With the promise of greater efficiency and effectiveness, public authorities have increasingly turned to algorithmic systems to regulate and govern society. In Algorithmic Rule By Law, Nathalie Smuha examines this reliance on algorithmic regulation and shows how it can erode the rule of law. Drawing on extensive research and examples, Smuha argues that outsourcing important administrative decisions to algorithmic systems undermines core principles of democracy. Examining and critiquing the February 2020 Annex VII award in Coastal State Rights, the book suggests that adjudicators would better implement the terms of UNCLOS and serve the legal system at large if they considered decisions of other international organs when these reflect consensus as to findings of fact and that they should also adhere to the standard methods of fact-finding familiar to parties and adjudicators in most legal systems. This is a book about law and its impact on our practical reasoning. Drawing on the work of Bernard Williams, the book argues that our practical engagements with the law are complex and often obscure. It begins with a novel view on practical reason that is called open-minded reasons internalism. This is a view that emphasises how certain considerations can bear on action for concrete agents, and in doing so it is an explanatory account of reasons and actions. The account is receptive to the considerations that makes much of peoples' lives: the motivations and dispositions they have, the notions of character and identity, and respect. The book explains that this account helps in making sense of much of the richness seen in real life in how concrete agents engage with the law. It provides the tools to explain when and why an agent identifies herself totally with the law, as Inspector Javert did in Les Misérables, but it can also explain the attitude of respect that many law-abiding citizens have, and even the merely prudential considerations of OW Holmes' famous 'bad man'. What emerges from this book is a view on law and practical reason that takes seriously the phenomenology of action. This book will be of particular importance to anyone interested in philosophical accounts of how we engage our practical reasoning with complex social practices.

This book examines the persistence of blasphemy provisions, their increasing use in post-authoritarian Indonesia and the extent to which religion has been instrumentalised for political ends justified by law.Based on empirical research and an analysis of more than a hundred court decisions that connects evidence to theoretical discussions, this book traces the evolution and dynamics of capitalism in relation to the nature of legal order and the operation of laws, particularly those related to religion. Using an interdisciplinary approach, the author offers a rich analysis of the competing discourses on blasphemy in Indonesia. The work bridges the literatures of law and other social sciences. Providing an updated analysis of Indonesian blasphemy laws, this book also aims to shed light on the dynamics of legal order that affect how and why such laws exist. Rather than merely documenting regulations on and cases of blasphemy, the study aims to further understand the operation of law as a reflection of power relations. Specifically, the book reveals that the persistence of blasphemy laws has more to do with the illiberal nature of Indonesia's legal order, which renders laws that privilege religious orthodoxy a practical instrument for religious mobilisation for political purposes, than with the cultural distinctiveness of Indonesian society or the lack of modern bureaucratic and legal institutions supporting secularisation, as many scholars have argued.Offering original contribution to scholarship on blasphemy, the politicisation of religion and illiberalism in democracies, this book will be of interest to academics in the field of Asian politics, law and Southeast Asia studies.

Patentstrategien können in Patentanmeldestrategien und Strategien zur Abwehr störender Patente unterteilt werden. In aller Regel werden Patente und nicht Patentanmeldungen als störend empfunden, da Patentanmeldungen im Gegensatz zu Patenten nicht durchgesetzt werden können bzw. da es noch überhaupt nicht bekannt ist, was überhaupt der Schutzbereich eines durchsetzungsfähigen Patents aus der Anmeldung sein wird. Der Schutzumfang wird erst durch die Patenterteilung bestimmt. Dann ist es möglich, dass der Schutzumfang der erteilten Anmeldung nicht mehr stört, da das eigene Produkt keine Patentverletzung darstellt. Außerdem ist es möglich, dass sich aus einer Patentanmeldung überhaupt kein Schutzbereich ergibt, da die Patentanmeldung zurückgewiesen wird. Eine Patentanmeldung ist eben ein noch ungeprüftes Schutzrecht. Ein eingetragenes Gebrauchsmuster ist ebenfalls ein ungeprüftes Schutzrecht, obwohl es als vollständig durchsetzbares Schutzrecht gilt. Dennoch wird es der Inhaber eines eingetragenen Gebrauchsmusters schwer haben, eine einstweilige Verfügung ohne vorherige mündliche Anhörung der Gegenseite zu erhalten. Die Chancen hierfür sind bei einem Patent deutlich besser.
Der Anmelder einer Patentanmeldung wird sich spätestens kurz vor Ablauf des Prioritätsjahrs vor die Frage gestellt sehen, ob er Nachanmeldungen in ausländischen Ländern vornehmen soll. Hierbei ist es relevant, in welchen Ländern wichtige Märkte für ihn sind und in welchen Ländern die Wettbewerber ihre Produktionsanlagen haben. Außerdem benötigt der Anmelder Informationen, wie am effektivsten und am kostengünstigsten Nachanmeldungen vorzunehmen sind bzw. welche Patentanmeldestrategien angewandt werden können. Dieses Fachbuch gibt dem Leser die Informationen an die Hand, die geeignete Anmeldestrategie zu finden und störende Patente abzuwehren. In der 2. Auflage des Buchs wird das seit Juni 2023 verfügbare Einheitspatent vorgestellt. Außerdem wurde in die 2. Auflage ein Kapitel zum Management von Patentportfolios neu aufgenommen, das eine praxiserprobte Methode zur Bewertung von Schutzrechten beschreibt. Wertlose Schutzrechte können so identifiziert und fallen gelassen werden, um Kosten zu sparen. 
Insbesondere kann die Methode zur Bestimmung der Stärke des eigenen und fremder Patentportfolios genutzt werden, um sich auf Verhandlungen bzw. streitige Verfahren mit Wettbewerbern vorzubereiten.
