Exploring a Translation of the Constitutional Political Rights into the Digital Sphere

Constitutional Rights in the Digital Context

Governments around the world are privatizing everything, with dramatic but largely ignored negative consequences for human rights. This open access book outlines the response that is urgently needed. Corporations are being given control over water, healthcare, housing, public transportation, child welfare services, aged care, and much else. Privatization is promoted by international financial institutions, consulting firms, and development actors as the answer to public finances devastated by the very tax cuts insistently pushed by these groups. Their pitch is based upon a mythology that extols the virtues of an idealized market while ignoring the heavy human rights costs incurred. Building on the latest evidence and on specially commissioned case studies, this book shows how the touted 'efficiency' of the private sector is often predicated on higher charges and/or reduced services, destructive employment practices, and the highly predictable exclusion of many users. Privatization generally costs states more money, marginalizes democratic decision-making, and transforms citizens from rights-holders into customers while sidelining accountability. The authors develop an approach designed to enable human rights actors, including courts, UN treaty monitoring bodies, and NGOs to move beyond their longstanding agnosticism towards privatization. It starts with a presumption that privatization is inherently retrogressive in human rights terms. Whatever mix of public and private is reflected in any given arrangement, governments must retain the degree of control necessary to ensure respect for rights, and the legal, financial and administrative ability to do so. The book charts a new direction for responding to the ever-growing threat that privatization poses to human rights. A new paradigm based on quantum probability that can model stock markets and price options—and also upends classical quantitative finance. In The Quantum Stock Market, David Orrell combines theory and new empirical findings to argue for a new approach to finance based on quantum probability. The main finding, a property called q-variance, may be unique in finance in that it was discovered as the result of a prediction, affects financial markets in general, has no tunable parameter, and has important consequences for a range of topics including the pricing of financial options. The property, which somehow eluded detection for over a century, has been verified by experts in the field. And the fact that it is incompatible with classical finance—which is perhaps why it went undetected—suggests that the field must be reinvented. The aim of this book is therefore nothing less than to initiate a paradigm shift in finance. As with any new work that challenges existing methods, the ideas have already received considerable pushback from a range of sources, including leaders in the field of finance, along with physicists skeptical of applying quantum probability outside its traditional domain. Written in an interdisciplinary style that mixes mathematical equations, data analysis, and informed comment on the field of finance, it should be read by anyone—including students, academics, and practitioners—who wants to be on the right side of a paradigm shift.

Fiscal transfers are often perceived to undermine democracy, as politicians utilise them to build patronage networks, weaken opposition candidates, and reward local governments that support them. On the other hand, others have argued that fiscal transfers serve to improve local governance, increase transparency, reduce corruption, and promote democracy. &nbsp;Drawing on eleven country case studies from Europe, Asia, and Africa, this book examines the extent to which local governments are affected with the risks connected with intergovernmental fiscal transfers.
