Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania. Hart Studies in European Criminal Law

Through an examination of the underlying technology driving digital currencies, this book offers a comprehensive understanding of the mechanisms governing their operation, clarifying complex legal concepts and confronting the pressing issue of anonymity inherent in digital currency transactions. The book focuses on two categories of digital currencies: cryptocurrencies (e.g. bitcoin) and in-game currencies (the currencies used in the closed virtual environment of a game). Despite their differences in governance - cryptocurrencies being decentralised and in-game currencies being centralised-they share significant similarities in terms of anonymity, which presents a notable issue within the anti-money laundering (AML) framework. Against the backdrop of both the international AML standards developed by the Financial Action Task Force (FATF) and the European Union AML regime, the book examines the AML compliance stage of the private sector and, specifically, the collection and retention of data relating to digital currency users. It analyses the new AML Regulation, alongside the 5th AML Directive, the Market in Crypto-Assets (MiCA) Regulation and the 'Travel Rule' Regulation, to construct a complete picture of the obligations imposed on virtual asset service providers and to assess whether the new framework disproportionately interferes with the right to privacy and data protection of the end user. In doing so, the book offers the first legal assessment of the proportionality of private-sector AML obligations in the field of digital currencies based on the argument that, in this context, EU AML law is increasingly transforming into a surveillance regime.

When a natural person engages in insider dealing or commits market manipulation, they can be held liable for it. But what applies in this regard to legal persons? The Market Abuse Regulation (MAR), which sets out the prohibitions on market abuse in Articles 14 and 15 MAR, contains no explicit statement on this matter. Carl Alexander Strobel first demonstrates that, in principle, the applicable legal framework is not national law but exclusively Union law. In this respect, the MAR contains a legal gap. This gap may be filled by the CJEU through judicial development of the law. The aim of such judicial development must be a framework that achieves the best possible balance between the effectiveness of the prohibitions and the protected interests of legal persons. Accordingly, violations of the market abuse prohibitions are attributable to a legal person when the acting natural person is subject to the legal person's organisational authority and the violation occurs "on its behalf ". There are also strong arguments that liability should be excluded where the legal person has implemented adequate preventive measures. These conditions generally apply whenever the question arises whether a legal person has violated Articles 14 et seq. MAR. The exception concerns the imposition of administrative fines on legal persons, for which national law must be applied in compliance with the requirements of Directive 2014/57/EU (CRIM-MAD).
