The Many Lives of Transnational Law

Critical Engagements with Jessup's Bold Proposal

This volume is the first in-depth collection to explore the impact of language on the field of comparative constitutional law. It addresses the epistemological and conceptual implications of English as the lingua franca. In this regard, it considers the global influence of Anglophone jurisdictions in orienting the discourse through the identification of concepts, designs and ideas that warrant engagement and exploration outside of those origin jurisdictions. In doing so, the book underscores that language is not a neutral device but can produce hegemonic pressures and expectations. It further makes the role of language in conducting comparative constitutional law explicit, so that its users can be more deliberate in their selection of foreign materials and are made conscious of the limitations of their findings due to language barriers. The book calls for a reckoning with the rich constitutional vocabulary that non-Anglophone jurisdictions have to offer to ensure a more holistic approach to the creation of knowledge. It also emphasises the need for the contextualised study of constitutional phenomena to appreciate how these are shaped by linguistic choices. In addition to raising awareness about language's significance as an epistemological, conceptual and methodological device, the volume also puts forward constructive tools and techniques to harness language's potential, making it an indispensable resource for scholars, students, lawmakers and judges.

The Language of Comparative Constitutional Law

This book explores how COVID-19 represents an inflection point for re-thinking and re-making democracy across the English-speaking world in an age where states are facing a future of overlapping crises. Years after the unprecedented COVID-19 pandemic started to unfold, have we yet learned the deep lessons essential to maintaining and improving democracy to meet crisis challenges? Produced with the benefit of distance from the most acute period of the pandemic, the book contextualises the COVID-19 crisis as revealing pre-existing vulnerabilities and intensifying challenges of governance, inclusion, and distrust, while also spurring democratic innovation and shifting the parameters for reform. Six national case studies - Australia, Ireland, Canada, Aotearoa New Zealand, UK and USA - reveal the heterogeneity of the Anglosphere as an imagined democratic space. Viewed in the round, pandemic responses ranged from the chaotic to the internationally lauded, although even the latter have featured acute deficiencies in democratic practice, which underscores the need to gather the lessons learned. Yet, in all states, the public and political temptation to simply move on, in an act of communal forgetting and collective return to "normalcy," presents a real risk of failing to prepare for more democratic future crisis responses. This collection takes the long view, approaching its subject from multiple perspectives that examine the heterogeneity of the Anglosphere as an imagined democratic space. Taking a cross-disciplinary approach and bringing together both leading and emerging experts on democracy, constitutionalism, and the rule of law, this book powerfully combines the insights of retrospective analysis with future-focused contemplation of where our democracies are heading.

This open access book establishes an interpretative framework by means of a functionalist-originalist reading of EU law and comparative federalism, in particular US constitutional law. The EU is undergoing one of the most profound structural crises of its history, relating to the rule of law and fundamental rights. The author conceptualises the existential question in terms of ontology, constitutional legitimacy, doctrine and institutional process. By providing the first conceptual methodology (based on comparative federalism and focusing on law and rights) the book develops proposals which can be used to address the EU's current constitutional challenges. This book is the first comprehensive academic treatment of the International Covenant on Economic, Social and Cultural Rights (ICESCR) and employment rights, which has a global vocation demonstrated by having been ratified by 173 States since it was adopted in 1966. Workers' rights need protection and reinforcement. To achieve this aim, international human rights standards can play an important role. The ICESCR is the most important global UN instrument in this respect. It covers a wide range of employment rights, including the right to strike, and has global application. But it is not sufficiently developed and used, and national implementation often needs improvement. Part 1 of the book analyses general issues related to the Covenant, such as context, development, challenges, influences at the global and regional levels, interpretation and procedural elements. Part 2 deals with the specific provisions which are directly linked to the employment relation. The book is based on a thorough analysis, mainly, but not exclusively, of the case law of the Committee on Economic, Social and Cultural Rights (CESCR), that is monitoring the national implementation of the Covenant. Together, the chapters in this book will empower academics and practitioners in labour law to find answers to relevant and practical problems in order to better enforce and improve workers' rights. The book is the result of a project by the 'Transnational Trade Union Rights' experts Network (TTUR), linked to the European Trade Union Institute (ETUI).
