South Africa presents the perplexing paradox of arguably having the most progressive Constitution in the world, marked by full-throated socio-economic rights protection, while also being one of the most unequal countries in the world. This book takes seriously increasing sociopolitical challenges to the legitimacy of South Africa's post-apartheid legal order and scorching critiques of the constitutional settlement, against which many in the legal establishment bristle. Sindiso Mnisi develops 'Alter-Native Constitutionalism,' which is distinguished by equitable amalgamation of customary and common law with vernacular (or 'living') law, as a more compelling and just model for South Africa to adopt in its future than the legal pluralism that largely represents the afterlives of colonialism. Game theory is a very powerful instrumental framework designed to analyze and solve complicated situations, especially decision-making problems under conditions of uncertainty. Major problems and issues in legal practice and jurisprudence are decision-making problems under conditions of uncertainty, therefore, it seems quite natural to use game theory to solve these problems. Moreover, game theory's solutions for these legal problems and issues are very simple, easily applicable, inexpensive and considered to be fair in comparison to other solutions. The objective of this book is to make game theory in the legal context accessible for the reader, especially for legal practitioners, academics and students, using clear, simple and comprehensive theory, explanations and examples from daily legal practice. This book offers an analysis of how the European Court of Human Rights engages with identity and emotion, revealing both the promise and the limitations of human rights law in addressing the complexities of human experience. The book explores how human rights law, often framed as universal and abstract, responds to deeply personal questions of identity, belonging, and emotional impact. Based on a systematic study of over 3,300 judgments, the book shows how the European Court of Human Rights has increasingly made identity central to its reasoning - particularly in cases involving sexuality, ethnicity, and family life. In these areas, the Court acknowledges how state actions shape emotions such as fear, humiliation, and dignity. Yet, in other domains - migration, religion, professional life - the Court avoids emotional engagement, leading to troubling inconsistencies. The book argues that when emotions are excluded from legal reasoning, individuals are reduced to formal entities, stripped of depth and interiority. Combining doctrinal analysis with insights from social theory and psychology, the book presents a new framework for understanding how emotions and identity interact with law. It traces the evolution of identity references across categories and highlights the Court's uneven treatment of emotional harm. Verordnung über künstliche Intelligenz: KI-VO

Der WuV-Kurs im Öffentlichen Recht unterstützt die eigene Vorbereitung auf die Erste Juristische Staatsprüfung ohne Repetitor. Er wendet sich an Studierende, die „scheinfrei“ sind und sich nunmehr in der Vorbereitung auf das Staatsexamen befinden. In dieser Phase ist es nicht mehr sinnvoll, weiteres Inselwissen anzuhäufen. Es droht ohnehin schon, angesichts der Stofffülle die Übersicht zu verlieren. Von Nöten ist vielmehr eine gezielte Schwerpunktsetzung. Für eine erfolgreiche Vorbereitung auf das Examen ist zudem das Training der Methodik der Fallbearbeitung unabdingbar. Deshalb müssen gutachterliche Falllösungen und systematische Rechtskenntnisse zusammengeführt werden.
