Research Paper (postgraduate) from the year 2016 in the subject Law - Miscellaneous, grade: 1,0, University of Kaiserslautern, course: Patentrecht, language: English, abstract: This work investigates the behavior of patent trolling entities in the European, German and American patent system. Legislative, judicial, executive and private measures with the intent to contain the rent seeking and abusive conduct of patent trolling entities are discussed. Moreover, the impact of these measures on other entities in the patent system are examined. The most efficient measures are assumed to show a high selectivity and a strong impact on the business model of the trolling entity, while negative effects on other entities are minimal or non-existent and positive effects are preferred. According to these requirements, suitable measures to increase the patent quality like improving the patent examination processes of the patent office or the inter partes and the post-grand review are debated. Furthermore, the introduction of a peer to patent network or Patent Investment Trusts (PIT) are examined. To cut through growing patent thickets, the collaboration with patent pools or patent pledges is proposed. At last, the differences between the European, German and American patent system regarding their vulnerability to trolling entities are elucidated. In the end, containment measures against patent trolling behavior should selectively target the business model of patent trolling, which is expected to arise from the weak spots of the patent system.

Studienarbeit aus dem Jahr 2005 im Fachbereich BWL - Beschaffung, Produktion, Logistik, Note: 1,3, Universität Duisburg-Essen (BLI), Veranstaltung: Business Systems Engineering, Sprache: Deutsch, Abstract: In den letzten Jahren haben automatische Identifizierungssysteme (Auto ID) einen enormen Zuwachs in der Beschaffungs- und Distributionslogistik im Handel und in vielen anderen Dienstleistungsbereichen gehabt.&#13;Hier gilt es Daten und Informationen über Güter und Waren allen beteiligten Instanzen zur Verfügung zu stellen, welches die Hauptaufgabe der Auto ID Systeme ist.&#13;&#13;Vor vielen Jahren revolutionierte der Barcode, gedruckt auf Verpackung oder Etiketten, den Markt und Handel. So ist der Barcode die bislang günstigste Variante, der Auto ID Systeme. Die jedoch geringe Speicherkapazität, so wie die unmögliche Umprogrammierung, stellt einen Engpass für das erhöhte Datenaufkommen in der Logistik da.&#13;Weitaus flexibler und leistungsstärker ist ein Auto ID System, das als RFID - System (Radio Frequency Identification) bezeichnet wird, welches die gespeicherten Daten und benötigte Energie durch induktive Übertragung mit einem dazu gehörigem Lesegerät kontaktlos austauschen kann. Die Entwicklung solcher RFID - Systeme wurde von einer Vielzahl von Firmen sehr stark vorrangetrieben und entwickelt sich zu einem eigenständigem interdisziplinären Fachgebiet.&#13;Jedoch die Technik als solche ist längst nicht neu, so wird diese Art der Transponder Technologie schon seid längerer Zeit in der KFZ Fertigung eingesetzt und dient in einfacher Bauform auch als Wegfahrsperre.&#13;Die Software- und Hardwarehersteller arbeiten intensivst an einer einheitlichen Lösung für Logistik und Handel um RFID entlang der gesamten Logistikkette einsetzbar zu machen. Aufbauend auf den Systemen vorhandener Auto ID Systeme, sind die Probleme der Integration und des globalen Einsatzes, insbesondere die einheitliche informationstechnische Infrastruktur, immer noch zu lösen.&#13;Dies ist insbesondere für den Einsatz von RFID in der Logistik sehr relevant, so gilt es eine Systemgestaltung zu entwickeln, um Produktdaten, via Internet, unter den vielen Akteuren, wie Lieferanten, Hersteller und Kunden, auszutauschen und nachvollziehbar zu machen.&#13;

Seminar paper from the year 2011 in the subject Leadership and Human Resource Management - Miscellaneous, grade: 2.0, University of applied sciences, Munich, course: MBA, language: English, abstract: The objective of this paper is to provide John Maynard, head of the human resource department of Tamiflex, with a sound recommendation whether he should accept Marit Iyang’s application for the position as the head of the new sales department in Bangalore, India. Iyang, born in India and currently working as a sales manager in the company’s German headquarter, is highly qualified for the job due to her MBA-degree and three years of working experience as an expatriate in a sales office in China. Marit Iyang’s possible compensation as an expatriate manager in Bangalore is calculated using the balance sheet approach and considering the COLA index. In contrast the salary of a local sales manager with comparable qualifications is evaluated with an empirical, self-made survey. While Iyang’s compensation consisting of a base salary, cost of living allowance, overseas service premium, hardship allowance and housing allowance would add up to EUR 129,312, the total annual costs for a local sales manager would not exceed EUR 15,000. Thus the labor costs for Iyang are significantly higher but the company would benefit from her local background as well as from her working experience in the headquarter of Tamiflex. Marit Iyang should definitely be assigned as the head of the sales department in Bangalore, India.

Many recent changes in the PCT are making it an increasingly more attractive option for applicants looking to protect inventions by means of international (PCT) applications. Still a great advantage of the PCT is that applicants are not limited to the 12-month priority period to decide on the States in which to seek patent protection, but instead they can extend this time limit by a further 18 months simply by filing an international application. In addition, the PCT extends even further options which the applicant can avail himself of to get his application searched and undergo a (preliminary) examination right in the international phase. These options allow an applicant to get a good grasp of his potential scope of patent protection right upon entering the national/regional phase. For example, ever since January 1, 2009, in addition to the international search, the PCT has also offered the option of having further (supplementary) international searches carried out so as to better serve the increasing diversity of languages among prior art documents. 

Particularly when compared to a European (EPC) application, an international (PCT) application has even further advantages, leading increasing numbers of applicants from EPC Contracting States to now favor international applications. One such advantage is that the PCT has no claims fee, so that without paying additional fees, applicants can have more than 15 claims subject to a search and (preliminary) examination in the international phase. This is particularly advantageous for highly-complex inventions which can be claimed in their entirety under the PCT without first being required to unnecessarily limit the application's scope of protection. Another advantage that the PCT provides for is that in cases of non-unity of invention, applicants will be invited to pay additional search fees. Thus, the PCT ensures that applications will be fully searched and examined (as need be) in the international phase - even despite lack of unity - so that applicants can use this information in deciding which inventions should enter the national/regional phases. These and other advantages of the PCT are steadily magnifying the importance of international PCT applications in everyday practice. 

Yet in everyday practice, the complicated structuring to the text of the PCT rules has led to considerable difficulties in answering the many questions related to such international applications, since almost all of the contentious issues are decided by the PCT member states themselves and fixed in the rules by means of regulations. 

The purpose of this book is to give a practice-oriented rendition of the PCT which discusses all the essential issues and questions which arise chronologically - starting with the initial filing of an international application, continuing through the international phase, and on up to entering the national/regional phase - all from the standpoint of the questions and contingencies occurring in actual practice. This book answers these questions using the actual wording of the articles and rules and, especially drawing on the PCT Guide, the PCT Newsletter and the PCT Gazette, then incorporates additional details on designated Offices and legal information important from the European perspective.
