyond the legal fraternity and judiciary and often polarised different sectors of Malaysian society. This collection of essays responds to this extremely important debate on the limits of constitutional amendments as a form of constitution-making in Malaysia by considering the theory behind the Basic Structure Doctrine and critically examining how it has been harnessed by the Federal Court and by other political actors - most notably Islamists and secularists; and royalists and republicans - on the ground.

This book analyzes the relation between the Churches’ official teachings regarding ‘desired’ and forbidden forms of sexual behaviour on the one hand, and mundane practice on the other hand, focusing on perspectives ‘from below’. Since the very beginning, Christianity has sought to regulate the love lives of its believers. The clergy’s growing influence on state institutions and the introduction of Christian sexual ethics left its mark on law, education and social norms. However, the everyday lives of most believers had little in common with the sexual norms propagated by clerics. The territory of Poland is especially interesting due to the fact that over the centuries different Christian confessions as well as distinct ethnic groups with various cultural norms co-existed there. Additionally, this edited collection looks at different groups of actors, such as peasants, the clergy or townspeople from the Early Middle Ages until the late twentieth century, and also includes different types of sources as well as of methodological approaches. This long-term perspective shows the impact and influence of Church teachings in a longue durée, and highlights social factors that both shaped discourses on sexuality and also indicated the changing power of the Church.

A new paradigm based on quantum probability that can model stock markets and price options—and also upends classical quantitative finance. In The Quantum Stock Market, David Orrell combines theory and new empirical findings to argue for a new approach to finance based on quantum probability. The main finding, a property called q-variance, may be unique in finance in that it was discovered as the result of a prediction, affects financial markets in general, has no tunable parameter, and has important consequences for a range of topics including the pricing of financial options. The property, which somehow eluded detection for over a century, has been verified by experts in the field. And the fact that it is incompatible with classical finance—which is perhaps why it went undetected—suggests that the field must be reinvented.
