'On the Regulation of Water Charges. A Systematic Analysis and Comparison of Control Mechanisms for Water Fees and Water Prices': Monopolies, whether private or public, tend to be inefficient. While antitrust abuse control is particularly suitable for protecting consumers from inefficiency costs, public law proves to be less effective. Considering the general principle of equality, there is thus a need for reform, which should be implemented by way of amendment of the Act against Restraints of Competition (Gesetz gegen Wettbewerbsbeschränkungen) so that water fees are subject to control by the antitrust authorities.
