Ce manuel universitaire, intitulé ' Cours d'Encyclopédie du Droit : Introduction Générale à l'Étude du Droit ', offre une exploration méthodique des fondations du savoir juridique. L'ouvrage s'adresse spécifiquement aux étudiants en début de cursus, leur fournissant les outils conceptuels nécessaires pour naviguer dans l'ensemble complexe des sciences juridiques, avec une orientation particulière vers les législations belge et française du XIXe siècle.La première partie est dédiée à l'analyse du droit en général et à ses manifestations. L'auteur y établit une distinction philosophique cruciale entre le droit naturel (idéal, universel, fondé sur la raison) et le droit positif (actuel, contingent). L'étude des sources du droit positif est exhaustive, couvrant le droit coutumier - en détaillant les conditions de son existence (uniformité, publicité, tolérance) - et le droit écrit ou légal. Concernant la loi, l'ouvrage explicite sa confection (procédure législative, sanction royale, promulgation, publication), ses effets dans le temps (principe cardinal de la non-rétroactivité des lois, incluant ses exceptions complexes en matière de droits acquis et de capacité des personnes) et dans l'espace (lois politiques, civiles, de police et de sûreté). Une section majeure est consacrée à l'interprétation des lois (authentique, doctrinale, par analogie, a contrario) et à leur application judiciaire, tout en soulignant la séparation des pouvoirs et la rigueur nécessaire pour éviter les abus de la juridiction volontaire.La deuxième partie déploie une classification du droit en quatre domaines principaux. Le droit politique englobe le droit constitutionnel (l'organisation de l'État, la souveraineté nationale, et les droits fondamentaux garantis par la Constitution belge, tels que l'égalité, la liberté individuelle, le droit de propriété et la liberté des cultes), le droit public organique, et un examen détaillé du droit administratif, y compris le droit de police et de finance. L'étude du droit administratif judiciaire est particulièrement riche, décrivant l'organisation, la compétence et la hiérarchie des juridictions (Cour de Cassation, Cours d'Appel, Tribunaux de Première Instance, Juges de Paix, Tribunaux de Commerce, Tribunaux Militaires) ainsi que la procédure civile et criminelle, introduisant le rôle des officiers ministériels (greffiers, avoués, huissiers, avocats) et des institutions de juridiction volontaire (état civil, notariat, conservation des hypothèques).Le droit privé est ensuite disséqué, commençant par le droit civil (issu principalement du Code Napoléon et des ordonnances royales françaises), puis le droit commercial (insistant sur sa nature dérogatoire au droit commun et ses sources comme l'ordonnance de 1673 et les codes modernes). Des chapitres spécifiques sont consacrés aux droits industriel, rural et forestier. Le droit pénal ou répressif est étudié sous l'angle de la philosophie du droit pénal (but de la peine, imputabilité) et du droit positif (crimes, délits, contraventions, peines), avec une perspective historique sur les réformes du XIXe siècle visant à modérer la sévérité des anciens codes. Enfin, le droit international (public et privé) est présenté, traitant des sources (traités), de la diplomatie (exterritorialité des agents) et des principes régissant les rapports privés transnationaux.

Die Einführung in das Europarecht bietet einen übersichtlich strukturierten und verständlichen Zugang zur Materie. Sie richtet sich an Studierende ebenso wie an Praktiker:innen, die sich rasch einarbeiten oder ihr Wissen gezielt auffrischen möchten. Die zentralen Fragestellungen des Europarechts werden fokussiert und ohne unnötige Vertiefungen vermittelt.

Im Mittelpunkt steht das Verständnis der grundlegenden Funktionsbedingungen, also der "Genetik", des Europarechts. Wer sie verinnerlicht hat, kann Problemstellungen sicher einordnen und fallweise relevante Details eigenständig vertiefen. The European Convention on Human Rights (ECHR) entered into force on 3 September, 1953, with a binding effect on all member states of the Council of Europe. It grants the people of Europe a number of fundamental rights and freedoms: right to life, prohibition of torture, prohibition of slavery and forced labour, right to liberty and security, right to a fair trial, no punishment without law, right to respect for private and family life, freedom of thought, conscience and religion, freedom of expression, freedom of assembly and association, right to marry, right to an effective remedy, prohibition of discrimination; plus some more by additional protocols to the Convention. Any person who feels that his or her rights are being violated under the ECHR by the authorities in one of the Member States can bring the case to the European Court of Human Rights, established under the Convention. The States are bound by the Court's decisions. Professor Grabenwarter's commentary systematically deals with the Convention, article-by-article, including development, scope, relevant case-law and literature.
