This open access book assesses whether European data regulation can be amended in light of contemporary technological developments. In an era when data powers our daily lives, economies and societies, data regulation is essential. However, European data regulation is still premised on concepts and foundations that were developed more than 50 years ago. The book offers an in-depth exploration of the European data regulatory landscape, from its historical roots to the challenges posed by new technological advancements. Through a detailed legal and technical analysis, it explores key data categories - such as anonymised, pseudonymised, aggregated, sensitive data, and metadata - highlighting their fluid and changing nature and the growing possibilities for transitioning between them. By identifying regulatory tensions and challenges arising from various technologies, such as AI, Big Data, and quantum computing, the book offers policymakers, legal scholars, computer scientists and data protection experts different perspectives on how to reshape future privacy and data protection legislation in a rapidly advancing technological world. <div>Human history is a history of individuals - of kings and queens, of leaders and thinkers and of the many individuals who struggle, work hard and find their paths in life. It is also the history of individuation, understood as a continuous search for autonomy, self-affirmation and the achievement of personal goals. But today, this process of individuation is coming to an end and morphing into its opposite - disindividuation. The individual is giving way to the progressive loss of individuality and social life is turning into the society of "dividuals" - that is, beings who are becoming unaware of their uniqueness and who are losing their sense of self.&nbsp;</div> <div>&nbsp;</div> <div>The main driver of this process is technology. The more that individuals rely on technological devices to fill the social void and mitigate loneliness, the more they are recognized not so much for themselves but as the bearers of the devices that contain all the information necessary for their identity: images, texts and the digital traces of earlier exchanges. Individuals increasingly renounce their privacy, sharing it with a device that becomes an integral part of themselves. Deprived of uniqueness, the dividual is a lonely being who no longer has the ability to relate effectively to others and to external reality. Why unfettered free-market capitalism endangers democracy—and what to do about it. In Private Power and Democracy’s Decline, Mordecai Kurz explores the relationship between free-market capitalism and democracy. He shows that technology has made capitalism different from what was envisioned in the Age of Enlightenment. Technology creates centers of market power and monopoly concentration that result in a society in which some people are enriched immensely while many workers’ livelihoods are often destroyed. Contrary to conventional thinking, technological competition does not remove market power, which becomes a permanent fixture of free-market capitalism. Such private power creates political inequality and generates forces that cause democracy’s decline and possible destruction. Applying these ideas to the US, Kurz shows that today’s problems begin in the 1980s with the policy of unregulated free-market capitalism. Coupled with the information technology revolution, this created a techno-winner-takes-all economy—leading to a second Gilded Age of unsustainable inequality and extreme political polarization. In the last 50 years, the economy “boomed” for some while leaving the majority of America’s workers behind. Kurz concludes that only regulated capitalism can support democracy so that the benefits of technology are more equally shared and no person’s livelihood is destroyed to enable others to be enriched. To save democracy, he proposes a “restoration-of-livelihood” policy, offering firms managerial flexibility to maintain rising productivity while ensuring that technology does not destroy the livelihood of others.
