The Impact of Directive (EU) 2024/1385 on Criminal Law

Directive 2024/1385, entitled 'on combating violence against women and domestic violence', sparked a wide-ranging debate on the scope of protection for sexual self-determination in Portugal, Germany and other legal systems, even though a provision comparable to Article 36 of the 'Istanbul Convention' was deleted during the legislative process. Furthermore, the relevance of the Directive is underlined by developments in the digital sphere and in political discourse. Deepfakes, hate speech and incitement to violence are widespread on social media platforms. These phenomena make the discussion on the appropriate use of (criminal law) instruments all the more urgent.
