Die vorliegende Arbeit zielt darauf, einerseits einige relevante argumentationstheoretische, diskurslinguistische und rechtslinguistische Aspekte zu den juristischen Diskursen zu behandeln und zu erörtern, andererseits intensiv zu analysieren und aufzuzeigen, wie anhand der Argumentationsanalyse die Zusammenhänge der Argumentationsstrukturen sowie -muster in den juristischen Diskursen analysiert werden (können). Die in der vorliegenden Arbeit durchgeführte Untersuchung kann einen Anstoß zu einem umfangreichen und systematischen Modell der juristischen Argumentation aus diskurslinguistischer und rechtslinguistischer Perspektive geben.

Ji-Hoon Oh hat von 2006 bis 2022 an der Heinrich-Heine-Universität Düsseldorf seine Promotion im Fach Germanistik absolviert. Seine Arbeitsschwerpunkte liegen in der Pragma-, Text-, Diskurs- und Rechtslinguistik sowie der linguistischen Argumentationsforschung.

This book explores the use of Third-Party Funding (TPF) in Investor-State Dispute Settlement (ISDS), a transformative yet controversial instrument that implicates procedural fairness, the commodification of justice, public interest, and state sovereignty in investment law.TPF is a topical, yet underexamined topic within international arbitration. With the TPF market now estimated to exceed USD 15 billion, its role in enabling investors to pursue expensive, high-value investment claims has attracted attention. The book comprehensively analyses the use of TPF in the context of the ISDS system, highlighting issues such as influence on the decision to settle, conflicts of interest, effects on procedural fairness, wealth transfer, and the commodification of justice. Deploying the literal translation 'making-good-again', this book focuses on the 'making' of law, literature and visual art to argue that restitution is a practice which is found in different genres, sites and temporalities. The practices of restitution identified are dynamic, iterative and incomplete: they are practices of failure. Nevertheless, in this book, the question of how to conduct restitution emerges as a material question of responsibility asked through the making of texts and objects in different genres, including law.
