Routledge Studies in Religion and Politics

The Politics of Catholic NGO Networks asks 'Who speaks for the Catholic Church during a humanitarian crisis?' and answers that there is no single voice; only a plurality of Catholic actors whose relationships with the Holy See differ sharply, and whose humanitarian work is shaped as much by internal organisational dynamics and Church politics as by the crises they respond to.This book offers the first comparative study of three of the world's most significant Catholic humanitarian networks: the Caritas confederation, the Jesuit Refugee Service, and the Community of Sant'Egidio, through drawing on over thirty interviews and extensive fieldwork in Rome and the Vatican. Each network occupies a distinct status (dependent, semi-dependent, and independent organisations) in relation to Church hierarchy, producing strikingly different approaches to assisting refugees and forced migrants. Moving between the internal governance of the Church and the external landscape of secular humanitarianism, the book exposes a persistent and more nuanced "religious literacy gap" among UN agencies, donors, and NGOs working alongside faith-based partners. Combining an interpretivist, practitioner-informed methodology at the intersection of IR, religion, and humanitarianism, Dr Intropido directly engaged with diplomats, humanitarian workers, and Church officials, offering both a new theoretical account of religious actors in world politics and a practical checklist for anyone partnering with Catholic humanitarian organisations. The Politics of Catholic NGO Networks will be essential reading for students and scholars of religion and politics, international relations, sociology and anthropology of religion, humanitarian, development, and migration studies, and for practitioners navigating the increasingly visible role of religion in global affairs.

Studies in Penal Theory and Ethics

This book examines whether the two dominant paradigms of punishment theory - retributivism and consequentialism - can be reconciled within a single coherent rationale. It addresses a central problem in criminal law theory and moral philosophy: how punishment can be justified in a way that is both principled and responsive to social consequences. Through a comparative and analytical approach, the book brings together major attempts to bridge the divide between deontological and consequentialist accounts of punishment. It moves from Kant and Bentham to Hegel's project of unification, and then to contemporary theorists including Rawls, Roxin, Brooks, Pawlik, Jakobs, Duff, Tadros, and Zaibert. In doing so, it analyses hybrid, limited, and supra-conceptual approaches across Anglo-American and Continental traditions. The book shows that the classical opposition between retribution and prevention no longer captures the complexity of contemporary punishment theory. Instead, it argues that many competing accounts converge on the idea of punishment as a mechanism of social ordering, while also showing that order cannot be understood merely as something to be maintained or restored. It proposes that any genuinely unifying theory must reconceptualise order as dynamic, contextual, and permeable, while also acknowledging the limits of theoretical unification. The book provides a clear framework for a fragmented debate and offers new perspectives on punishment, legitimacy, and ethics that will be of interest to anyone working in, or with an interest in, criminal law, jurisprudence, penal theory, criminology, and moral and political philosophy.

The Search for a Unified Theory of Punishment

Leniency might sometimes be the ethical response to atrocity. However, the more extraordinary an act of violence is, the greater the compulsion to severely punish the offender. The rationale is that the threat of harsh punishment will be more effective at preventing crime. At the same time, the notion that the criminal justice system is corrupt and ineffective has become commonplace. At the center of these conflicting trends is a puzzle that this book sets out to solve: what if punishment should not only be judged by its effectiveness, but also by its morality? Mexico's War on Drugs has unleashed an endless cycle of violence in the country. The resulting human toll is catastrophic. Atrocity Without Punishment advances ethically compelling reasons to impose lenient sentences on offenders involved in drug trafficking, including many who commit serious offenses. Juan Espíndola argues that this is in fact a morally permissible, even obligatory, way to hold perpetrators accountable. From this vantage point, Espíndola problematizes the relationship between punishment and core political values such as legitimacy and justice. By challenging the criminal justice system in this way, he charts a path toward a more just criminal legal system that can muster the support of those who reject abolitionism.

Studies in Private International Law

This groundbreaking book offers an in-depth exploration of the complex and evolving landscape of the recognition and enforcement of foreign judgments across Africa. Covering more than 26 jurisdictions, it spans a remarkable diversity of linguistic traditions (including English, French, Arabic, and Portuguese), religious contexts (such as Christian-majority and Muslim-majority countries), and legal systems (ranging from common law and civil law to mixed jurisdictions). As the first comprehensive study of its kind, the book examines national procedures, legal regimes, and institutional frameworks, combining theoretical insights with practical analysis. It sheds light on the multifaceted challenges that arise in cross-border civil and commercial litigation and reflects on the prospects for legal harmonization and reform within the continent. Drawing on the most up-to-date case law and legislative developments, both domestic and regional, the book offers a unique and timely contribution to understanding the mechanisms-current and emerging-that govern the movement of judgments across African borders. A practical guide and indispensable reference for practitioners, academics, judges, students, and policy makers alike, this invaluable book provides a comprehensive overview of the current state of foreign judgments recognition and enforcement in Africa, with all its intricacies and complexities.

