This open access book establishes an interpretative framework by means of a functionalist-originalist reading of EU law and comparative federalism, in particular US constitutional law. The EU is undergoing one of the most profound structural crises of its history, relating to the rule of law and fundamental rights. The author conceptualises the existential question in terms of ontology, constitutional legitimacy, doctrine and institutional process. By providing the first conceptual methodology (based on comparative federalism and focusing on law and rights) the book develops proposals which can be used to address the EU's current constitutional challenges. Das Werk richtet sich - der Konzeption der Reihe entsprechend - in erster Linie an Studierende der Rechtswissenschaft in den ersten Semestern und will insoweit die Grundlagen des Rechtsgebietes verständlich und im Überblick darstellen. Es werden die für das grundsätzliche Verständnis notwendigen Strukturen des Zivilrechts erörtert, wobei keinerlei Vorkenntnisse vorausgesetzt werden. 
Der Besondere Teil des Schuldrechts (§§ 433-853 BGB) wirkt für Studienanfänger durch die geradezu überwältigende Diversität der Schuldverhältnisse schwer überschaubar. Das Werk behandelt die im Jahr 2018 geltenden Regelungen, ohne die frühere Rechtslage vorauszusetzen oder zu wiederholen. Der Klausurpraxis entsprechend werden dabei Kauf-, Miet- und Werkvertrag in den Vordergrund gestellt, aber auch die anderen Ver-tragstypen in ihren zentralen Merkmalen und Gemeinsamkeiten behandelt. Etwa die Hälfte des Werkes wird für die gesetzlichen Schuldverhältnisse (Geschäftsführung ohne Auftrag, Bereicherungsrecht, De-liktsrecht) aufgewandt. Hier wird die Struktur in den Vordergrund gestellt. Ziel ist es, ein Verständnis für den Anwendungsbereich, aber auch die näher zu diskutierenden Voraussetzungen zu entwickeln.
Das Werk vermeidet es, Meinungsstreitigkeiten, die erst für höhere Semester oder Examenskandidaten bedeutsam werden, zu vertiefen. Anhand einer Vielzahl kleinerer Fälle sollen die Problemstellungen verdeutlicht und die Studierenden in die Lage versetzt werden, die Klausuren und Hausarbeiten im Grundstudium erfolgreich zu bewältigen. Dies wird durch konkrete Klausurtipps, Formulierungshilfen, Merksätze, Definitionen und Aufbauschemata sichergestellt.

This book offers the first detailed study of women's legal status in early modern Liège, an otherwise largely overlooked case in European legal history. It follows women across the course of their lives, from birth to widowhood, to show how their legal position and control over property shifted over time, depending on their social status and place within the family. Drawing on a substantial body of wills and marriage contracts from notarial practice, it moves beyond traditional sources to show how the law actually worked in everyday practice, and who took part in its creation. By bringing all these elements together, this book offers a nuanced picture of how law and gender interacted in early modern Europe.

This book analyzes the rhetorical and ethical dynamics of a culture of jihadi cool/chic, and why these rhetorical and aesthetic techniques have been such a powerful recruitment force for particular transnational terrorist groups.
