Die Zivilgerichte haben der öffentlichen Hand mehrfach untersagt, eigene (digitale und analoge) Publikationen zu verbreiten. Zur Begründung führen sie das Gebot der Staatsferne der Presse an: Betätige der Staat sich auf dem Gebiet der Presse, gefährde er die Interessen privater Verleger und die neutrale öffentliche Meinungsbildung der Bevölkerung. Doch das Gebot der Staatsferne der Presse ist positivrechtlich nicht ausdrücklich normiert. Der BGH hat den Grundsatz selbst entwickelt und aus Art. 5 Abs. 1 S. 2 GG abgeleitet. Die vorliegende Arbeit untersucht, ob sich ein solches Gebot aus dem Grundgesetz ableiten lässt und ob es als wettbewerbsrechtliche Marktverhaltensregelung vor Zivilgerichten durchsetzbar ist.