Recognition and Enforcement of Foreign Judgments in Africa

A revelatory financial history showing that today's massive Islamic finance industry was preceded by decades of Muslim interest banking across Eurasia and Africa. Since the 1970s, the now multi-trillion-dollar Islamic finance industry has offered interest-free banking to Muslims around the world. Its proponents maintain that Islamic law strictly forbids all forms of financial interest. Many academic accounts echo this perspective, assuming that before the 1970s, Muslims either avoided interest banking out of deep-seated religious hostility or practiced it in defiance of religious stricture. Yet as Michael O'Sullivan argues, these narratives overlook rich traditions of Muslim interest banking that preceded Islamic finance. In the early twentieth century, the first modern Muslim-owned interest banks appeared across Eurasia and Africa-from India to the Ottoman Empire, Tsarist Russia, Habsburg Bosnia, Tunisia, Egypt, Iran, Palestine, and Indonesia. Viewed as a solution to Muslim economic distress, these banks intensified debates among Muslims about both the Islamic legal tradition and acceptable economic practices. While interest banks raised suspicions among some Islamic legal scholars, others explicitly defended their legality and encouraged Muslim entrepreneurs. Ultimately, O'Sullivan shows that the Islamic finance industry's commitment to interest-free banking was a product of contingency as much as principle. It was a combination of bank failures, high rates of indebtedness, and changing religious interpretations that eventually led many Muslims to reject interest banking and demand a replacement more commensurate with an "Islamic economy." Even so, the religious debates inaugurated by the first Muslim interest banks persist to this day. A vibrant portrait of economic life in the so-called peripheries of capital, The Borrower's Refuge is a major contribution to the global history of finance.

The Borrower’s Refuge

In striking black-and-white portraits, dozens of survivors of Michigan's cruel sentencing of children to life without parole-now free adults-are portrayed with irrepressible dignity

The United States is the only country in the world that sentences children to serve time in adult prisons without the possibility of parole. The portrayal of children in conflict with the law, particularly children of color, as inherently threatening, dangerous, and adult-like has been key to denying these youth a second chance and foundational in justifying their cruel and excessive punishment in the criminal legal system..

In Morning from Now On, LaBelle, himself a survivor of childhood incarceration, cocreates astute and nuanced portraits with more than fifty of the hundreds of people in Michigan incarcerated as children. Accompanying essays provide critical context on the history of and impact on a society that locks away our children.

In witnessing these survivors' yearning for freedom, the obstacles they face upon reentry, as well as the wonder and joy of being reunited with their families and communities, this collection reminds us of their unfathomable losses and calls on us to cherish all our children.

With contributions by Jose Burgos, Bernardine Dohrn, Xavier McElrath-Bey, Timothy Connors, and Alison Leal Parker.

What if we abolished police, courts, and prisons? Where would we turn for justice? Do we need laws? Punishment? These questions are not just the preoccupation of an abolitionist pipedream. Their answers already exist, if only we know where to look.
Professor Sitrin introduces readers to communities worldwide that resolve harms and conflicts without looking to the state or the judiciary. The book focuses on alternative forms of justice, peace-keeping, and adjudication in selected locations, with particular attention to indigenous and women-led movements from across Mexico, Argentina, Rojava, and the USA. Marina Sitrin traces how each came to be and examines the theoretical and political underpinnings of the process.
We Make Our Own Justice allows the reader to reflect on how these alternative forms of justice and adjudication have been planted and nurtured over time-often over decades-and to consider the possibilities for other communities and regions to produce something similar. We Make Our Own Justice offers an invaluable resource, fostering optimism and open-mindedness as we seek to transform our neighborhoods, groups, and communities into abolitionist spaces, both in theory and in practice.

By exploring the historic development of marriage laws and changing relationship norms in England, Qatar and Australia; the legal treatment of religious-only unions in light of the family law regime in each country, and the impact of non-recognition, this book reveals the complexities of the law reform needed to tackle these issues. This examination of the differing outcomes for couples who live in England/Wales where cohabitants have no legal rights, Australia where cohabitants do benefit from some legal protections, and Qatar, a Muslim majority state with a modern family law regime which ordinarily recognises religious marriages provides a broad canvas for exploring this issue in depth. The book looks at this very complex issue from a range of perspectives including autonomy, cultural transitions and legal pluralism. It examines the issue of religious-only marriages in order to convey the complex and interwoven narrative which signifies how multifaceted law reform must be in order to adequately respond to these transitioning relationship norms in any given jurisdiction. Of course, relationship norms are not static and they continue to evolve. In light of changing norms and practices, the theoretical framework for this book focuses on the concept of 'liminality' or transition, which is being witnessed in the processes and formalities by which Muslims are entering their marriages.
