The Ten Legal Cases That Made Modern Britain

The planetary boundaries framework - one of the most influential ideas of our age - is used to describe human-Earth relationships. It shapes global environmental policy and new economic thinking. This book presents a new perspective on the debate around legitimacy, politics and constitutional law in Supreme Courts. Moving away from the troubling perception that Supreme Courts are trampling on the wrong side of the law/politics divide, it accepts and defends the critical claim that constitutional law is intrinsically and inescapably politics: in style, substance and outcome. It explains what is involved in that claim and recommends a more nuanced and compelling account than it is caricatured to be. The book proceeds to demonstrate how the legal and judicial process can proceed if the law-is-politics critique is taken seriously. Insisting that it cannot be business as usual, the author offers a series of constructive proposals about how constitutional law and judicial decision-making can continue in anything like their present format and style. Recognising that a more radical approach could be taken to the way in which democracy might re-organise, the book runs with the idea that it is possible to incorporate and accommodate the law-is-politics argument within a governmental system of constitutional democracy that resembles closely what now occurs. In that sense, the book is both critical and constructive as well as principled and pragmatic.

Scotland does not have a 'law of contract', as most comparable jurisdictions do, but rather - due in large part to the intellectual innovations of Viscount Stair - possesses a unitary 'law of voluntary obligations', of which contracts form but a part. This fact is highly significant, but is frequently overlooked. Indeed, the significance of this has even been overlooked by the Scottish Law Commission, who have recently proposed to significantly reform the 'law of contract' in Scotland by urging the passing of a statute which, among other things, would abolish the so-called 'postal acceptance rule'. This short book takes the view that the proposed reforms are wrongheaded and would be deleterious to the coherence of the Scottish legal framework. To that end, it examines the taxonomy of obligations pioneered by Stair, indicates that the application of that taxonomy to situations such as the process of contracting by distance suggests that there is in fact no 'postal acceptance rule' in this jurisdiction and suggests, in light of this, that reform of 'contracts' and the formation of, in Scotland, is better left to the courts and jurists than to the Scottish Parliament (or, for that matter, Westminster).
