Human Rights Law in Perspective

This book offers an analysis of how the European Court of Human Rights engages with identity and emotion, revealing both the promise and the limitations of human rights law in addressing the complexities of human experience. The book explores how human rights law, often framed as universal and abstract, responds to deeply personal questions of identity, belonging, and emotional impact. Based on a systematic study of over 3,300 judgments, the book shows how the European Court of Human Rights has increasingly made identity central to its reasoning - particularly in cases involving sexuality, ethnicity, and family life. In these areas, the Court acknowledges how state actions shape emotions such as fear, humiliation, and dignity. Yet, in other domains - migration, religion, professional life - the Court avoids emotional engagement, leading to troubling inconsistencies. The book argues that when emotions are excluded from legal reasoning, individuals are reduced to formal entities, stripped of depth and interiority. Combining doctrinal analysis with insights from social theory and psychology, the book presents a new framework for understanding how emotions and identity interact with law. It traces the evolution of identity references across categories and highlights the Court's uneven treatment of emotional harm. This timely and original contribution speaks to legal scholars, practitioners, and theorists interested in human rights, identity politics, and the emotional dimensions of law. It calls for a more responsive and empathetic human rights jurisprudence - one that reflects the lived realities of those it seeks to protect.

This open access book is a cultural history of lawsuits that explains the development of French performance rights from la Belle Époque, via the roaring Twenties, and into Post-War France. It does so by analysing the ways in which performers, composers, and playwrights used French court rooms, newspaper scandals, and international conferences to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. Towards the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre, the rise of modern celebrity culture and mass media, to the French governments' management of radio entertainment in the interwar period, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime, while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. Despite the remarkably serious problems caused by aging and population decline in Japan, there are very few books that inform the world about them in English. Through this book, a Japanese economic demographer clearly shows the various economic consequences of population problems in Japan, especially the impacts of continuing ultra-low fertility and the world's highest life expectancy in the post-demographic transition phase. The explanation is at a basic level but covers the overall economic issues including labor, capital, technical progress, consumption, savings and investment from a demographic perspective. Finally, some remedies for economic growth in Japan are proposed. Because economic policies are expected to have short-term effects while demographic ones to increase the fertility rate need some time to take effect, earlier books about the Japanese economy have hardly ever dealt with demographic policies. Furthermore, this book directly addresses the integrated economic and demographic policies appropriate to Japan. These are different from the French natalistic social policy, the Scandinavian policy of a work-life balance or the immigration policy in Australia or the United States. This book emphasizes the power of local communities in Japan as a part of East Asia. In this sense, the book provides a new key to readers who are interested in the future Japanese economy and population.
