&lt;p&gt;Der Mobilitäts- und Verkehrssektor stellt eine tragende Säule der Unionspolitik dar und ist als integraler Bestandteil für das Funktionieren der europäischen Wirtschaft zu betrachten. Rund ein Viertel aller Treibhausgasemissionen der Europäischen Union entfallen auf den Verkehrssektor. Die Mitgliedstaaten sehen sich daher mit der Herausforderung konfrontiert, die im Verkehrssektor entstehenden Treibhausgasemissionen beträchtlich zu reduzieren. Maßnahmen wie Fahrverbote und Verkehrsbeschränkungen können eine wesentliche und effektive Maßnahme zur Reduktion von Treibhausgasemissionen darstellen, wobei einige Städte bereits eine Vorreiterrolle hinsichtlich mobilitätsbezogener Maßnahmen einnehmen. Während in mehreren europäischen Städten längst Fahrverbote für Kfz zur Verbesserung der Luftqualität bestehen, sind keine Fahrverbote mit dem vorrangigen Ziel der Reduktion verkehrsbedingter Treibhausgasemissionen auszumachen. In dem vorliegenden Werk wird aus (unions-)rechtlicher Perspektive untersucht, inwiefern auf lokaler Ebene örtlich begrenzte Fahrverbotszonen für Fahrzeuge mit Verbrennermotoren als Maßnahme zur Begrenzung verkehrsbedingter Treibhausgasemissionen eingeführt werden können. Die rechtliche Zulässigkeit von Fahrverbotszonen wird dabei im Lichte des einschlägigen Unionsrechts und des innerstaatlichen Rechts betrachtet.&lt;/p&gt;

This book considers the derivative action, an important corporate governance tool which is commonly considered to serve two basic functions, i.e., enabling shareholders to gain redress for a wrong done to their company and deterring potential breaches of directors' fiduciary duties. This book critically examines the derivative action from theoretical, evolutionary, and comparative perspectives. It considers how controversial issues such as locus standi, demand requirements, indemnity cost orders, information asymmetry and res judicata are approached in selected civil law countries as well as throughout the Commonwealth. The book also assesses whether derivative litigation could fulfill a similar role in China, which is one of the most rapidly developing economies in the world, yet lacks adequate corporate governance mechanisms. The ultimate aim discussed in the book is how to establish a remedial mechanism which makes derivative actions more accessible and consistent, while maintaining the balance between corporate efficiency and protecting minority shareholders' interests. Lastly, based on different approaches in the latest reforming infrastructure, it explores whether there is a general converging trend for derivative actions between the two major legal systems.

&lt;p&gt;Definitions within legal fields have always been subject to significant debate, with some recurring more often than others. Every now and then, a perspective arises which transforms the orthodoxy. As such is the case with the notion of precedent. Outlining its contours establishes a continuity between disparate and temporally distinct traditions. It requires theoretical-philosophical speculation, historical-comparative sense, and attention to the particularities of Brazilian Law.&lt;/p&gt;

A Curious Case

Ratio Decidendi and Obiter Dictum

The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.

This book examines the relationship between EU energy politics and the law of the World Trade Organization (WTO), focusing on how the EU's Internal Energy Market can be promoted and protected in a way that is consistent with the requirements of WTO law. The need for a significant reorientation of the EU foreign policy, including its trade and energy policy, has become apparent in today’s rapidly changing geopolitical context. Many states are responding to this situation by seeking to increase their “strategic sovereignty”. In the EU, this reorientation is taking place under the leitmotivs of “strategic autonomy” in its foreign affairs and “open strategic autonomy” in the EU’s external trade context. Given that the many current geopolitical shifts also affect the international energy landscape, it has been argued that the EU needs to increase its autonomy in the field of energy policy. As the EU’s Internal Energy Market is central to this, it needs to be protected from undue foreign influence. In this respect, three horizontal unilateral tools that are part of the EU’s strategy of open strategic autonomy have been considered essential in relevant academic studies: the EU Investment Screening Regulation, the EU Carbon Border Adjustment Mechanism (CBAM) and the EU Foreign Subsidies Regulation. This study shows that while it is strategically imperative to protect the Internal Energy Market from undue foreign influence, it is difficult to achieve this objective in a WTO-compatible manner on the basis of the unilateral measures adopted by the EU.
