The North America: Canada and the United States volume of the International Encyclopaedia of Restorative Justice presents an overview and systematic analysis of restorative justice law, policy, and practice across 28 jurisdictions (13 provinces and territories in Canada and 15 states in the United States). It addresses key research questions on the integration of restorative justice within, alongside, or outside criminal justice systems. The second part of the book is comprised of 9 thematic chapters that identify common historical strands in the region, address emerging issues, highlight promising advancements, and discuss structural challenges facing restorative justice theory and practice in the region.

A broad array of law enforcement and criminal justice issues are examined, including mass incarceration, sentencing disparities, anti-drug efforts, marijuana legalization, death penalty, mandatory minimums, civil asset forfeiture, prison privatization, rape and other crimes in prison settings, women in prison, support for therapeutic/educational programs, sentencing for juvenile offenders, harsher penalties for hate crimes, and voting rights for ex-felons. This book is the first comparative law study of collateral consequences of criminal conviction in all federally recognized Indian tribes in the lower 48 U.S. states, and the mechanisms for restoring civil rights in tribal law.Surveying the constitutions, codes, and ordinances of tribal jurisdictions reveals a broad range of consequences - the impact of which has not been comprehensively and critically examined. Like state and federal jurisdictions, tribal law attaches thousands of legal disabilities to tribal offices, business licenses and permits, social services, and civil rights for persons with criminal convictions. This is especially true in economically important industries such as gaming and resource extraction; additionally, rapidly changing areas such as marijuana regulation and sex offender registries expand the scope still further. This book catalogues restoration of rights procedures in tribal law, to include pardons, expungements, and record sealing. Collateral consequences have proliferated in tribal law because of the limitations of tribal criminal jurisdiction, including over non-tribal members. However, tribal collateral consequences risk contributing to overcriminalization and social exclusion for persons with previous criminal convictions, especially as Native Americans are already disproportionately impacted by the U.S. criminal justice system.This book will appeal to legal academics, scholars, and practitioners working in tribal criminal law, as well as to others with interests in Indigenous legal issues.

Criminal Convictions in U.S. Tribal Law

This volume of the Netherlands Yearbook of International Law (NYIL) examines general principles of law, which, alongside treaties and customary international law, traditionally form one of the three formal sources of international law, as enshrined in Article 38 of the Statute of the International Court of Justice (ICJ). The contributions in this volume are situated in the wider discussion on general principles reignited by the recent ILC reports and the reports of the Special Rapporteur on the matter. It aims to be part of a renewed wave of engagement with both the substance and methodology surrounding this mercurial formal source of international law.
Diverse functions are attributed to general principles by scholarship and case law: they are a source of various rules which merely form an expression of them; guidelines for a framework for interpretation/application of other rules; lacuna-filling norms; a source of interpretation of treaties and custom; a means for developing new treaties and custom; a supplemental source to treaties and custom; and even a modifier of treaties and custom. ‘General principles’ are here examined through various areas of international law, revealing their deep connections with other sources, overarching concepts such as time and change, and their diverse manifestations across the field.
As a double-blind peer-reviewed publication, NYIL offers a forum for the publication of scholarly articles of a conceptual nature in a varying thematic area of public international law. In addition, as of 2012 each volume includes a section entitled ‘Dutch Practice in International Law', which replaces the section previously dedicated to Documentation. The NYIL has been published under the auspices of the T.M.C. Asser Instituut since 1970.

This book provides an overview of male violence against women and the failure of the legal system. 

Male violence against women is pervasive. From the bedroom to the boardroom; from the home to the hospital; from the court to the care home, women are subject to male violence. The legal response to this is weak. The violence is either invisible or downplayed. This book explains why and how the law can do better. 

It explores how violence in different settings reinforces and magnifies the abuse in others. Too often violence against women is considered in silos (sexual assault; domestic abuse; street harassment, etc.). The book argues that they must be seen on a continuum. It brings out the common themes, but also the subtle differences in context between the scenes of violence. In doing so it argues that we cannot understand an incident of male violence against women without understanding the broader context within which that takes place. The book claims that the legal response to male violence against women downplays the severity of the harm or even fails to recognise it. 

This is a must-read for those interested in criminal law, gender politics, and feminist approaches to law. It is only when the true nature of the problem is grasped that the law can start to provide an effective response to it. This book shows how a better and more effective law can be found.
